{"id":486453,"date":"2026-05-15T18:43:11","date_gmt":"2026-05-15T18:43:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/486453\/"},"modified":"2026-05-15T18:43:11","modified_gmt":"2026-05-15T18:43:11","slug":"redundancy-rules-worthless-if-meta-contractor-can-simply-ignore-them-says-union-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/486453\/","title":{"rendered":"Redundancy rules \u2018worthless\u2019 if Meta contractor can simply ignore them, says union \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Legal provisions intended to ensure employees losing their jobs are consulted with have been described as worthless after <a href=\"https:\/\/www.irishtimes.com\/tags\/meta\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/meta\/\">Meta<\/a> contractor Covalen declined an invitation to attend the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a> (WRC) to discuss the more than 700 redundancies it is planning.<\/p>\n<p class=\"c-paragraph paywall \">Members of the <a href=\"https:\/\/www.irishtimes.com\/tags\/communications-workers-union-cwu\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/communications-workers-union-cwu\/\">Communication Workers\u2019 Union<\/a> (CWU) at the company staged a one-day strike on Friday as part of their campaign to win recognition and collective bargaining rights.<\/p>\n<p class=\"c-paragraph paywall \">Owen O\u2019Reilly, the CWU branch representative at the company, said the union\u2019s members had been \u201cleft with no choice but to take strike action\u201d. <\/p>\n<p class=\"c-paragraph paywall \">\u201cWe are not asking for anything extraordinary \u2013 we are asking for the basic right that workers across Europe take for granted: the right to be represented by a trade union of our choosing,\u201d he said. <\/p>\n<p class=\"c-paragraph paywall \">\u201cCovalen has the resources to treat us fairly. Instead, they are using every mechanism available to them to deny workers a voice. That cannot be allowed continue.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Those involved in the strike say the legally required consultation has not yielded any improvements to the company\u2019s position that only statutory redundancy will be paid.<\/p>\n<p class=\"c-paragraph paywall \">As that requires two years\u2019 service, more than half of the workers losing their jobs are not expected not to receive any redundancy payment at all.<\/p>\n<p class=\"c-paragraph paywall \">Asked about the situation, the Department of Enterprise said there are a number of laws in place to protest workers at risk of redundancy and that legislation imposes certain legal obligations on employers proposing collective redundancies.<\/p>\n<p class=\"c-paragraph paywall \">It said that while the Minister cannot intervene in individual employer-employee relations, there are well-established dispute resolution mechanisms available through the WRC and the Labour Court.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/work\/2026\/05\/07\/meta-contractor-covalen-accused-of-rushing-lay-offs-to-avoid-redundancy-payments\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Meta contractor Covalen accused of rushing lay-offs to avoid redundancy paymentsOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">CWU deputy general secretary Ian McArdles said the fact that the company has simply declined more than one invitation to engage at the WRC \u201cshows how the procedures can be easily ignored and are therefore worthless\u201d.<\/p>\n<p class=\"c-paragraph paywall \">In a statement, Covalen said it \u201ccontinues to proactively consult with and support the affected teams through this transition. We also continue to follow the required processes in line with our obligations. All employees have access to our employee wellbeing support through Covalen\u2019s Employee Assistance Programme.\u201d<\/p>\n<p class=\"c-paragraph paywall \">CWU general secretary Se\u00e1n McDonagh says the situation \u201cexposes the fundamental flaw at the heart of our worker representation and collective redundancy legislation. The \u2018with a view to agreement\u2019 concept places no real obligation on employers to reach agreement where a union is not recognised \u2013 in effect handing management a veto over enhanced redundancy terms and measures to mitigate job losses.
