It&#8217;s a real possibility, warns Stephen Brobeck, senior fellow with the Consumer Policy Center.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">Brobeck, a consumer advocate who has authored reports on <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/06\/18\/low-fee-brokers-a-viable-option-for-home-sellers\" rel=\"nofollow noopener\" target=\"_blank\">low-fee brokerages<\/a> and <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2024\/07\/16\/consumer-watchdog-shares-its-recipe-for-buyer-agreements\" rel=\"nofollow noopener\" target=\"_blank\">buyer agreements<\/a>, believes an industry-wide push for private listings combined with <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/04\/10\/brokerages-boosted-sales-in-2024-despite-tough-market\" rel=\"nofollow noopener\" target=\"_blank\">the current consolidation moment<\/a> could vastly change the future of real estate sales, impacting agents and consumers alike.\u00a0<\/p>\n<p>An uncertain future for small brokerages<\/p>\n<p class=\"Document_p__O_O2M\">Small, independent teams and firms have reason to worry about the direction of the industry, Brobeck suggests, particularly as large brokerages like <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/04\/04\/how-compass-staged-its-pre-marketing-blitz-in-seattle\" rel=\"nofollow noopener\" target=\"_blank\">Compass<\/a>, <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/07\/12\/hoby-hanna-zillow-is-overstepping-limiting-creativity\" rel=\"nofollow noopener\" target=\"_blank\">Howard Hanna<\/a> <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/03\/05\/inside-kw-gos-usd1-billion-private-listing-playbook\" rel=\"nofollow noopener\" target=\"_blank\">and others<\/a> seek to maintain control over their listings and inventory via office exclusives and brokerage-specific websites.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">As far as small brokerages go, <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/02\/27\/no-clear-cooperation-expect-an-explosion-in-private-listings\" rel=\"nofollow noopener\" target=\"_blank\">a large-scale shift to private listings<\/a> would &#8220;put them right out of business,&#8221; Brobeck told Real Estate News.<\/p>\n<p class=\"Document_p__O_O2M\">&#8220;I mean, who&#8217;s going to go to a Realtor who has access to only a third of the market? That&#8217;s where this could go, and it could go pretty quickly,&#8221; he explained.<\/p>\n<p>If the dominoes start to fall, &#8216;it&#8217;s like World War I&#8217;<\/p>\n<p class=\"Document_p__O_O2M\">While <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/06\/05\/compass-ceo-lambastes-mlss-nar-in-fiery-keynote\" rel=\"nofollow noopener\" target=\"_blank\">Compass has been the most outspoken<\/a> \u2014 and has focused much of its <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/02\/01\/compass-launches-client-portal-amid-private-listings-push\" rel=\"nofollow noopener\" target=\"_blank\">brokerage strategy around &#8220;private exclusives&#8221;<\/a> \u2014\u00a0others have quietly followed suit or said they&#8217;re prepared to pivot in the same direction.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">Anywhere CEO Ryan Schneider has repeatedly said the company <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/07\/29\/anywhere-revenue-inches-up-despite-weird-housing-market\" rel=\"nofollow noopener\" target=\"_blank\">is ready to flip the switch<\/a> on private listings, and eXp CEO Leo Pareja told Real Estate News<a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2024\/11\/13\/exps-ceo-on-clear-cooperation-you-cant-take-but-not-give\" rel=\"nofollow noopener\" target=\"_blank\"> he&#8217;ll &#8220;do what&#8217;s best&#8221;<\/a> for the brokerage and its agents if the tide moves in that direction \u2014 though Schneider and Pareja have both been consistent in their support of the MLS and open access to listings.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">But should a company the size and scale of Anywhere or eXp signal a sudden shift in position, it could &#8220;represent a very serious threat to a free market and a transparent market&#8221; and to consumers, Brobeck believes.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">&#8220;Once this starts, it&#8217;s like World War I \u2014 you&#8217;ve got to line up and then all of a sudden, you&#8217;ve got six big brokers who are doing it,&#8221; he said, adding that once the top handful of brokerages all rush to capture inventory, they would likely control a majority of the listings, &#8220;disadvantaging everybody else.&#8221;<\/p>\n<p>A weakened NAR holds less sway over brokerages<\/p>\n<p class=\"Document_p__O_O2M\">Even if the market <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/05\/30\/is-it-finally-a-buyers-market\" rel=\"nofollow noopener\" target=\"_blank\">shifts back in a big way to buyers<\/a>, that doesn&#8217;t mean those brokerages would suddenly change course. &#8220;Power gets concentrated and institutionalized,&#8221; Brobeck explained, meaning that it would be difficult to revert to a more open and transparent market.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">And while the National Association of Realtors once &#8220;disciplined the marketplace&#8221; through its rules and MLS system, <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2024\/10\/21\/a-danger-foretold-nars-waning-dominance\" rel=\"nofollow noopener\" target=\"_blank\">its influence has waned in recent years<\/a>. Brobeck believes that could also enable big brokerages to gain \u2014 and retain \u2014 dominance of the industry and inventory.\u00a0<\/p>\n<p>Self-interest plays a role, but &#8216;so what?&#8217;<\/p>\n<p class=\"Document_p__O_O2M\">Brobeck agrees with some critics of the private listings effort who argue that pressure from investors has pushed publicly-traded brokerages to grow at any cost. &#8220;I think that&#8217;s a good portion of it, because Wall Street tends to have a short-term orientation, and that&#8217;s a problem,&#8221; he said.<\/p>\n<p class=\"Document_p__O_O2M\">But Zillow is also a publicly-traded company, and it <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/03\/15\/zillow-exec-i-dont-see-the-benefit-of-hiding-inventory-ever\" rel=\"nofollow noopener\" target=\"_blank\">strongly opposes private listings<\/a>, going so far as to <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/04\/10\/zillow-to-bar-publicly-marketed-listings-not-shared-via-mls\" rel=\"nofollow noopener\" target=\"_blank\">bar some types of off-MLS listings<\/a> from appearing on its websites. The home search giant has positioned itself as <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/03\/06\/private-listing-networks-harm-buyers-sellers-and-agents\" rel=\"nofollow noopener\" target=\"_blank\">an industry leader fighting for the consumer<\/a> and the integrity of the marketplace. However, <a class=\"Document_link__d6Jno Accessibility_focusLink__Y4Tn4\" href=\"https:\/\/www.realestatenews.com\/2025\/05\/07\/a-way-to-end-private-listings-fight-make-clear-cooperation-the-law\" rel=\"nofollow noopener\" target=\"_blank\">some argue<\/a> that Zillow \u2014 like other major corporations \u2014 is just looking out for its own best interest since it relies on listings coming from the MLSs.\u00a0<\/p>\n<p class=\"Document_p__O_O2M\">&#8220;So what?&#8221; Brobeck argued. &#8220;Forget about motive. Look at impact.
