href=\"https:\/\/www.irishtimes.com\/tags\/planning-permission\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/planning-permission\/\">planning<\/a> paralysis better than a <a href=\"https:\/\/www.irishtimes.com\/business\/2026\/05\/12\/objection-puts-brakes-on-plan-for-562-apartments-on-former-jesuit-site-in-milltown\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/business\/2026\/05\/12\/objection-puts-brakes-on-plan-for-562-apartments-on-former-jesuit-site-in-milltown\/\">10-acre plot<\/a> at the corner of Sandford Road and Milltown Road in <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-6\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-6\">Dublin 6<\/a>.<\/p>\n<p class=\"c-paragraph paywall \">Real estate developer <a href=\"https:\/\/www.irishtimes.com\/tags\/ardstone-homes\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/ardstone-homes\">Ardstone<\/a> bought the land from the Jesuit Order in 2019 for about \u20ac69 million.<\/p>\n<p class=\"c-paragraph paywall \">The site \u2013 located 1km from the <a href=\"https:\/\/www.irishtimes.com\/tags\/milltown\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/milltown\">Milltown<\/a> Luas stop \u2013 forms part of the larger 18-acre Milltown Park in <a href=\"https:\/\/www.irishtimes.com\/tags\/ranelagh\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/ranelagh\/\">Ranelagh<\/a>, which runs to the back of <a href=\"https:\/\/www.irishtimes.com\/tags\/gonzaga-college\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/gonzaga-college\/\">Gonzaga College<\/a> secondary school and which contains the Irish Jesuit Provincialate, Cherryfield Nursing Home and the Milltown Community building.<\/p>\n<p class=\"c-paragraph paywall \">In 2021, Ardstone, via its subsidiary Sandford Living Ltd, applied directly to <a href=\"https:\/\/www.irishtimes.com\/tags\/an-bord-pleanala\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-bord-pleanala\/\">An Bord Plean\u00e1la<\/a> \u2013 under the former Strategic Housing Development (SHD) system \u2013 for permission to build 667 homes, mainly build-to-rent apartments.<\/p>\n<p class=\"c-paragraph paywall \">In December that year An Bord Plean\u00e1la granted planning permission.<\/p>\n<p class=\"c-paragraph paywall \">However, the permission became the subject of High Court judicial review proceedings initiated by local residents\u2019 bodies and various individuals, who took issue with the scale of the project, the potential impact on traffic  and the proposed removal of trees.<\/p>\n<p class=\"c-paragraph paywall \">The height of the proposed apartment blocks, 10 floors in the case of the highest one, was raised as a concern.<\/p>\n<p class=\"c-paragraph paywall \">In May 2024, An Bord Plean\u00e1la conceded there were issues raised in the judicial review that it could not defend. <\/p>\n<p class=\"c-paragraph paywall \">These included the fact that Stefan Hyde, brother of<b> <\/b>Paul Hyde, former deputy chairman of An Bord Plean\u00e1la who was forced to resign over alleged<b> <\/b>conflicts of interest, was a director of a company that produced a five-page disability access report for the developer.<\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2026\/04\/1776101724_424_1754647931518-c07d65db-55b5-463e-ae51-976300c5837e.jpeg\"\/>Could we be heading toward a world recession if Trump can\u2019t broker a deal with Iran?<\/p>\n<p class=\"c-paragraph paywall \">A request to allow An Bord Plean\u00e1la to make a new decision to address these and other issues was granted by the courts and the original application awaited a fresh decision by An Bord Plean\u00e1la\u2019s successor An Coimisi\u00fan Plean\u00e1la.<\/p>\n<p class=\"c-paragraph paywall \">While this legal wrangle was ongoing, Ardstone, in 2023, came up with a modified plan for the site involving 636 homes (31 fewer homes than the first plan).<\/p>\n<p class=\"c-paragraph paywall \">It applied for planning under the Large-scale Residential Development system (the successor to the SHD) and was in September that year granted planning by <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-city-council\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-city-council\/\">Dublin City Council<\/a>. <\/p>\n<p class=\"c-paragraph paywall \">A subsequent appeal against the permission was rejected by An Bord Plean\u00e1la but the planning application, like its predecessor, became the subject of judicial review proceedings initiated by Cherryfield Avenue Residents Association, Norwood Park Residents Association and Dermot Murphy of Cherryfield Avenue Upper.