{"id":519769,"date":"2026-06-05T08:10:14","date_gmt":"2026-06-05T08:10:14","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/519769\/"},"modified":"2026-06-05T08:10:14","modified_gmt":"2026-06-05T08:10:14","slug":"eu-is-taking-ireland-to-court-over-failure-to-stop-illegal-peat-extraction-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/519769\/","title":{"rendered":"EU is taking Ireland to court over failure to stop illegal peat extraction \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Ireland is being taken to the European Union\u2019s highest court for failing to stop illegal peat extraction. <\/p>\n<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/european-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-commission\/\">European Commission<\/a> said the decision was taken because there was \u201csignificant\u201d peat-cutting  going on without any planning permission or environmental impact assessment. <\/p>\n<p class=\"c-paragraph paywall \">\u201cDespite evidence of these ongoing illegal activities, enforcement action at the local level is not being taken,\u201d it said. <\/p>\n<p class=\"c-paragraph paywall \">That evidence is not just physical but economic: commercial peat operators export 370,000 tonnes, valued at about \u20ac40 million, a year despite having no licence, planning permission or other required permits to do so. <\/p>\n<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/environmental-protection-agency-epa\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/environmental-protection-agency-epa\/\">Environmental Protection Agency<\/a> (EPA) said this year that illegal large-scale extraction of peat was \u201cwidespread\u201d. <\/p>\n<p class=\"c-paragraph paywall \">\u201cThe sector does not operate within planning or environmental laws,\u201d the agency said. <\/p>\n<p class=\"c-paragraph paywall \">The commission\u2019s move follows years of legal wrangles over peat extraction in Ireland. <\/p>\n<p class=\"c-paragraph paywall \">The activity has never been properly regulated, with comprehensive rules only being introduced after a decade of legal challenges led by Friends of the Environment ended in 2019. <\/p>\n<p class=\"c-paragraph paywall \">At that point, the government at the time introduced legislation requiring commercial peat operators to have one or two forms of environmental assessment and to secure planning permission. In the case of extraction sites of more than 50 hectares they must have a licence from the EPA, too. <\/p>\n<p class=\"c-paragraph paywall \">\u201cThese legislative changes were not followed by enforcement action,\u201d the commission said in its decision to refer Ireland to the <a href=\"https:\/\/www.irishtimes.com\/tags\/european-court-of-justice\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-court-of-justice\/\">European Court of Justice<\/a>. <\/p>\n<p class=\"c-paragraph paywall \">After the legislative changes, Bord na M\u00f3na, the semi-State peat extraction company, took the decision to cease peat production. <\/p>\n<p class=\"c-paragraph paywall \">The commission acknowledged this and the restoration work being carried out on <a href=\"https:\/\/www.irishtimes.com\/tags\/bord-na-mona\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/bord-na-mona\">Bord na M\u00f3na<\/a> lands. It noted that this work was \u201clargely funded by the EU\u201d. <\/p>\n<p class=\"c-paragraph paywall \">A small number of other large operators were ordered to shut down following court action by the EPA and some others ceased production voluntarily. <\/p>\n<p class=\"c-paragraph paywall \">But many other operators continued in business without seeking assessment, planning permission or a licence. <\/p>\n<p class=\"c-paragraph paywall \">In 2024, the EPA handed over dossiers on 38 sample sites below the 50-hectare threshold to seven local authorities for enforcement. <\/p>\n<p class=\"c-paragraph paywall \">The local authorities were in counties <a href=\"https:\/\/www.irishtimes.com\/tags\/offaly\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/offaly\/\">Offaly<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/westmeath\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/westmeath\">Westmeath<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/roscommon\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/roscommon\/\">Roscommon<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/tipperary\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/tipperary\">Tipperary<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/longford\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/longford\">Longford<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/kildare\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/kildare\">Kildare<\/a> and <a href=\"https:\/\/www.irishtimes.com\/tags\/sligo\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/sligo\">Sligo<\/a>. <\/p>\n<p class=\"c-paragraph paywall \">No enforcement action followed, an issue highlighted again by the EPA this time last year. <\/p>\n<p class=\"c-paragraph paywall \">Several of the local authorities said at that time they did not have the planning, legal or financial resources to pursue enforcement cases in what they believed would become lengthy and costly proceedings. <\/p>\n<p class=\"c-paragraph paywall \">Minister for Local Government James Browne said this year he would set up a regional enforcement authority to run the proceedings on behalf of the local authorities, but he did not give a time frame for its establishment. <\/p>\n<p class=\"c-paragraph paywall \">The commission said \u201cefforts by the Irish authorities have been insufficient\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The Minister\u2019s department has been contacted for comment. <\/p>\n","protected":false},"excerpt":{"rendered":"Ireland is being taken to the European Union\u2019s highest court for failing to stop illegal peat extraction.
