{"id":43676,"date":"2025-09-04T18:28:08","date_gmt":"2025-09-04T18:28:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/43676\/"},"modified":"2025-09-04T18:28:08","modified_gmt":"2025-09-04T18:28:08","slug":"application-for-131-apartment-scheme-in-clontarf-reactivated-following-high-court-ruling-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/43676\/","title":{"rendered":"Application for 131-apartment scheme in Clontarf reactivated following High Court ruling \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">Plans for a contentious 131-apartment development in <a href=\"https:\/\/www.irishtimes.com\/tags\/clontarf\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/clontarf\/\">Clontarf<\/a> will be reviewed by <a href=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\/\">An Coimisi\u00fan Plean\u00e1la<\/a> (ACP) after the case was kicked back to it by the <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a>.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The planned <a href=\"https:\/\/www.irishtimes.com\/tags\/build-to-rent\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/build-to-rent\/\">build-to-rent<\/a> apartment scheme, on Seafield Road East, attracted significant local opposition.<\/p>\n<p class=\"c-paragraph paywall \">In total, 377 separate objections were lodged against the plans \u2013 including submissions from then-Fianna F\u00e1il TD Se\u00e1n Haughey, two local councillors, and five residents\u2019 associations.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">An Bord Plean\u00e1la (now An Coimisi\u00fan Plean\u00e1la) granted fast-track permission under the now-expired <a href=\"https:\/\/www.irishtimes.com\/tags\/strategic-housing-development\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/strategic-housing-development\/\">strategic housing development<\/a> regime for the planned residential project.<\/p>\n<p class=\"c-paragraph paywall \">The board\u2019s December 2021 approval of the four apartment blocks of up to six storeys at Redcourt, Seafield Road East, was challenged by Martin Stapleton, who lives in a neighbouring property at Seacourt.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Mr Justice David Holland quashed ACP\u2019s decision, noting that a roofed courtyard did not constitute \u201copen\u201d space.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe space is either open or it is not. While the possibility of a third of intermediate category of space was discussed at trial, in the end that is irrelevant,\u201d Mr Justice Holland said in his February 2024 judgment.<\/p>\n<p class=\"c-paragraph paywall \">He noted that the open louvres between the long edges of the roof and the buildings below do not turn the courtyard into an open space \u201cjust as an open window does not turn indoor space into outdoor space\u201d.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">He also found that the board had failed to consider whether it should seek information from <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-bus\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-bus\/\">Dublin Bus<\/a> about its capacity to service the area at peak times.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">A large number of the objections from local residents related to the impact of the proposed development on the 130 bus route.  The judge would go on to say that \u201cobjecting local residents invoked their daily peak hour experience of standing at bus stops watching full buses pass them by\u201d.<\/p>\n<p class=\"c-paragraph paywall \">He said the capacity of the 130 route was considered by ACP, but that correspondence with Dublin Bus relied upon by the developers Savona Ltd in their application was not supplied to the planning commission.<\/p>\n<p class=\"c-paragraph paywall \">Only once in the correspondence made available to the court did it emerge that it \u201cmanifestly [did] not live up to its billing\u201d and was in relation to a different development, with the judge noting he found the developers\u2019 position on the matter \u201cdistinctly unimpressive\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Mr Justice Holland said the planning application should be remitted for fresh consideration by the board.<\/p>\n<p class=\"c-paragraph paywall \">ACP sought to refer the decision to the Court of Appeals, but the High Court judge did not find grounds for an appeal in April 2025.
