{"id":57156,"date":"2025-09-11T11:37:08","date_gmt":"2025-09-11T11:37:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/57156\/"},"modified":"2025-09-11T11:37:08","modified_gmt":"2025-09-11T11:37:08","slug":"landlord-to-pay-e34800-to-ex-tenants-following-egregious-behaviour-rtb-rules-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/57156\/","title":{"rendered":"Landlord to pay \u20ac34,800 to ex-tenants following \u2018egregious\u2019 behaviour, RTB rules \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">A tenant was forced to sleep rough in a park after her landlord unlawfully changed the locks to the property, part of a pattern of behaviour described as \u201csustained and egregious\u201d by a <a href=\"https:\/\/www.irishtimes.com\/tags\/residential-tenancies-board\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/residential-tenancies-board\/\">Residential Tenancies Board<\/a> tribunal. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Afrim Hoxha, landlord of the property at Fortlawn Drive, <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-15\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-15\/\">Dublin 15<\/a>, must pay a total of \u20ac34,800 to three former tenants after the tribunal found he breached various statutory obligations. The tribunal heard evidence in the case across three days in May.<\/p>\n<p class=\"c-paragraph paywall \">Josephine Aniagye, who moved into the property in November 2023, told the tribunal she was forced to sleep in a park after the landlord changed the locks to the premises in April. <\/p>\n<p class=\"c-paragraph paywall \">The tribunal accepted Ms Aniagye\u2019s testimony, describing her experience as \u201cprofoundly distressing\u201d, and noted that it \u201cheightened her sense of vulnerability and insecurity in her own home\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The landlord changed the locks to the property during the course of the RTB tribunal proceedings in a \u201cparticularly egregious\u201d action, the tribunal noted.<\/p>\n<p class=\"c-paragraph paywall \">Over the course of her tenancy, Ms Aniagye said the landlord persistently entered the property unannounced, failed to facilitate rent-payment arrangements and failed to maintain basic utilities. <\/p>\n<p class=\"c-paragraph paywall \">She said the landlord\u2019s conduct caused her psychological distress and resulted in her missing two weeks of work.<\/p>\n<p class=\"c-paragraph paywall \">During the tribunal hearing the landlord denied many of the allegations made against him, including that he changed the locks on the property. He blamed the lock-change on another tenant.<\/p>\n<p class=\"c-paragraph paywall \">The tribunal said the landlord\u2019s conduct was aggravated by repeated attempts to discredit Ms Aniagye\u2019s evidence and justify his actions \u201con spurious grounds\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The tribunal awarded \u20ac17,000 in damages to Ms Aniagye arising from the landlord\u2019s various breaches of the Residential Tenancies Act. <\/p>\n<p class=\"c-paragraph paywall \">This Act entitles tenants to enjoy peaceful and exclusive occupation of their rented properties.<\/p>\n<p class=\"c-paragraph paywall \">The award reflected \u201cthe cumulative impact of the landlord\u2019s sustained and egregious conduct, encompassing the prolonged period of interference, the calculated attempts to intimidate the tenant and the profound disruption to her peaceful occupation and emotional wellbeing\u201d, the tribunal found.<\/p>\n<p class=\"c-paragraph paywall \">Boitshwarelo Mosotho was also locked out of the property following the lock changes in April, the tribunal heard. She said she was provided access to retrieve her belongings, but has not been permitted to return to reside at the property.<\/p>\n<p class=\"c-paragraph paywall \">She said she was forced to stay with friends after being locked out, and suffered significant disruption to her daily life and work. She said her health was negatively impacted and her work performance dipped due to the instability brought on by her landlord\u2019s actions. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Ms Mosotho also made similar allegations to Ms Aniagyei, stating the landlord repeatedly entered the premises without notice and disconnected utilities from the property.<\/p>\n<p class=\"c-paragraph paywall \">The tribunal said it regarded Ms Mosotho\u2019s reporting of emotional distress and inconvenience as credible. <\/p>\n<p class=\"c-paragraph paywall \">The tribunal awarded \u20ac15,000 to Ms Mosotho. It said it was a proportionate award, given \u201cthe severity of the landlord\u2019s conduct and the distress, anxiety and disruption caused to the tenant\u2019s peaceful occupation\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Another tenant, Esther Garc\u00eda P\u00e9rez, alleged that the landlord engaged in inappropriate behaviour, including sexual harassment. <\/p>\n<p class=\"c-paragraph paywall \">She alleged that he repeatedly attempted to enter her bedroom, but prevented him from doing so by locking the door.<\/p>\n<p class=\"c-paragraph paywall \">Ms Garc\u00eda P\u00e9rez ultimately left the premises in April 2024, saying she felt unsafe. <\/p>\n<p class=\"c-paragraph paywall \">In total, the tribunal ordered Ms Garc\u00eda P\u00e9rez be compensated \u20ac2,000.<\/p>\n<p class=\"c-paragraph paywall \">The landlord served notices of termination on the tenants in December 2023, but they were found to be invalid. The tribunal found the landlord had no intention to sell the property, but rather used the notices as a mechanism to remove tenants \u201cdeemed troublesome\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Subsequent notices of termination were also found to be invalid.<\/p>\n<p class=\"c-paragraph paywall \">During the tribunal hearing, a man identified as John Hoxha made submissions on behalf of the landlord of the Fortlawn Drive property, Afrim Hoxha.
