A tenant who allegedly entered a primary school near his rented Co Cork<\/a> home and engaged in \u201cthreatening and abusive\u201d behaviour has been ordered to vacate the property.<\/p>\n

Bogdan Kreigel, a tenant of Focus Housing Association since July 2021, received a notice of termination in May 2024, giving him 10 days to leave the property on Church Road, Carrigaline.<\/p>\n

At the outset of a Residential Tenancies Board<\/a> (RTB) tribunal hearing, the appointed Polish translator informed the panel that Kreigel was \u201cinsulting\u201d and used \u201cabusive language\u201d towards her after she asked him to repeat an affirmation before evidence was heard.<\/p>\n

Gr\u00e1inne Murphy, a representative for Focus Housing Association, told the tribunal the notice was served after Kreigel \u201cunlawfully and without permission\u201d entered a primary school adjacent to the property on May 16th, 2024.<\/p>\n

She said she could not give first-hand evidence of the incident, but evidence had been obtained from other parties who alleged Kreigel \u201cthreatened people\u201d at the school.<\/p>\n

She told the tribunal he engaged in \u201cabusive behaviour\u201d and \u201cacted aggressively\u201d on the school\u2019s premises.<\/p>\n

Murphy also provided a summary of Kreigel\u2019s alleged \u201cdangerous and reckless behaviour\u201d during his tenancy, including an incident where he fell asleep while using the cooker, \u201calmost burning the dwelling\u201d.<\/p>\n

She also alleged he allowed visitors who \u201cacted in an antisocial manner\u201d into the property and that garda\u00ed had been called on a number of occasions. Murphy also claimed Kreigel was frequently \u201cverbally aggressive\u201d and made threats to Focus Ireland<\/a> staff.<\/p>\n

Warning letters and correspondence asking Kreigel to desist from \u201cproblematic behaviour\u201d were issued before the notice of termination, she said.<\/p>\n

During the hearing, Qiqa Maqubela, a case worker with Cork Simon Community and Kreigel\u2019s representative, told the tribunal Kriegel became \u201cincreasingly agitated\u201d while Murphy gave evidence.<\/p>\n

Maqubela said he and his colleague, as a result, had to leave Kreigel\u2019s apartment and join the hearing from outside while the tenant remained indoors and \u201crefused\u201d to participate.<\/p>\n

This meant none of the landlord\u2019s evidence was challenged by the tenant, though the tribunal noted he had previously accepted he engaged in antisocial behaviour and the school staff \u201cmay have been afraid\u201d following the incident.<\/p>\n

The tribunal said it was satisfied Kreigel had entered the neighbouring school\u2019s premises and engaged in behaviour that caused or could cause fear, danger or injury to those working at the school. Noting this, it said it was satisfied he engaged in antisocial behaviour.<\/p>\n

The tribunal deemed the notice of termination to be valid and lawful, saying the correct procedure had been followed by Focus Housing Association, and Kreigel was therefore overholding.