<\/p>\n<p class=\"c-paragraph paywall \">The appellants claimed the density of Ardstone\u2019s scheme materially contravened guidelines for the outer suburbs laid out in the Dublin City Development Plan 2022\u20132028.<\/p>\n<p class=\"c-paragraph paywall \">They also claimed the proposed tree removal contravened the development plan\u2019s green infrastructure objectives and that the developer only provided a \u201ctheoretical capacity of public transport\u201d, not an actual capacity.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" maintained that the Environmental Impact Assessment of bat fauna in the area had been inadequate.<\/p>\n<p class=\"c-paragraph paywall \">The case has yet to be heard. A High Court hearing date is expected later this year. <\/p>\n<p class=\"c-paragraph paywall \">Despite two separate plans being knocked back, Ardstone in January this year renewed its bid to secure planning for the site. <\/p>\n<p class=\"c-paragraph paywall \">It came up with a new scheme involving 562 housing units, 105 fewer than the initial 667 proposed. <\/p>\n<p class=\"c-paragraph paywall \">The revised plan reduced the height across the scheme and on the main apartment block from 10 storeys to eight.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThis scaled-back approach is a direct response to concerns raised about building heights, density and overlooking, while still seeking to unlock the delivery of housing on a site designated for residential development,\u201d Ardstone said.<\/p>\n<p class=\"c-paragraph paywall \">Dublin City Council granted planning for this scheme last month, noting that the site will provide for a large number of homes \u201cin a highly sought after existing residential area which is located in an area within close proximity to employment, public transport and a range of services and facilities\u201d.<\/p>\n<p class=\"c-paragraph paywall \">An Coimisi\u00fan Plean\u00e1la, however, confirmed on Tuesday this week that a <a href=\"https:\/\/www.irishtimes.com\/business\/2026\/05\/12\/objection-puts-brakes-on-plan-for-562-apartments-on-former-jesuit-site-in-milltown\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/business\/2026\/05\/12\/objection-puts-brakes-on-plan-for-562-apartments-on-former-jesuit-site-in-milltown\/\">third-party appeal has been lodged<\/a> against the grant of permission by Cherryfield Avenue Residents\u2019 Association.<\/p>\n<p class=\"c-paragraph paywall \">In its objection, the residents\u2019 group, represented by BPS Planning and Development Consultants, contended that the scheme should be refused as the proposals \u201cwould have an overbearing, overshadowing and overlooking impact on adjoining properties on Cherryfield Avenue Lower and Upper\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The objection also said permission should be refused as it would \u201cadversely impact on the amenity of the local area, the skylines enjoyed by adjoining properties and residential areas and adjoining residential properties\u201d.<\/p>\n<p class=\"c-paragraph paywall \">BPS\u2019s objection stated that<b> <\/b>\u201cin objecting to the current proposals, our client\u2019s concerns are no longer to prevent the entire scheme because of its overall cumulative adverse impacts on them and their area. <\/p>\n<p market finally turning?Opens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">\u201cInstead, the current objection focuses on a list of revisions needed to the scheme to make it acceptable to them.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Armstrong Planning Ltd, representing the Norwood residents, has also lodged an appeal, highlighting what it describes as the \u201cexcessive density\u201d and \u201cexcessive building height\u201d of the scheme. <\/p>\n<p class=\"c-paragraph paywall \">A decision on these appeals is expected later this year.<\/p>\n<p class=\"c-paragraph paywall \">So seven years after the site was bought and after the three separate planning grants, one from An Bord Plean\u00e1la and two from Dublin City Council, and two judicial
