{"id":579041,"date":"2026-07-10T18:03:18","date_gmt":"2026-07-10T18:03:18","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/579041\/"},"modified":"2026-07-10T18:03:18","modified_gmt":"2026-07-10T18:03:18","slug":"dispute-over-alleged-overheating-in-e6m-dublin-penthouse-goes-to-mediation-court-told-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/579041\/","title":{"rendered":"Dispute over alleged overheating in \u20ac6m Dublin penthouse goes to mediation, court told \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> dispute over alleged overheating of a \u20ac6 million penthouse <a href=\"https:\/\/www.irishtimes.com\/tags\/apartment\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/apartment\/\">apartment<\/a> in <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin\/\">Dublin<\/a> is to go to mediation, a judge has been told.<\/p>\n<p class=\"c-paragraph paywall \">Aideen O\u2019Byrne bought the Lansdowne Place, <a href=\"https:\/\/www.irishtimes.com\/tags\/ballsbridge\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/ballsbridge\/\">Ballsbridge<\/a>, apartment \u2013 marketed in 2017 as \u201cthought to be the most expensive in Ireland\u201d \u2013 for some \u20ac6.16 million and moved into it in 2021. <\/p>\n<p class=\"c-paragraph paywall \">She has claimed that due to a failure to maintain or repair the district heating system, temperatures in her apartment have reached \u201cunbearable\u201d highs of 33 degrees.<\/p>\n<p class=\"c-paragraph paywall \">Temperatures in lobby areas have been recorded to reach 29 degrees, she claimed.<\/p>\n<p class=\"c-paragraph paywall \">The defendants deny the claims. Developer Copper Bridge said it had experts who \u201cflatly contradict\u201d the claims of Byrne and also that it spent three years trying to address her claims without any progress.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2026\/02\/11\/lawyer-complains-about-hearing-delays-in-case-over-6m-apartments-alleged-heating-defects\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Lawyer complains about hearing delays in case over \u20ac6m apartment\u2019s alleged heating defectsOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">The case has been before the court on a number of occasions to deal with a number of matters, including discovery.<\/p>\n<p class=\"c-paragraph paywall \">On Friday, Gavin Mooney, counsel for O\u2019Byrne, told Judge Brian Cregan that pleadings had closed, most discovery had been agreed and it had been agreed between the parties to go to mediation on October 12th. <\/p>\n<p class=\"c-paragraph paywall \">The court heard outstanding discovery issues had been paused until then. <\/p>\n<p class=\"c-paragraph paywall \">The judge said he wanted the parties to \u201cput their minds together\u201d and use the 10 weeks between now and the mediation to resolve outstanding issues on discovery.
