{"id":354902,"date":"2026-02-25T03:50:08","date_gmt":"2026-02-25T03:50:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/354902\/"},"modified":"2026-02-25T03:50:08","modified_gmt":"2026-02-25T03:50:08","slug":"fresh-legal-challenge-to-almost-1000-new-homes-at-former-central-mental-hospital-dundrum-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/354902\/","title":{"rendered":"Fresh legal challenge to almost 1,000 new homes at former Central Mental Hospital Dundrum \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The development of almost 1,000 homes on the site of the former Central Mental Hospital in <a href=\"https:\/\/www.irishtimes.com\/tags\/dundrum\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dundrum\/\">Dundrum<\/a>, south Dublin, first planned five years ago, has been hit with a fresh legal challenge. <\/p>\n<p class=\"c-paragraph paywall \">Developer Mark Leonard has initiated judicial review proceedings against <a href=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\/\">An Coimisi\u00fan Plean\u00e1la<\/a> and <a href=\"https:\/\/www.irishtimes.com\/tags\/dun-laoghaire-rathdown-county-council\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dun-laoghaire-rathdown-county-council\/\">D\u00fan Laoghaire-Rathdown County Council<\/a> in relation to the decision last December to grant permission for 934 <a href=\"https:\/\/www.irishtimes.com\/tags\/affordable-homes\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/affordable-homes\/\">affordable purchase<\/a>, cost rental, and <a href=\"https:\/\/www.irishtimes.com\/tags\/social-housing\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/social-housing\/\">social homes<\/a> on the old hospital site.<\/p>\n<p class=\"c-paragraph paywall \">This is the second challenge Leonard has taken to the <a href=\"https:\/\/www.irishtimes.com\/tags\/land-development-agency\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/land-development-agency\/\">Land Development Agency<\/a>\u2019s (LDA) plans for the site, one of the most prominent housing sites in the agency\u2019s portfolio of State lands.<\/p>\n<p class=\"c-paragraph paywall \">In May 2023 the LDA secured permission to build 852 homes at the old hospital using the <a href=\"https:\/\/www.irishtimes.com\/tags\/strategic-housing-development\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/strategic-housing-development\/\">Strategic Housing Development<\/a> (SHD) system, which was designed to speed up the construction of housing. Leonard took judicial review proceedings against this decision, arguing that the development was in conflict with the D\u00fan Laoghaire-Rathdown County Development Plan.<\/p>\n<p class=\"c-paragraph paywall \">The board conceded the legal challenge in April 2024, but the LDA, which was a notice party, decided to continue to defend the case. The SHD system has been scrapped, but the judicial review proceedings are ongoing.<\/p>\n<p class=\"c-paragraph paywall \">Separately,  in September 2024 the LDA lodged a new application for the 934 apartments, which was <a href=\"https:\/\/www.irishtimes.com\/business\/2025\/12\/23\/plans-for-close-to-1000-homes-in-south-dublin-get-go-ahead\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/business\/2025\/12\/23\/plans-for-close-to-1000-homes-in-south-dublin-get-go-ahead\/\">granted last December<\/a>. While Leonard has this week initiated judicial review proceedings against this grant of permission, the LDA last month said it planned to press ahead with construction even if there was a new legal challenge.<\/p>\n<p class=\"c-paragraph paywall \">LDA chief executive John Coleman last month told The Irish Times it intended to start work this month, saying: \u201cWe can\u2019t wait any longer.\u201d<\/p>\n<p class=\"c-paragraph paywall \">He said: \u201cWe\u2019re hoping not to get a judicial review challenge but if we do, we have this job tendered already &#8230; we\u2019re ready to go, we\u2019ve selected the contractor. We can start on this next month and even if we do get a judicial review, we\u2019re going to start next month.<\/p>\n<p class=\"c-paragraph paywall \">\u201cWe\u2019re moving on regardless.\u201d<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/2026\/02\/20\/developer-seeks-extension-of-permission-for-480-apartment-scheme-at-carrickmines-in-south-dublin\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Developer seeks to reignite plan for 480 new homes in south Dublin after paying out \u20ac3.22m in \u2018exceptional planning costs\u2019Opens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">If Leonard is successful in his legal challenge, the LDA may have to reverse any work commenced on the site. <\/p>\n<p class=\"c-paragraph paywall \">Coleman told an Oireachtas committee last year the first court challenge delayed the plans by two years, and added \u201cat least \u20ac30 million\u201d to the \u20ac400 million project cost.
