disability charity has been ordered to pay over \u20ac320,000 in a record whistleblower penalisation award to a senior manager following an attempt to replace her and allegations of bullying against its ex-chairman.<\/p>\n<p class=\"c-paragraph paywall \">The Waterford Intellectual Disability Association (WIDA) has been ordered by the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission (WRC)<\/a> to pay the compensation to Fiona O\u2019Neill, the charity\u2019s \u201cde facto chief executive officer\u201d, on foot of her complaints under the Protected Disclosures Act 2014. <\/p>\n<p class=\"c-paragraph paywall \">It\u2019s more than triple the previous record sum awarded by the WRC in a dispute brought under the whistleblower shield law. <\/p>\n<p class=\"c-paragraph paywall \">The unidentified former chairman was alleged to have declared he would install an interim chief executive (CEO) who \u201chates whistleblowers\u201d, who would run the organisation \u201cthe way the board wanted it to run\u201d \u2013 and that the chairman would \u201csee [Ms O\u2019Neill] out of WIDA before he would go anywhere\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The chairman has since been replaced, the WRC recorded in a set of decisions on the dispute published on Wednesday. <\/p>\n<p class=\"c-paragraph paywall \">Shaun Boylan, for the complainant, submitted that a chairman of the board, identified only as \u201cEC\u201d in the decisions, had \u201cincreasingly sought to interfere\u201d with the management of the service. <\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2026\/07\/1784683890_230_1754647931518-c07d65db-55b5-463e-ae51-976300c5837e.jpeg\"\/>Aer Lingus job cuts and Ryanair\u2019s profits plunge &#8211; what is happening in the Irish aviation sector?<\/p>\n<p class=\"c-paragraph paywall \">This included the chairman directing O\u2019Neill to \u201cassist him\u201d at the Farrelly Commission \u2013 the State investigation into the Grace case concerning alleged foster home abuse of a woman with intellectual disabilities, Boylan said. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Neill considered this inappropriate, as she was to be a witness before the commission, it was submitted. <\/p>\n<p class=\"c-paragraph paywall \">In early 2022, she notified the board of a complaint of \u201cbullying and harassment against the chair\u201d and asked that this be treated as a protected disclosure, the tribunal heard. <\/p>\n<p class=\"c-paragraph paywall \">In September 2022 board engaged an external human resources consultant for an \u201corganisational review\u201d. <\/p>\n<p class=\"c-paragraph paywall \">\u201c[This] investigation into bullying and harassment by one executive management team member against the chairman morphed into a root-and-branch review of the organisation without any adequate explanation,\u201d Boylan submitted. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Neill and her trade union, the Psychiatric Nurses\u2019 Association (PNA) took issue with the independence and fairness of the process, which produced two reports her legal team argued went beyond their terms of reference and made \u201cunwarranted and unjustified\u201d recommendations. <\/p>\n<p class=\"c-paragraph paywall \">These included the creation of a CEO post at the charity \u2013 effectively demoting O\u2019Neill, as she was the most senior manager in place at the time as director of services \u2013 its \u201cde facto CEO\u201d \u2013 her legal team said. <\/p>\n<p class=\"c-paragraph paywall \">As well as demoting Ms O\u2019Neill, the report urged the charity to eliminate the jobs of its human resources (HR) manager and corporate governance officer, two other senior managers who \u201chad come into conflict with the chair\u201d, Boylan submitted. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Neill then faced pressure from the chairman in late 2022 to settle a \u20ac33,000 invoice raised by the external consultant out of the charity\u2019s funds, the tribunal heard. <\/p>\n<p class=\"c-paragraph paywall \">The chairman had told her the HSE had ordered the review, but when she inquired with the health service, she learned this was not the case, Mr Boylan submitted. <\/p>\n<p class=\"c-paragraph paywall \">Two more invoices were later raised in relation to the consultant \u2013 one for \u20ac24,995, the other for \u20ac8,071, it was submitted. <\/p>\n<p class=\"c-paragraph paywall \">Boylan said his client noticed the sum of the two later invoices added up to the outstanding sum of the first invoice. <\/p>\n<p class=\"c-paragraph paywall \">She was concerned the invoice had been split to \u201cdeliberately circumvent financial controls\u201d, as invoices valued over \u20ac25,000 were required to go through procurement under the charity\u2019s service level agreement with the HSE. <\/p>\n<p class=\"c-paragraph paywall \">She told the HSE she was concerned about \u201cimproperly procured services\u201d in February 2023, and went on to make disclosures to the Charities Regulator and the National Office for Protected Disclosures later in the year, the tribunal heard. <\/p>\n<p class=\"c-paragraph paywall \">The stand-off over the invoices continued and in March 2023, the chairman emailed O\u2019Neill directing her to pay them, according to the legal papers. <\/p>\n<p class=\"c-paragraph paywall \">\u201cYou may pay them under duress if you wish, but they must be paid, to avoid attracting much greater cost, and doing irreparable damage to the company in the courts,\u201d he wrote in correspondence opened to the WRC. <\/p>\n<p class=\"c-paragraph paywall \">At a meeting with the HSE in April 2023, the chair called correspondence sent on behalf of claimant by the PNA \u201crubbish\u201d and added he \u201cwould see [Ms O\u2019Neill] out of WIDA before he would go anywhere\u201d, it was submitted. <\/p>\n<p class=\"c-paragraph paywall \">In January 2024, the chairman held a \u201cone-minute meeting\u201d with O\u2019Neill and told her an interim CEO would be starting the following day, it was submitted. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Neill\u2019s case was that the chairman informed her the new appointee \u201chates whistleblowers\u201d and was being put in place to run the charity \u201cthe way the board wanted it run\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Three hearings on the case had already been conducted by the WRC at sittings in Waterford when in May 2025, a solicitor acting for WIDA, John Goff, told adjudicator Gaye Cunningham the former board had stepped down. <\/p>\n<p class=\"c-paragraph paywall \">The new board \u201cconcedes all the allegations made by the complainant [and] offers an unequivocal apology\u201d, Goff added. <\/p>\n<p class=\"c-paragraph paywall \"> Boylan, who was led by solicitor Kirsty Kavanagh on behalf of the PNA, said in a closing submission that his client was penalised \u201con the extreme end of the spectrum\u201d. <\/p>\n<p class=\"c-paragraph paywall \">He argued for \u201ccompensation on the upper end\u201d, noting that his client had to go to the High Court in relation to the dispute and that the charity \u201crefused to give undertakings until the very last minute\u201d. <\/p>\n<p class=\"c-paragraph paywall \">In decision documents published today, Cunningham found WIDA penalised O\u2019Neill \u201cin a most egregious manner throughout a long period\u201d while being \u201cfully aware\u201d of her protected disclosures.<\/p>\n<p class=\"c-paragraph paywall \">She awarded \u20ac323,240 for the breaches of the Protected Disclosures Act \u2013 more than triple the previous record award at the WRC under the legislation. <\/p>\n<p class=\"c-paragraph paywall \">Cunningham further directed WIDA to quash both reports; cease the position of interim CEO and stop any moves to appoint one; acknowledge Ms O\u2019Neill as \u201cde facto CEO\u201d, and offer her a \u201cfull and unequivocal apology for the mistreatment\u201d.
