{"id":472539,"date":"2026-05-07T06:54:12","date_gmt":"2026-05-07T06:54:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/472539\/"},"modified":"2026-05-07T06:54:12","modified_gmt":"2026-05-07T06:54:12","slug":"almost-300-asylum-seekers-claiming-to-be-children-were-adults-oireachtas-committee-told-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/472539\/","title":{"rendered":"Almost 300 asylum seekers claiming to be children were adults, Oireachtas committee told \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Almost 300 asylum seekers who claimed they were children were subsequently deemed to be adults over the past four years, the child and family agency has said.<\/p>\n<p class=\"c-paragraph paywall \">The average time these adults were incorrectly presumed to be children, and were possibly living in children\u2019s accommodation, was 57 days, <a href=\"https:\/\/www.irishtimes.com\/tags\/tusla\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/tusla\/\">Tusla<\/a> said in a report to the D\u00e1il <a href=\"https:\/\/www.irishtimes.com\/tags\/public-accounts-committee\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/public-accounts-committee\/\">Public Accounts Committee<\/a>. It said, however, this timescale has reduced considerably since January. <\/p>\n<p class=\"c-paragraph paywall \">In the briefing document, the agency said \u201cthe issue of age assessment in relation to unaccompanied minors has been an issue of significant risk to Tusla in recent years\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThere is no provision in law for Tusla to conduct age assessments,\u201d it said in the document, dated April 27th. <\/p>\n<p class=\"c-paragraph paywall \">Between 2022 and 2025, a total of 2,530 young people who were alone and seeking asylum were referred to the agency in cases where either immigration officials believed they were under 18 and unaccompanied, or the individuals claimed to be.<\/p>\n<p class=\"c-paragraph paywall \">Of these, 293 were subsequently \u201cdeemed ineligible\u201d for Tusla\u2019s services \u201cand referred back to the <a href=\"https:\/\/www.irishtimes.com\/tags\/international-protection-office\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/international-protection-office\/\">International Protection Office<\/a> (IPO)\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The 2015 International Protection Act says that where an immigration official forms a view an asylum seeker is under 18 years, they shall refer them to Tusla. That young person shall be presumed to be a child and shall access Tusla\u2019s protective services, the legislation says. <\/p>\n<p class=\"c-paragraph paywall \">Tusla said it had been taking close to two months from the time it received a referral of an individual appearing or claiming to be an unaccompanied minor, and completing an assessment determining them not to be eligible for services, \u201cand therefore an adult\u201d.<\/p>\n<p class=\"c-paragraph paywall \">However, since January this year the IPO, which is run by the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-justice\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-justice\/\">Department of Justice<\/a>, had been conducting more robust age screenings, it said.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/irishtimes.com\/ireland\/2026\/05\/07\/hiqa-pac-and-legal-professionals-all-voiced-concerns-around-safety-of-child-asylum-seekers-in-tuslas-care\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Hiqa, PAC and legal professionals all voiced concerns around safety of child asylum seekers in Tusla\u2019s careOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">As a result, such referrals to Tusla had dropped and fewer eligibility assessments were required \u2013 leading to a shorter timescale of approximately 15 days for completed age determinations. <\/p>\n<p class=\"c-paragraph paywall \">\u201cIn quarter one 2026, we have experienced a reduction in the number of young people referred to the service, with 97 referrals.\u201d This compared with  196 referrals in the last three months of 2025. <\/p>\n<p class=\"c-paragraph paywall \">\u201cThis reduction is simultaneous to the introduction of a new process by the Department of Justice in relation to age screening at the point of entry in preparation for the implementation of the EU Migration Pact in June 2026.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Tusla said where there was a query about the young person\u2019s age, or an appeal of the decision of the IPO or Tusla, they were categorised as \u201cage disputed\u201d and accommodated in an emergency placement or an adult Ipas  placement, and not in a registered children\u2019s centre \u201cpending a final determination\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Figures provided by Tusla to the committee \u2013 based in some instances on a manual sampling of cases, as data is not collected electronically \u2013 showed it received 768 referrals from an immigration or  IPO official last year.<\/p>\n<p class=\"c-paragraph paywall \">Of these, 288 underwent eligibility assessments of which 141 were deemed \u201cineligible\u201d for Tusla services \u2013 ie, were over the age of 18.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/opinion\/2026\/05\/03\/the-international-protection-act-does-the-precise-opposite-of-what-it-says-on-the-tin\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">The International Protection Act does the precise opposite of what it says on the tinOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">The report suggests there were three judicial reviews taken last year in relation to such eligibility decisions.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIt is &#8230; particularly challenging to rebut the claim of being a minor particularly when adhering to best practice guidance of fair procedures, benefit of the doubt and the legal premise of presumption of minority,\u201d said Tusla.<\/p>\n<p class=\"c-paragraph paywall \">In some cases, unaccompanied minors were placed in unregistered, unregulated placements known as special emergency arrangements (SEAs). These have been harshly criticised by the Ombudsman for Children and the judiciary as unsuitable for vulnerable children.<\/p>\n<p class=\"c-paragraph paywall \">Their use was \u201cdriven primarily by the number of arrivals\u201d, said Tusla.
