{"id":539747,"date":"2026-06-17T11:17:12","date_gmt":"2026-06-17T11:17:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/539747\/"},"modified":"2026-06-17T11:17:12","modified_gmt":"2026-06-17T11:17:12","slug":"single-defendant-accused-of-brothel-keeping-generated-up-to-e14000-in-legal-aid-fees","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/539747\/","title":{"rendered":"Single defendant accused of brothel keeping, generated up to \u20ac14,000 in legal aid fees"},"content":{"rendered":"<p>It comes as a report revealed that 63 legal aid certificates were issued for a single defendant accused of brothel keeping, generating up to \u20ac14,000 in fees for one court appearance.<\/p>\n<p class=\"\">New legal aid rules are due to come into effect on July 1, with solicitors planning to strike for the rest of the week in protest at the proposed \u201cone accused, one fee\u201d system.<\/p>\n<p class=\"\">Government sources said the changes are aimed at addressing abuse of the system, with plans to replace the current model with a flat fee of \u20ac455 per case.<\/p>\n<p class=\"\">Under the existing system, solicitors receive \u20ac239.39 per defendant for the first two cases, \u20ac143.61 for each additional case on the first day, and \u20ac59.86 for each subsequent hearing day.<\/p>\n<p class=\"\">A confidential, unpublished report completed by the Department of Justice found several issues with the free legal aid system. These included:\u00a0<\/p>\n<ul class=\"listbullet\">\n<li>Courts not asking for statements of means;<\/li>\n<li>Cases taking nearly 2.5 times longer than those not involving free legal aid;<\/li>\n<li>Multiple solicitors from one firm representing one client on different charges and all receiving free legal aid certificates.<\/li>\n<\/ul>\n<p class=\"\">The outgoing regulation states that where \u201ctwo or more certificates for free legal aid are granted to a person and the cases in relation to which they are granted are heard together or in immediate succession, one certificate only shall be deemed\u201d.<\/p>\n<p class=\"contextmenu caption\">&#8216;Multiple certificates&#8217;\u00a0<\/p>\n<p class=\"\">The report found that \u201cmultiple certificates are being granted for no stated reason\u201d and that the number of certificates granted to a single accused person has \u201cincreased dramatically\u201d in several cases.<\/p>\n<p class=\"\">In one case, the Department of Justice received requests for payments for one lone accused person for 63 legal aid certificates for charges of brothel keeping, 221 certificates for charges of theft, and 80 certificates for charges of sexual assault.<\/p>\n<p class=\"\">\u201cThe financial implications of the misuse of Regulation 7(4) cannot be understated, as a rough estimate for one appearance in respect of the above case with 63 certificates is \u20ac14,000,\u201d the report said.<\/p>\n<p class=\"\">The report also alleged that \u201cin order to maximise earnings\u201d, multiple solicitors from the same legal firm frequently request legal aid for the same defendant who is facing multiple charges.<\/p>\n<p class=\"contextmenu caption\">&#8216;Solicitors maximising earnings&#8217;<\/p>\n<p class=\"\">\u201cFor example, in a district court case where 30 separate payments were granted in respect of multiple legal aid certificates for one defendant,\u201d states the report.<\/p>\n<p class=\"\">\u201cThese 30 separate certificates were divided amongst seven solicitors from the same firm.\u201d\u00a0<\/p>\n<p class=\"\">In most cases, only one solicitor from the firm comes to court to represent the client.<\/p>\n<p class=\"\">The report also expressed concerns that statements of means for those seeking free legal aid are not being requested from the courts.
