{"id":482416,"date":"2026-05-13T10:36:13","date_gmt":"2026-05-13T10:36:13","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/482416\/"},"modified":"2026-05-13T10:36:13","modified_gmt":"2026-05-13T10:36:13","slug":"garda-claims-superior-asked-if-she-expected-a-consolation-prize-for-losing-your-son-court-told-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/482416\/","title":{"rendered":"Garda claims superior asked if she expected a \u2018consolation prize for losing your son\u2019, court told \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A <a href=\"https:\/\/www.irishtimes.com\/tags\/garda-siochana\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/garda-siochana\/\">Garda<\/a> sergeant who alleges bullying within the force has submitted to the <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> that after she applied for a new position following the death of her son, a superior officer told her: \u201cI suppose you thought you would get a consolation prize for losing your son.\u201d<\/p>\n<p class=\"c-paragraph paywall \">At the High Court this week, Sgt Laura Gaffey, Kilcullen, Co <a href=\"https:\/\/www.irishtimes.com\/tags\/kildare\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/kildare\/\">Kildare<\/a>, through barrister Neil Rafter, instructed by Matthew Byrne of Hammerstones solicitors, <a href=\"https:\/\/www.irishtimes.com\/tags\/naas\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/naas\/\">Naas<\/a>, was granted permission to pursue her legal challenge over the handling of her complaints to An Garda S\u00edoch\u00e1na.<\/p>\n<p class=\"c-paragraph paywall \">Gaffey, in sworn court documents, submits she is a senior and extensively qualified Garda sergeant with 18 years\u2019 experience. Since 2018, she says she has had an \u201congoing\u201d grievance with a supervising inspector, who, she submits, engaged in \u201cbullying behaviour\u201d following her maternity leave in 2018.<\/p>\n<p class=\"c-paragraph paywall \">She alleges that a superior officer criticised her for taking maternity leave and then, it is claimed, he commented to Gaffey: \u201cI suppose you thought you would get a consolation prize for losing your son.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Gaffey submits that this alleged comment from her superior, was \u201cdiscriminatory in nature in that it interfered with my utilisation of maternity leave and caused stress and distress\u201d.<\/p>\n<p class=\"c-paragraph paywall \"> She further alleges that her complaint of bullying led to a data breach when an inspector received \u201csensitive category data, directly in contravention to assurances previously given to me\u201d.<\/p>\n<p class=\"c-paragraph paywall \"> The sergeant complained of \u201cbullying, harassing and dysfunctional behaviour\u201d.<\/p>\n<p class=\"c-paragraph paywall \">She submits that she took maternity leave again in 2020 and returned in October, to be informed that she was to be a Tusla liaison officer. She said she discovered that entries into the Garda system were already being processed under her name without her having taken up the post.<\/p>\n<p class=\"c-paragraph paywall \">She submits that she was \u201cintentionally undermined\u201d in her role and in the fulfilment of her duties and was not provided with a phone or a computer to discuss sensitive cases at issue.<\/p>\n<p class=\"c-paragraph paywall \">Gaffey submits that in 2024, she raised a complaint against a different superior officer regarding \u201crepeated actions towards me intended to intimidate and cause upset and distress\u201d by intervening in her work in a \u201chostile\u201d manner.<\/p>\n<p class=\"c-paragraph paywall \">The second officer was cleared of the allegation by an internal Garda panel but Gaffey alleged that information disseminated during the December 2024 process contained sensitive personal data that amounted to a breach of information \u201cfar beyond the parameters of the expectation of privacy in the context of the investigation\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Gaffey submits that information involved in her complaint \u201cincluded references to my mental health, professional challenges, and the death of my son\u201d.<\/p>\n<p class=\"c-paragraph paywall \">In June 2025, a Garda determination found that the officer had not engaged in any bullying or harassment of Gaffey but, it is submitted, did not adequately address her alleged data breach.<\/p>\n<p class=\"c-paragraph paywall \">Gaffey appealed the June 2025 determination and submitted that the question of the alleged data breach was originally \u201centirely inadequate\u201d.<\/p>\n<p class=\"c-paragraph paywall \"> She claims she has not received any determination regarding her appeal and this has not yet been delivered despite an extension of time from August 2025.<\/p>\n<p class=\"c-paragraph paywall \">She submits that the alleged failure by the respondent to abide by its own timeline processes creates a breach of the Applicants Article 3 rights under the European Convention on Human Rights charter.<\/p>\n<p class=\"c-paragraph paywall \">Gaffey submits that the lack of the appeal determination is contrary to fair procedures.<\/p>\n<p class=\"c-paragraph paywall \">Judge Garrett Simons granted leave to seek judicial review and adjourned the matter to June.<\/p>\n","protected":false},"excerpt":{"rendered":"A Garda sergeant who alleges bullying within the force has submitted to the High Court that after she&hellip;\n","protected":false},"author":2,"featured_media":219457,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[40],"tags":[9,10,18,13,14,8030,6,10476,19,17,3625,11,12,15,16,16209,5,7,8],"class_list":{"0":"post-482416","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-ireland","8":"tag-breaking-news","9":"tag-breakingnews","10":"tag-eire","11":"tag-featured-news","12":"tag-featurednews","13":"tag-garda-siochana","14":"tag-headlines","15":"tag-high-court","16":"tag-ie","17":"tag-ireland","18":"tag-kildare","19":"tag-latest-news","20":"tag-latestnews","21":"tag-main-news","22":"tag-mainnews","23":"tag-naas","24":"tag-news","25":"tag-top-stories","26":"tag-topstories"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@ie\/116566831063845053","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/482416","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=482416"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/482416\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/219457"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=482416"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=482416"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=482416"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
