{"id":606056,"date":"2026-07-27T06:56:12","date_gmt":"2026-07-27T06:56:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/606056\/"},"modified":"2026-07-27T06:56:12","modified_gmt":"2026-07-27T06:56:12","slug":"lorcan-murphys-use-of-spy-pen-to-record-women-in-dublin-part-of-path-to-future-crime-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/606056\/","title":{"rendered":"Lorcan Murphy\u2019s use of \u2018spy pen\u2019 to record women in Dublin part of \u2018path to future crime\u2019 \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Lorcan Tadgh Murphy, who was earlier this month <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2026\/07\/09\/dublin-man-who-murdered-american-nurse-is-jailed-for-14-years-in-hungary\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2026\/07\/09\/dublin-man-who-murdered-american-nurse-is-jailed-for-14-years-in-hungary\/\">jailed for murdering US nurse Mackenzie Michalski<\/a> in Hungary, had obsessively tried to pick up women across various European cities.<\/p>\n<p class=\"c-paragraph paywall \">He even covertly recorded  attempts in Dublin.<\/p>\n<p class=\"c-paragraph paywall \">The south Dublin law and marketing graduate was jailed for 14 years earlier this month for the brutal assault and strangulation of the nurse, from Portland, Oregon, during a visit to Budapest in November 2024.<\/p>\n<p class=\"c-paragraph paywall \">During their investigation into Michaelski\u2019s murder, Hungarian police <a href=\"https:\/\/www.irishtimes.com\/crime-law\/2026\/07\/17\/what-hungarian-police-found-on-the-laptop-of-dublin-murderer-lorcan-murphy\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/2026\/07\/17\/what-hungarian-police-found-on-the-laptop-of-dublin-murderer-lorcan-murphy\/\">discovered video footage<\/a> of Murphy\u2019s efforts to pick up 16 young women in Dublin city centre, probably in the summer of 2020. The recordings had been made on a \u201csmall camera disguised as a pen\u201d or a \u201cspy pen\u201d, police said.<\/p>\n<p class=\"c-paragraph paywall \">These women may never realise they were recorded by Murphy (38), whose digital footprint also revealed a serious porn addiction and detailed notetaking about his pickup \u201csuccess rate\u201d and derogatory views about women.<\/p>\n<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-rape-crisis-centre\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-rape-crisis-centre\/\">Dublin Rape Crisis Centre<\/a> has been concerned for some time at the increasing use of hidden cameras, spy glasses, pen cameras and other covert recording devices to secretly film women and girls without their knowledge or consent, says the organisation\u2019s chief executive Rachel Morrow. <\/p>\n<p class=\"c-paragraph paywall \">Recordings such as those made by Murphy are \u201coften minimised as harmless\u201d, but this type of \u201charassment\u201d was \u201cpart of a path to future crime\u201d, she says. <\/p>\n<p class=\"c-paragraph paywall \">\u201cVictims may never discover that recordings of them have been captured, shared or repeatedly viewed by strangers &#8230; The number of known cases is likely to represent only a fraction of the true extent of the problem.\u201d<\/p>\n<p class=\"c-paragraph paywall \">There is a strong case for criminalising the covert recording of individuals where a reasonable person would regard it as sexualising, she says.<\/p>\n<p class=\"c-paragraph paywall \">Section 3 of the Harassment, Harmful Communications and Related Offences Act 2020, also known as <a href=\"https:\/\/www.irishtimes.com\/ireland\/2023\/05\/22\/qa-on-sharing-intimate-images\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/ireland\/2023\/05\/22\/qa-on-sharing-intimate-images\/\">Coco\u2019s Law<\/a>, made it an offence to record, distribute or publish intimate images of someone without their consent. <\/p>\n<p class=\"c-paragraph paywall \">Photographing up skirts or down blouses falls under this offence. There have been 48 section 3 prosecutions since the offence was introduced six years ago, according to the Director of Public Prosecutions.<\/p>\n<p class=\"c-paragraph paywall \">But Morrow says Coco\u2019s Law does not affect a man who conceals a camera to film a woman above her clothes in public.