{"id":526534,"date":"2026-06-09T16:56:11","date_gmt":"2026-06-09T16:56:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/526534\/"},"modified":"2026-06-09T16:56:11","modified_gmt":"2026-06-09T16:56:11","slug":"couple-buying-first-home-miss-out-on-help-to-buy-refund-of-up-to-e30k-after-alleged-typo-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/526534\/","title":{"rendered":"Couple buying first home miss out on Help to Buy refund of up to \u20ac30k after alleged typo \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A couple buying their <a href=\"https:\/\/www.irishtimes.com\/tags\/first-time-buyer\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/first-time-buyer\/\">first home<\/a> have missed out on a tax refund up to \u20ac30,000 under the <a href=\"https:\/\/www.irishtimes.com\/tags\/help-to-buy\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/help-to-buy\/\">Help to Buy<\/a> scheme over what they claim was a \u201ctypographical error\u201d made by their valuer.<\/p>\n<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/tax-appeals-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/tax-appeals-commission\/\">Tax Appeals Commission<\/a> has dismissed the first-time buyers\u2019 appeal against a <a href=\"https:\/\/www.irishtimes.com\/tags\/revenue-commissioners\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/revenue-commissioners\/\">Revenue Commissioners<\/a>\u2019 decision last September to refuse the couple their Help to Buy application.<\/p>\n<p class=\"c-paragraph paywall \">Payment was refused by Revenue Commissioners after it noted that the valuation of their self-build home on the bank\u2019s <a href=\"https:\/\/www.irishtimes.com\/tags\/mortgage\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/mortgage\/\">mortgage <\/a>approval letter was \u20ac510,000.<\/p>\n<p class=\"c-paragraph paywall \">Revenue pointed out that to qualify for the scheme a property cannot be valued higher than \u20ac500,000.<\/p>\n<p class=\"c-paragraph paywall \">Help to Buy allows first-time purchasers of newly-built homes worth no more than \u20ac500,000 to claim back up to \u20ac30,000 in income tax and deposit interest retention tax (Dirt) they have paid over the four years prior to the year of application. <\/p>\n<p class=\"c-paragraph paywall \">More than 65,000 claims for the relief have been made successfully since it was introduced in 2017.<\/p>\n<p class=\"c-paragraph paywall \">The couple blamed a \u201ctypo\u201d by their valuer who estimated the value of the home at \u20ac510,000 instead of \u20ac500,000.<\/p>\n<p class=\"c-paragraph paywall \">To date the Help to Buy scheme has helped over 65,000 individuals or couples to buy or build their own and the scheme can provide up to \u20ac30,000 to applicants through a tax refund.<\/p>\n<p class=\"c-paragraph paywall \">In their appeal, the couple submitted that the \u20ac510,000 figure \u201cwas an unintentional typographical error by our valuer\u201d. They said the actual agreed purchase price of the property is \u20ac500,000, as stated in the official letter from the valuer.<\/p>\n<p class=\"c-paragraph paywall \">\u201cOur mortgage letter of approval valued our purchase price of the house on completion as \u20ac510,000. At the time of approval, we were unaware of the significance of this valuation as this was our first time building\/purchasing a property.\u201d<\/p>\n<p class=\"c-paragraph paywall \">An email from the valuer to the couple stated that \u201cit has come to my attention that [in] the valuation that I carried out for the above, there was a typo error on the valuation. The value for the house should have been \u20ac500,000 not \u20ac510,000\u2033.<\/p>\n<p class=\"c-paragraph paywall \">However, in dismissing the couple\u2019s appeal, Commissioner Jo Kenny said she was satisfied that the documentation presented shows that the valuation of the property, which was approved by the bank at the time the loan was entered into was \u20ac510,000, which exceeded the maximum purchase value of \u20ac500,000 provided for in the legislation.<\/p>\n<p class=\"c-paragraph paywall \">Ms Kenny said she did not regard the fact that the valuer subsequently stated there was an error in the valuation as altering the valuation approved by the bank at the time the loan was entered into.<\/p>\n<p class=\"c-paragraph paywall \">Ms Kenny said that while she has sympathy for the couple\u2019s position, the legislation affords no discretion on the matter.
