{"id":292807,"date":"2026-01-19T21:05:08","date_gmt":"2026-01-19T21:05:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/292807\/"},"modified":"2026-01-19T21:05:08","modified_gmt":"2026-01-19T21:05:08","slug":"retired-superintendent-helped-end-limerick-gang-feud-that-killed-23-gardai-trial-told","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/292807\/","title":{"rendered":"Retired superintendent helped end Limerick gang feud that killed 23, garda\u00ed trial told"},"content":{"rendered":"<p>A retired garda superintendent accused of unlawfully quashing pending penalty points has been described as an outstanding crime fighter who previously used his discretion to save lives.\u00a0<\/p>\n<p>Former superintendent Eamon O\u2019Neill, and four serving garda\u00ed, are on trial at Limerick Circuit Criminal Court charged with a total of 39 counts of engaging in conduct tending or intended to pervert the course of justice.<\/p>\n<p class=\"\">The four serving garda\u00ed on trial along with Mr O\u2019Neill are sergeant Anne Marie Hassett, sergeant Michelle Leahy, Garda Colm Geary, Garda Tom McGlinchey, all serving in the Limerick and Clare divisions.<\/p>\n<p class=\"\">The use of a garda\u2019s discretion \u2014 to cancel pending traffic tickets \u2014 when dealing with members of the public has been central to the trial.<\/p>\n<p class=\"contextmenu caption\">Dedicated crime fighter<\/p>\n<p class=\"\">On Monday, the trial heard from retired chief superintendent Gerry Mahon, who described Mr O\u2019Neill as one of the most dedicated crime fighters he had ever worked with.<\/p>\n<p class=\"\">Mr Mahon said Mr O\u2019Neill was one of a handful of garda\u00ed responsible for restoring peace to the streets of Limerick when the public faced \u201canarchy\u201d from the feuding gangs which, he said, murdered 23 people, including innocent bystanders, between 1997 and the mid-2000s.<\/p>\n<p class=\"\">Mr Mahon recalled how Mr O\u2019Neill had used his discretion when dealing with a man he had arrested for an alleged public order offence but who had requested to attend a family event.<\/p>\n<p class=\"\">Mr Mahon said this individual was attacked and stabbed 20 times in a gang hit, but he survived, and \u201che would only give a statement to Mr O\u2019Neill\u201d due to the discretion Mr O\u2019Neill showed to him previously.<\/p>\n<p class=\"\">Mr Mahon said this was a groundbreaking moment for garda\u00ed, as the norm up to then had been that gangs did not talk to garda\u00ed.<\/p>\n<p class=\"\">\u201cAs a result, five gang members were charged with murder \u2014 it really was the key that opened up the door and decimated the gangs,\u201d Mr Mahon said.<\/p>\n<p class=\"\">Mr Mahon said Mr O\u2019Neill \u201csaved many lives&#8221; while serving as a garda, and helped \u201cput an end to the horrific warfare\u201d at great risk to himself.<\/p>\n<p class=\"\">After he learned that Mr O\u2019Neill was charged in connection with the cancelling of traffic tickets, Mr Mahon wrote a 17-page letter to the Garda Commissioner outlining Mr O\u2019Neill\u2019s professionalism.<\/p>\n<p class=\"\">Mr Mahon said he was also routinely asked by members of the public \u201cfor discretion\u201d and he often used it. He often used and sanctioned \u201clight touch policing\u201d to build the trust of the community, he told the court.<\/p>\n<p class=\"\">\u201cWe brought a common, basic humanity to it,&#8221; Mr Mahon said.\u00a0<\/p>\n<p class=\"\">Mr Mahon argued:<\/p>\n<p class=\"\">\n            You have the law, you have the human being in front of you, and you have discretion, it is in every facet of policing.\n        <\/p>\n<p class=\"\">\u201cA member of the public is entitled to ask a garda for discretion, a garda\u2019s application of the law is greatly facilitated by the use of his\/her discretion.\u201d\u00a0<\/p>\n<p class=\"\">The court heard that under previous Garda policy, local garda superintendents did have the power to cancel traffic tickets, but the policy changed following the so-called penalty points scandal.<\/p>\n<p class=\"\">Senior prosecuting counsel, Carl Hanahoe, put it to Mr Mahon that a Garda HQ directive implemented in 2014 resulted in the power to cancel traffic tickets being removed from local superintendents and given to three superintendents based out of a \u201ccancelling authority, Thurles, Co Tipperary\u201d.<\/p>\n<p class=\"\">Mr Mahon agreed with Mr Hanahoe that Garda policy at the time meant that Mr O\u2019Neill did not have the power to cancel traffic tickets when it is alleged he was involved in doing so.<\/p>\n<p class=\"\">Mr Mahon said this might or might not have resulted in a potential breach of garda disciplinary procedures, but that in his opinion, it was not a criminal offence.<\/p>\n","protected":false},"excerpt":{"rendered":"A retired garda superintendent accused of unlawfully quashing pending penalty points has been described as an outstanding crime&hellip;\n","protected":false},"author":2,"featured_media":292808,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[9,10,27,18,13,14,11167,6,19,17,11,12,15,16,5,7,8],"class_list":{"0":"post-292807","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-headlines","8":"tag-breaking-news","9":"tag-breakingnews","10":"tag-courts","11":"tag-eire","12":"tag-featured-news","13":"tag-featurednews","14":"tag-gardai","15":"tag-headlines","16":"tag-ie","17":"tag-ireland","18":"tag-latest-news","19":"tag-latestnews","20":"tag-main-news","21":"tag-mainnews","22":"tag-news","23":"tag-top-stories","24":"tag-topstories"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@ie\/115923801221062883","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/292807","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=292807"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/292807\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/292808"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=292807"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=292807"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=292807"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
