{"id":395805,"date":"2026-03-21T00:30:15","date_gmt":"2026-03-21T00:30:15","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/395805\/"},"modified":"2026-03-21T00:30:15","modified_gmt":"2026-03-21T00:30:15","slug":"dublin-business-school-ordered-to-pay-lecturer-e104000-by-labour-court-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/395805\/","title":{"rendered":"Dublin Business School ordered to pay lecturer \u20ac104,000 by Labour Court \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/labour-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/labour-court\/\">Labour Court<\/a> has ordered the Dublin Business School (DBS) to pay \u20ac104,000 compensation to a lecturer after he was unfairly dismissed for logging into his college email account from <a href=\"https:\/\/www.irishtimes.com\/tags\/iran\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/iran\/\">Iran<\/a>.<\/p>\n<p class=\"c-paragraph paywall \">In February 2023, the school sacked Amir Sajad Esmaeily for gross misconduct after it concluded that \u201cunauthorised access to his college emails whilst abroad amounted to a serious breach of college policy\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The school stated that Esmaeily accessed his DBS system while visiting what it said was a \u201cprohibited\u201d country and this was despite being told not to do so before he left Ireland.<\/p>\n<p class=\"c-paragraph paywall \">Esmaeily had travelled to attend the funeral of an uncle in Iran.<\/p>\n<p class=\"c-paragraph paywall \">At a previous hearing in the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a> (WRC), Esmaeily said his dismissal had a devastating effect on him.<\/p>\n<p class=\"c-paragraph paywall \">However, at the WRC and subsequently at the Labour Court, Accountancy &amp; Business College (Ireland) Limited, trading as Dublin Business School, conceded the dismissal was unfair.<\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2025\/08\/1754647931518-c07d65db-55b5-463e-ae51-976300c5837e.jpeg\"\/>The difficult choices that could dramatically increase housing supply in Dublin<\/p>\n<p class=\"c-paragraph paywall \">At the WRC, the school was ordered to pay \u20ac53,000 compensation to Esmaeily. He then successfully appealed the amount of the award to the Labour Court, where it was almost doubled to \u20ac104,000.<\/p>\n<p class=\"c-paragraph paywall \">At the Labour Court hearing to decide upon quantum only, Esmaeily represented himself and stated that the WRC \u20ac53,000 awarded was inadequate and did not reflect the impact and duration of his losses.<\/p>\n<p class=\"c-paragraph paywall \">Esmaeily said he suffered significant damage to his career and professional reputation when dismissed by the DBS as he had difficulty explaining to prospective employers why his employment had ended.<\/p>\n<p class=\"c-paragraph paywall \">Esmaeily said a just and equitable award should be made in the range of \u20ac150,000.<\/p>\n<p class=\"c-paragraph paywall \">In her findings, deputy Labour Court chairwoman Katie Connolly said that following his dismissal Esmaeily secured two part-time, temporary lecturing roles, at a lower rate of pay. One role ceased in 2024 and the roles allowed him to mitigate his loss by \u20ac26,000 per annum.<\/p>\n<p class=\"c-paragraph paywall \">Based on Esmaeily\u2019s DBS \u20ac91,133 salary, the maximum compensation award available was \u20ac182,266.<\/p>\n<p class=\"c-paragraph paywall \">Connolly  said that the court heard no evidence from DBS to justify the reasons for Esmaeily\u2019s dismissal, or to support the assertion that Esmaeily contributed to that dismissal.
