{"id":469977,"date":"2026-05-05T19:06:12","date_gmt":"2026-05-05T19:06:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/469977\/"},"modified":"2026-05-05T19:06:12","modified_gmt":"2026-05-05T19:06:12","slug":"john-mcguirk-criticised-by-high-court-judge-after-adjournment-of-libel-action-against-paddy-cosgrave-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/469977\/","title":{"rendered":"John McGuirk criticised by High Court judge after adjournment of libel action against Paddy Cosgrave \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\">High Court<\/a> judge has sharply criticised conservative commentator <a href=\"https:\/\/www.irishtimes.com\/tags\/john-mcguirk\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/john-mcguirk\/\">John McGuirk<\/a> after his lawyers sought an 11th-hour adjournment of his defamation action against <a href=\"https:\/\/www.irishtimes.com\/tags\/web-summit\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/web-summit\/\">Web Summit<\/a> founder <a href=\"https:\/\/www.irishtimes.com\/tags\/paddy-cosgrave\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/paddy-cosgrave\/\">Paddy Cosgrave<\/a>.<\/p>\n<p class=\"c-paragraph paywall \">Judge Tony O\u2019Connor, who described the situation as a \u201ctravesty\u201d, agreed to adjourn the trial of the action on Tuesday, but ordered that McGuirk pay certain legal costs incurred in the action before a new hearing date is fixed in the case.<\/p>\n<p class=\"c-paragraph paywall \">The trial of McGuirk\u2019s case, in which he alleges he was defamed by posts made by Cosgrave on <a href=\"https:\/\/www.irishtimes.com\/tags\/x\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/x\/\">X<\/a> \u2013 then Twitter \u2013 in 2021, was due to begin on Tuesday before a judge and a jury. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Connor said McGuirk could not \u201chide behind\u201d comments made by his senior counsel, who told the judge that two junior lawyers representing McGuirk had last week agreed to the trial going ahead on Tuesday, in circumstances where this consent should not have been given.<\/p>\n<p class=\"c-paragraph paywall \">The judge said McGuirk was responsible for the situation, and said he would not tolerate the integrity of the junior lawyers \u201cbeing impugned in this court\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The judge also noted how about 100 potential jurors, summonsed by the court in advance of a jury empanelling in the case, had been \u201cinconvenienced tremendously\u201d by the circumstances. <\/p>\n<p class=\"c-paragraph paywall \">McGuirk was not present in court. Cosgrave was present.<\/p>\n<p class=\"c-paragraph paywall \">At Tuesday\u2019s hearing, McGuirk\u2019s senior counsel Maura McNally, instructed by Robinson solicitors, told the judge that a junior solicitor and junior barrister last week appeared before the court and agreed to the case proceeding to trial that day. <\/p>\n<p class=\"c-paragraph paywall \">McNally said this consent should not have been given, as the McGuirk side was then still awaiting a report from a San Francisco-based expert. McNally said her instructing firm\u2019s principal solicitor had not been notified that consent was given for the hearing date. <\/p>\n<p class=\"c-paragraph paywall \">McNally said she had not met her client in months, and had not reviewed papers in the case since January. <\/p>\n<p class=\"c-paragraph paywall \">Counsel said she was seeking the adjournment as she was not in a position to proceed with the trial. McNally likened the trial proceeding to \u201cbeing asked to go into a boxing ring with both hands tied behind my back\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Barrister Tom Hogan, appearing for Cosgrave with Jennifer Goode and instructed by Flynn O\u2019Driscoll LLP, opposed the application for adjournment, submitting that he couldn\u2019t overstate \u201chow extraordinary this state of affairs is\u201d. <\/p>\n<p class=\"c-paragraph paywall \">He said Cosgrave was in court and prepared for the trial. <\/p>\n<p class=\"c-paragraph paywall \">Hogan noted that documents were lodged with the court by the McGuirk side on Friday, indicating that \u201csomebody thought the case was going on\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Responding to the judge\u2019s invitation for counsel\u2019s views on the making of a legal costs order against McGuirk, McNally said such an order should not be so onerous to preclude McGuirk from pursuing his case.
