{"id":505769,"date":"2026-05-27T21:03:11","date_gmt":"2026-05-27T21:03:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/505769\/"},"modified":"2026-05-27T21:03:11","modified_gmt":"2026-05-27T21:03:11","slug":"man-48-convicted-and-fined-for-possession-of-child-pornographic-material-using-ai-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/505769\/","title":{"rendered":"Man (48) convicted and fined for possession of child pornographic material using AI \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph free \">A 48-year-old man has been convicted and fined \u20ac400 at <a href=\"https:\/\/www.irishtimes.com\/tags\/tralee-district-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/tralee-district-court\/\">Tralee District Court<\/a>, after he pleaded guilty to a charge of possession of child pornographic material generated using <a href=\"https:\/\/www.irishtimes.com\/tags\/artificial-intelligence\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/artificial-intelligence\/\">artificial intelligence<\/a> (AI).<\/p>\n<p class=\"c-paragraph free \">In one of the images a downloaded AI app had been used to digitally undress an image of a teenage girl.<\/p>\n<p class=\"c-paragraph free \">Stephen Buckley (48) of Hunter\u2019s Wood, Ballyseedy, Tralee, Co <a href=\"https:\/\/www.irishtimes.com\/tags\/kerry\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/kerry\/\">Kerry<\/a>, pleaded guilty to a single charge of possessing child pornography, namely four photographic images created using AI and three anim\u00e9 videos depicting sexual acts with teenagers on February 2nd, 2024.  <\/p>\n<p class=\"c-paragraph free \">The defendant pleaded guilty to the single charge at a previous sitting of Tralee District Court.<\/p>\n<p class=\"c-paragraph free \">The charge is contrary to Section 6 (1) of the Child Trafficking and Pornography Act, 1998. He is believed to be the first person in the country to be convicted of possession of AI-generated child pornographic material.<\/p>\n<p class=\"c-paragraph free \">Two years ago, the US Center for Missing and Exploited Children alerted detectives in the Garda Online Exploitation Unit in Dublin to suspicious activity on his phone, the court heard previously.<\/p>\n<p class=\"c-paragraph free \">Garda\u00ed in Tralee secured a warrant and searched Buckley\u2019s home in February 2024. They spoke to him and seized a number of phones.<\/p>\n<p class=\"c-paragraph free \">An examination of the phones revealed child sex abuse images, including one  of a young girl that had been digitally manipulated using an app.<\/p>\n<p class=\"c-paragraph free \">Defence solicitor Pat Mann told the court in Tralee on Wednesday that Buckley had no previous convictions. The solicitor said the matter had had a devastating effect on his client.<\/p>\n<p class=\"c-paragraph free \">Mann asked the court to deal with the case without recording a criminal conviction against his client. Buckley had co-operated \u201ccompletely\u201d and had attended dozens of counselling sessions to address his issues, the solicitor said.<\/p>\n<p class=\"c-paragraph free \">However, Judge David Waters described the offence as serious and said it was appropriate to record a conviction. He said the fact that the material was downloaded showed there was an element of deliberation and premeditation involved.<\/p>\n<p class=\"c-paragraph free \">He said the portrayal of the presence of the material on Buckley\u2019s phone as \u201calmost accidental\u201d didn\u2019t stand up.<\/p>\n<p class=\"c-paragraph free \">He convicted Buckley on the charge of possession of child pornography and fined him \u20ac400.
