Both men deny all charges.

The men had been preapproved as adoption candidates; however, the child suffered a number of injuries while in their care, including a fractured elbow.

A jury at Preston Crown Court heard on Tuesday that when Varly brought the unconscious infant to the A&E department at Victoria hospital on the day he was pronounced dead, he claimed that the child had drowned after being left alone in a bath for three to four minutes; however, a coroner reported that the child was subjected to deliberate asphyxiation and had been the victim of “abusive trauma, non-accidental injuries and sexual abuse” and had not drowned.

The infant’s cause of death was determined to be the result of an upper airway obstruction, leading to his collapse by a deliberate act of smothering, or from an object or objects being inserted into his mouth.

When Varley was asked why Preston, who was a healthy child, had died four months after being placed with him, and if he had killed the child, he said, “I have not done it. I will fight you til the day I die. I know you are wrong. I have not done it.”

The court heard that when Varely was asked why he had images of the child’s genitalia on his phone, he told police, “Unlike you, I don’t think about his genitals 24/7.

Asked why he had an over-14-minute video of the child visibly “distressed” and “whimpering” in the bath, and why he had not helped him, he said, “I was keeping an eye on him. He’s not distressed. There was no intent to hurt him.”

“You are making a mountain out of a molehill. It’s totally innocent, it’s ridiculous. You have got it now, as if I’m a bloody pervert,” he claimed.

Varley is charged with one count of murder, one count of manslaughter, two counts of assault by penetration of a child under 13, Five counts of cruelty to a person under 16, one count of inflicting grievous bodily harm, One count of sexual Assault of a child under 13, ten counts of taking indecent photographs of a child, One count of distributing indecent photographs of a child, Two counts of possession of an indecent pseudo image of a child, One count of possession of an extreme pornographic image.

McGowan-Fazakerley is charged with one count of allowing the death of a child, two counts of cruelty to a person under 16, and one count of sexual Assault of a child under 13. A previous hearing of the case revealed that his DNA was found close to the baby’s cot.

The trial continues.

The following report contains details of a distressing nature. An infant who died only months after being given…

[3
9,10,18,13,14,211150,6,19,17,11,12,15,16,76805,5,211151,42652,7,8
0":"post-482865","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-headlines","8":"tag-breaking-news","9":"tag-breakingnews","10":"tag-eire","11":"tag-featured-news","12":"tag-featurednews","13":"tag-gay-adoption","14":"tag-headlines","15":"tag-ie","16":"tag-ireland","17":"tag-latest-news","18":"tag-latestnews","19":"tag-main-news","20":"tag-mainnews","21":"tag-murder-trial","22":"tag-news","23":"tag-preston-davey","24":"tag-sexual-abuse","25":"tag-top-stories","26":"tag-topstories
["GET
