{"id":39315,"date":"2025-09-02T19:51:12","date_gmt":"2025-09-02T19:51:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/39315\/"},"modified":"2025-09-02T19:51:12","modified_gmt":"2025-09-02T19:51:12","slug":"why-is-eu-deadlocked-on-israeli-sanctions-over-gaza-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/39315\/","title":{"rendered":"Why is EU deadlocked on Israeli sanctions over Gaza? \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">In May 2021 the <a href=\"https:\/\/www.irishtimes.com\/tags\/european-union\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-union\/\">European Union<\/a>\u2019s representative to the <a href=\"https:\/\/www.irishtimes.com\/tags\/united-nations-un\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/united-nations-un\/\">United Nations<\/a> took the microphone at a session of its general assembly in New York and delivered a speech.<\/p>\n<p class=\"c-paragraph paywall \">The debate was about the \u201cresponsibility to protect\u201d: the principle that bystander countries have the duty to step in to protect people in other countries from atrocities, in particular <a href=\"https:\/\/www.irishtimes.com\/opinion\/2023\/11\/20\/what-does-the-term-genocide-mean-in-international-law\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/opinion\/2023\/11\/20\/what-does-the-term-genocide-mean-in-international-law\/\">genocide<\/a>, when their own states fail to do so.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe European Union, born, like the United Nations, from the ashes of the second World War, has the protection of people from such atrocities as its raison d\u2019\u00eatre,\u201d first secretary Thisvi Ekmektzoglou-Newson told the assembly.<\/p>\n<p class=\"c-paragraph paywall \">The principle originated in the post-second world War Genocide Convention, in which all signatories agreed to prevent and to punish the crime of genocide.<\/p>\n<p class=\"c-paragraph paywall \">In the following decades, particularly during the Rwandan genocide of 1994, the idea became increasingly prominent that countries should prevent genocides beyond their borders.<\/p>\n<p class=\"c-paragraph paywall \">Major powers were often cautious of any legally binding iteration: China and Russia because they feared western meddling; the United States because it didn\u2019t want to be obliged to intervene.<\/p>\n<p class=\"c-paragraph paywall \">But the EU was always a fan, and successfully advocated for the idea at a 2005 World Summit, in which the UN member states unanimously backed the idea.<\/p>\n<p class=\"c-paragraph paywall \">Getting that unanimity meant building  loopholes into the language, however, like \u201cas appropriate\u201d, and \u201con a case-by-case basis\u201d. Which states had the responsibility to act? What should they do? What would happen if they didn\u2019t?<\/p>\n<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/international-court-of-justice\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/international-court-of-justice\/\">International Court of Justice<\/a> (ICJ) gave some answers in a ruling on the Bosnian genocide in 2007. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/politics\/2025\/08\/30\/eus-credibility-on-line-unless-concrete-action-taken-against-israel-harris\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">EU\u2019s credibility on line unless concrete action taken against Israel &#8211; HarrisOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">From the moment that countries learn of \u201cthe existence of a serious risk that genocide will be committed\u201d, they have a responsibility \u201cto employ all means reasonably available to them, so as to prevent genocide so far as possible\u201d. Those with the most influence have the most responsibility to act.<\/p>\n<p class=\"c-paragraph paywall \">The EU\u2019s diplomatic arm, the EEAS, developed a \u201ctoolkit\u201d that laid out what such action by the EU might look like. The document, issued with \u201ccut out and keep\u201d checklists to help its overseas delegations, spelled out early warning signs of atrocities and what should be done to prevent them.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIf the EU wants to uphold its values, it cannot remain inactive or neutral,\u201d the document reads.<\/p>\n<p class=\"c-paragraph paywall \">Imminent warning signs listed include: \u201cideologies based on the supremacy of a certain group\u201d, \u201cwidespread impunity\u201d, \u201cincitement in the political discourse\/on social media to discrimination or\/and atrocity crimes against certain groups\u201d, \u201cdiscriminatory legislation that increasingly obstructs the basic rights of certain groups\u201d, \u201cattacks against or destruction of homes, farms, businesses or other livelihoods of certain groups and\/or of their cultural and\/or religious symbols and property\u201d.<\/p>\n<p class=\"c-paragraph paywall \">All rather familiar, you would think, to the EU diplomats working in Jerusalem and the <a href=\"https:\/\/www.irishtimes.com\/tags\/west-bank\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/west-bank\/\">West Bank<\/a>.<\/p>\n<p class=\"c-paragraph paywall \">On the list of actions to prevent atrocities: \u201cinvoke the \u2018human rights clause\u2019 in EU co-operation and assessment agreements\u201d, \u201cthe involvement of the International Criminal Court\u201d, \u201cthe adoption of an EU travel ban, a trade or arms embargo or\/and the freezing of assets\u201d, and \u201cthe imposing of diplomatic sanctions\u201d.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/world\/middle-east\/2025\/08\/12\/mary-robinson-urges-states-to-act-decisively-to-stop-gazas-unfolding-genocide\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Mary Robinson urges states to act decisively to stop Gaza\u2019s \u2018unfolding genocide\u2019Opens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/world\/europe\/2024\/01\/26\/international-court-of-justice-icj-ruling-on-south-africas-genocide-case-against-israel\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/world\/europe\/2024\/01\/26\/international-court-of-justice-icj-ruling-on-south-africas-genocide-case-against-israel\/\">The ICJ warned of a plausible risk of genocide in Gaza in January 2024<\/a>. On Monday, the International Association of Genocide Scholars passed a resolution stating that <a href=\"https:\/\/www.irishtimes.com\/world\/middle-east\/2025\/09\/01\/israel-sends-tanks-deeper-into-gaza-city-more-families-flee\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/world\/middle-east\/2025\/09\/01\/israel-sends-tanks-deeper-into-gaza-city-more-families-flee\/\">\u201cIsrael\u2019s policies and actions in Gaza meet the legal definition of genocide\u201d<\/a>.<\/p>\n<p class=\"c-paragraph paywall \">If the ICJ\u2019s 2007 ruling is taken seriously, as Israel\u2019s biggest trading partner and the source of over a third of its imports, many argue that the EU has a particular responsibility to act.<\/p>\n<p class=\"c-paragraph paywall \">But, as the months roll by, the EU has still not agreed to even the most modest action. Partially suspending Israel from the Horizon Europe research programme \u2013 which would only exclude future applicants from EIC grants, a small part of Horizon \u2013 does not have the required majority.<\/p>\n<p class=\"c-paragraph paywall \">An increasing number of EU states support suspending Israel\u2019s advantageous trade agreement. According to the EU\u2019s foreign policy chief, \u201cIsrael has been breaching Article Two\u201d, which makes the EU-Israel Association Agreement conditional upon Israel\u2019s respect for human rights. <\/p>\n<p class=\"c-paragraph paywall \">But it appears that for a blocking minority, the normal rules do not apply to Israel.<\/p>\n<p class=\"c-paragraph paywall \">In the circumstances, a group of 209 former EU ambassadors and senior staff have begun pressuring member states to take national action.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/world\/middle-east\/2025\/09\/01\/gaza-postwar-plan-envisages-voluntary-relocation-of-entire-population\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Gaza postwar plan envisages \u2018voluntary\u2019 relocation of entire populationOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">They have urged the suspension of export licenses for any arms or technology that can be used for both civilian and military purposes, like semiconductors.
