{"id":452059,"date":"2026-04-24T19:15:12","date_gmt":"2026-04-24T19:15:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/452059\/"},"modified":"2026-04-24T19:15:12","modified_gmt":"2026-04-24T19:15:12","slug":"enoch-burkes-appeal-against-dismissal-ends-after-he-repeatedly-interrupted-proceedings-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/452059\/","title":{"rendered":"Enoch Burke\u2019s appeal against dismissal ends after he repeatedly interrupted proceedings \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/tags\/enoch-burke\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/enoch-burke\/\">Enoch Burke<\/a>\u2019s appeal against his dismissal by Wilson\u2019s Hospital School concluded on Friday without the three panel members hearing from the teacher after he repeatedly interrupted proceedings and was removed from the hearing by prison officers.<\/p>\n<p class=\"c-paragraph paywall \">Burke had been taken from Castlerea Prison to the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-education\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-education\/\">Department of Education<\/a> in Athlone for the hearing which is understood to have started about 10am. He was later returned to the prison.<\/p>\n<p class=\"c-paragraph paywall \">It is normal for the appellant in such proceedings to present their case first but Burke instead took issue with the fact that Wilson\u2019s Hospital was represented by a solicitor from Mason Hayes and Curran along with a barrister.<\/p>\n<p class=\"c-paragraph paywall \">He is said to have been repeatedly disruptive as he took issue with school\u2019s decision to be legally represented and the independent chair of the Disciplinary Appeal Panel (DAP), Claire Callanan, eventually requested that he be removed.<\/p>\n<p class=\"c-paragraph paywall \">The other members of the DAP are joint managerial body nominee John Irwin and Teachers\u2019 Union of Ireland representative Seamus Lahart. Burke is not a member of any teachers\u2019 union but a union representative on such panels is standard practice.<\/p>\n<p class=\"c-paragraph paywall \">The board of management\u2019s representatives then presented its case in the absence of Burke who is said to have been offered the opportunity to return to the hearing if he gave a commitment to respect the proceedings. He was eventually returned to the room after the school\u2019s legal team had concluded their case but is understood to have become disruptive again.<\/p>\n<p class=\"c-paragraph paywall \">In a video posted afterwards on X, formerly Twitter, Isaac Burke confirmed his brother had been removed by prison officers after, he said, objections had been raised to the legal representation.<\/p>\n<p class=\"c-paragraph paywall \">This, Isaac Burke said, was \u201ctotally contrary to the process provided for by the circular [Department regulation] which states it should be informal. It\u2019s totally contrary to settled law in this area.\u201d<\/p>\n<p class=\"c-paragraph paywall \">He described the events as \u201cscandalous\u201d, saying: \u201cIt\u2019s supposed to be informal &#8230; him on one side, the teacher, he chose to represent himself, facing the board of management, that\u2019s what the circular says, the chairperson with a serving member of the board to help the chairperson on the other side.\u201d<\/p>\n<p class=\"c-paragraph paywall \">In a statement issued on Friday afternoon, fellow sibling Josiah Burke said that at a previous DAP hearing in December 2025, the panel had refused to allow lawyers to be present in the hearing room. The decision was confirmed in writing, he said, with the panel stating: \u201cIt is not the practice of the DAP to allow legal representation at oral hearings.\u201d<\/p>\n<p class=\"c-paragraph paywall \">The Department of Education was approached for comment.<\/p>\n<p class=\"c-paragraph paywall \">Those familiar with the process say that, while the circular does state the proceeding are intended to be \u201cinformal\u201d, there is no prohibition on legal representation for either side. <\/p>\n<p class=\"c-paragraph paywall \">The circular specifically states \u201cthe teacher making the appeal is entitled, if he or she wishes, to make oral submissions to the panel either in person or through a representative, normally a serving teacher, a wholetime official\/s of the union holding recognition for his or her grade or other such person as the panel agrees may be present for that purpose\u201d.<\/p>\n<p class=\"c-paragraph paywall \">It also states that where the panel meets to hear oral evidence, the teacher and their representatives are permitted to attend as well as the chair of the board of management \u201calong with a serving member of the board, or principal, designated to assist the chair of the board of management\u201d.<\/p>\n<p class=\"c-paragraph paywall \">It goes on to state that \u201cany other person whom the panel agrees may be present\u201d can also attend.<\/p>\n<p class=\"c-paragraph paywall \">It is understood that voluntary schools \u2013 privately owned and managed post-primary schools, usually under the patronage of an individual body such as a religious community, a charitable trust or a private charitable company \u2013 like Wilson\u2019s Hospital are usually legally represented in such appeals.<\/p>\n<p class=\"c-paragraph paywall \">There is an expectation among those familiar with the appeals process generally that, as Burke did not present his case on Friday, he is likely to be offered another chance to do so before the panel considers its decision. <\/p>\n<p class=\"c-paragraph paywall \">The Irish Prison Service said it does not comment on operation matters.<\/p>\n","protected":false},"excerpt":{"rendered":"Enoch Burke\u2019s appeal against his dismissal by Wilson\u2019s Hospital School concluded on Friday without the three panel members&hellip;\n","protected":false},"author":2,"featured_media":382134,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[40],"tags":[9,10,13264,18,8662,13,14,6,19,17,11,12,15,16,5,7,8],"class_list":{"0":"post-452059","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-ireland","8":"tag-breaking-news","9":"tag-breakingnews","10":"tag-department-of-education","11":"tag-eire","12":"tag-enoch-burke","13":"tag-featured-news","14":"tag-featurednews","15":"tag-headlines","16":"tag-ie","17":"tag-ireland","18":"tag-latest-news","19":"tag-latestnews","20":"tag-main-news","21":"tag-mainnews","22":"tag-news","23":"tag-top-stories","24":"tag-topstories"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@ie\/116461287942873482","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/452059","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=452059"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/452059\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/382134"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=452059"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=452059"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=452059"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