<\/p>\n<p class=\"c-paragraph paywall \">\u201cWithout updated laws sending a clear unambiguous message to everyone that this behaviour will not be tolerated, we have little hope of turning the tide on the covert filming epidemic we see growing before our eyes,\u201d she says.<\/p>\n<p class=\"c-paragraph paywall \">The State\u2019s data privacy watchdog, the Data Protection Commission (DPC), says privacy laws generally do not prohibit people from taking photos or videos in a public space, provided no harassment is involved. <\/p>\n<p class=\"c-paragraph paywall \">A data protection issue could arise if the imagery was shared publicly or sold for commercial gain, it says.<\/p>\n<p class=\"c-paragraph paywall \">University College Dublin law lecturer and data protection expert TJ McIntyre says data laws are engaged if identifiable images are taken of people in public spaces. <\/p>\n<p class=\"c-paragraph paywall \">Exemptions permitting processing of this data include journalistic photography and recordings for recreational purposes or personal, family or household affairs.<\/p>\n<p class=\"c-paragraph paywall \">He believes the description of Murphy\u2019s use of the recordings would not qualify for one of the exemptions and would equate to a breach of privacy laws. <\/p>\n<p class=\"c-paragraph paywall \">Alleged breaches of data protection laws are not a criminal matter but can be reported to the DPC or pursued through the civil courts.<\/p>\n<p class=\"c-paragraph paywall \">Policing privacy breaches arising from covert recordings is difficult, says McIntyre. A more impactful intervention would be to target the companies providing devices that \u201csystemically\u201d lend themselves to surrepetitous recording, he says.<\/p>\n<p class=\"c-paragraph paywall \">He pointed to the most prominent discrete recording device: <a href=\"https:\/\/www.irishtimes.com\/tags\/meta\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/meta\/\">Meta<\/a>\u2019s AI glasses, which to the uninitiated look like regular spectacles or sunglasses. Along with other smart features, a small camera on the side of the glasses records outwards from the wearer\u2019s perspective. A tiny LED light illuminates to indicate to others when the camera is on.<\/p>\n<p class=\"c-paragraph paywall \">Critics of the technology, including McIntyre, say the light is not obvious enough and can be easily covered. An internet search for ways to block the light returns a plethora of results.<\/p>\n<p class=\"c-paragraph paywall \">Meta says the camera disables if the glasses detect the light has been covered. However, in a recent blog post it acknowledged some people have gone to sophisticated lengths to interfere with the light.<\/p>\n<p class=\"c-paragraph paywall \">\u201cWe are continuously improving our ability to detect tampering, and now we\u2019re updating the glasses to disable the camera if they detect the LED was physically tampered with,\u201d the company said. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/opinion\/2026\/07\/15\/the-rough-sex-defence-didnt-work-for-lorcan-murphy-he-wasnt-the-first-to-try-it\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Kathy Sheridan: The \u2018rough sex\u2019 defence didn\u2019t work for Lorcan Murphy. He wasn\u2019t the first to try itOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">When contacted, a Meta spokeswoman said many people use the glasses because they were genuinely helpful in everyday moments, such as listening to music or making hands-free calls. The company would keep strengthening protections as the glasses become more capable, she added.<\/p>\n<p class=\"c-paragraph paywall \">McIntyre says society should ask whether technology enabling surreptitious recording should be allowed.<\/p>\n<p class=\"c-paragraph paywall \">\u201cAt the very minimum it should be socially unacceptable for people to be using these in public,\u201d he says.<\/p>\n<p class=\"c-paragraph paywall \">Ruth Breslin, director of the Sexual Exploitation Research and Policy Institute, says the filming of women on the street without their knowledge is \u201cvery problematic behaviour\u201d.
