{"id":371632,"date":"2026-03-06T21:35:09","date_gmt":"2026-03-06T21:35:09","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/371632\/"},"modified":"2026-03-06T21:35:09","modified_gmt":"2026-03-06T21:35:09","slug":"two-tds-awarded-50-of-costs-in-unsuccessful-legal-challenge-over-super-junior-ministers-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/371632\/","title":{"rendered":"Two TDs awarded 50% of costs in unsuccessful legal challenge over \u2018super junior\u2019 ministers \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Two TDs raised issues of public and constitutional importance in their unsuccessful legal challenge to the attendance of \u201csuper junior\u201d ministers at Government meetings, and should be awarded half of their legal costs incurred in the actions, the <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> has ruled.<\/p>\n<p class=\"c-paragraph paywall \">In a judgment on Friday, a three-judge court said proceedings brought by <a href=\"https:\/\/www.irishtimes.com\/tags\/sinn-fein\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/sinn-fein\/\">Sinn F\u00e9in<\/a>\u2019s Patrick <a href=\"https:\/\/www.irishtimes.com\/tags\/pa-daly\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/pa-daly\">\u2018Pa\u2019 Daly<\/a> and <a href=\"https:\/\/www.irishtimes.com\/tags\/paul-murphy\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/paul-murphy\">Paul Murphy<\/a> of <a href=\"https:\/\/www.irishtimes.com\/tags\/people-before-profit-solidarity-pbps\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/people-before-profit-solidarity-pbps\">People Before Profit\u2013Solidarity<\/a> gave rise to \u201cone of the rare and exceptional circumstances\u201d where unsuccessful litigants should be awarded a proportion of their legal costs.<\/p>\n<p class=\"c-paragraph paywall \">Accordingly, High Court president Judge David Barniville, ruling with Judge Siobh\u00e1n Phelan and Judge Conleth Bradley, said the State should pay 50 per cent of the TDs\u2019 legal costs incurred in their cases.<\/p>\n<p class=\"c-paragraph paywall \">The TDs brought separate but similar challenges arguing article 28 of Bunreacht na h\u00c9ireann limits the number of Government members to 15 and that the attendance of super junior ministers at Cabinet meetings goes against this.<\/p>\n<p class=\"c-paragraph paywall \">In December, the court held that no provision of the Constitution is breached by the attendance and participation of the junior ministers at Cabinet meetings.<\/p>\n<p class=\"c-paragraph paywall \">It remains open to Daly and Murphy to seek permission to appeal the High Court\u2019s judgment.<\/p>\n<p class=\"c-paragraph paywall \">Ministers of state attending Cabinet \u2013 or super junior ministers \u2013 are appointed by the Government on the nomination of the Taoiseach. They participate in Government meetings, but do not vote.<\/p>\n<p class=\"c-paragraph paywall \">At Friday\u2019s hearing, the judges said the cases of the two TDs met criteria set out by the Supreme Court, outlining circumstances when the court can depart from the default costs rule \u2013 namely, that a successful litigant should be awarded their costs, or \u201ccosts follow the event\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The judges said there was \u201creal substance\u201d to the deputies\u2019 cases, noting a public interest in clarifying the issues raised in the cases.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe principal judgments brought clarification to what, in our view, was an issue of fundamental importance and on which there were diverging academic views,\u201d the judges said.<\/p>\n<p class=\"c-paragraph paywall \">The cases involved evidence relating to Government decision-making processes not fully addressed before the courts, the judges said.<\/p>\n<p class=\"c-paragraph paywall \">The cases involved \u201cunchartered constitutional terrain\u201d, the court noted.<\/p>\n<p class=\"c-paragraph paywall \">While noting that it was not a determining factor, the judges said it was relevant that Barniville considered the cases of such importance that they required the convening of a three-judge divisional court.<\/p>\n<p class=\"c-paragraph paywall \">By comparing the cases to other instances when a losing litigant was awarded costs, the judges decided the TDs should be awarded 50 per cent of their costs against the State.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThrough their actions, Deputy Daly and Deputy Murphy have clarified for the future an important legal and constitutional issue in relation to the attendance at and participation in meetings of the Government by super junior ministers,\u201d the judges said.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIn view of the systemic importance and the novelty and complexity of the fundamental and foundational constitutional issues raised in these two cases, we consider that we should exercise our discretion to award Deputies Daly and Murphy 50 per cent of their costs against the State.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"Two TDs raised issues of public and constitutional importance in their unsuccessful legal challenge to the attendance of&hellip;\n","protected":false},"author":2,"featured_media":371633,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[73],"tags":[79,18,10476,19,17,65266,27172,27171,47],"class_list":{"0":"post-371632","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-business","8":"tag-business","9":"tag-eire","10":"tag-high-court","11":"tag-ie","12":"tag-ireland","13":"tag-pa-daly","14":"tag-paul-murphy","15":"tag-people-before-profit-solidarity-pbps","16":"tag-sinn-fein"},"share_on_mastodon":{"url":"","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/371632","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=371632"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/371632\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/371633"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=371632"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=371632"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=371632"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
