{"id":296355,"date":"2026-01-21T20:13:08","date_gmt":"2026-01-21T20:13:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/296355\/"},"modified":"2026-01-21T20:13:08","modified_gmt":"2026-01-21T20:13:08","slug":"meps-refer-mercosur-deal-to-eu-courts-throwing-future-of-trade-agreement-into-doubt-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/296355\/","title":{"rendered":"MEPs refer Mercosur deal to EU courts, throwing future of trade agreement into doubt \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The future of the <a href=\"https:\/\/www.irishtimes.com\/tags\/european-union\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-union\/\">EU<\/a>&#8211;<a href=\"https:\/\/www.irishtimes.com\/tags\/mercosur\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/mercosur\">Mercosur<\/a> free trade deal has been thrown into doubt by a <a href=\"https:\/\/www.irishtimes.com\/tags\/european-parliament\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-parliament\/\">European Parliament<\/a> decision to refer the landmark deal to the courts, potentially holding up its ratification by two years. <\/p>\n<p class=\"c-paragraph paywall \">European leaders will now have to consider whether the trade deal between the EU and four South American countries should come into force provisionally, before it has been approved by MEPs, a move that would prove incredibly contentious. <\/p>\n<p class=\"c-paragraph paywall \">A sizeable majority of EU states backed the trade pact earlier this month, allowing it to be approved despite the objections of Ireland, France, Poland and others. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/your-money\/2026\/01\/15\/irish-farm-and-meat-industry-lobby-is-overstating-the-impact-of-mercosur-on-beef-market\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Smart Money: Subscriber Only Smart Money Where\u2019s the beef? A vote to ratify or reject the agreement was expected in April or May.<\/p>\n<p class=\"c-paragraph paywall \">However, MEPs on Wednesday first voted to refer the trade agreement to the European Court of Justice (ECJ), to rule on whether it complies with EU treaties. The decision will put the ratification process on ice pending the court ruling, which may take at least a year and a half to issue. <\/p>\n<p class=\"c-paragraph paywall \">The parliament\u2019s decision to kick the deal to the EU courts passed by a narrow margin of 10 votes. <\/p>\n<p class=\"c-paragraph paywall \">Fine Gael MEP Sean Kelly criticised the move to trigger a legal review. \u201cI personally do not see any genuine legal reasons for such a referral. MEPs are elected by their constituents to take decisions,\u201d he said. <\/p>\n<p class=\"c-paragraph paywall \">The vote had taken on greater significance given the latest rupture in transatlantic relations and fears a EU-US trade war may be on the horizon. <\/p>\n<p class=\"c-paragraph paywall \">Supporters of the trade agreement view the deal as crucial to Europe reducing its economic dependence on Washington, by opening up a big new South American market for trade. <\/p>\n<p class=\"c-paragraph paywall \">The deal will lower tariffs and other barriers to trade between EU countries and Brazil, Argentina, Uruguay and Paraguay. <\/p>\n<p class=\"c-paragraph paywall \">The European Commission, the EU executive body that leads on trade, has the power to bring the trade agreement into force provisionally, before it is ratified by MEPs. <\/p>\n<p class=\"c-paragraph paywall \">However, such a decision would draw fierce backlash from opponents of the deal, including farmers and environmentalists, political parties on the far right and the far-left, and perhaps governments in France, Ireland and Poland. <\/p>\n<p class=\"c-paragraph paywall \">The European Commission would likely only allow the deal to come into effect provisionally with the backing of national governments.
