{"id":60654,"date":"2025-09-13T01:04:19","date_gmt":"2025-09-13T01:04:19","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/60654\/"},"modified":"2025-09-13T01:04:19","modified_gmt":"2025-09-13T01:04:19","slug":"central-bank-of-ireland-accused-of-cop-out-over-israeli-war-bond-switch-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/60654\/","title":{"rendered":"Central Bank of Ireland accused of \u2018cop-out\u2019 over Israeli \u2018war bond\u2019 switch \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">An Oireachtas committee chairwoman has accused the Central Bank of Ireland of a \u201ccop-out\u201d over <a href=\"https:\/\/www.irishtimes.com\/tags\/israel\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/israel\">Israel<\/a>\u2019s \u201cwar bond\u201d transfer to Luxembourg, after the bank gave its blessing for the switch to EU regulators.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Sinn F\u00e9in TD <a href=\"https:\/\/www.irishtimes.com\/tags\/mairead-farrell\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/mairead-farrell\">Mair\u00e9ad Farrell<\/a>, chairwoman of the Oireachtas finance committee, said the bank had sweeping discretionary powers to refuse Israel\u2019s move but didn\u2019t when notifying the change to the European Securities and Markets Authority (ESMA) in Paris.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe crux of it for me remains that this request should have been refused,\u201d Ms Farrell said. <\/p>\n<p class=\"c-paragraph paywall \">\u201cHad the Central Bank refused this request or indeed refused to approve the prospectus it would have sent a strong signal to other EU central banks about the serious concern they have as to the genocide and these bonds being used to fund this.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThis is what should have happened; instead we have a cop-out where the approval was simply moved to Luxembourg, which occurred at the sole discretion of the Irish Central Bank.\u201d<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Israel uses bonds formerly approved by Ireland to part-fund its military campaign in the <a href=\"https:\/\/www.irishtimes.com\/tags\/gaza-strip\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/gaza-strip\">Gaza Strip<\/a>. The country rejects claims it is committing genocide in Gaza.<\/p>\n<p class=\"c-paragraph paywall \">The war has led to tens of thousands of deaths and a United Nations declaration of famine in the crowded Palestinian enclave.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/2025\/09\/01\/israel-to-market-war-bonds-through-luxembourg-as-irish-authority-expires\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Central Bank of Ireland confirms it will no longer approve sale of Israeli \u2018war bonds\u2019Opens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">Anger about the war prompted sustained criticism of the bank for approving Israel\u2019s bond prospectus in the EU.<\/p>\n<p class=\"c-paragraph paywall \">The arrangements changed last week when bank governor Gabriel Makhlouf told Ms Farrell the power to approve Israel\u2019s bonds had transferred to Luxembourg. The switch, on the same day Irish approval for a 2024 bond expired, followed an Israeli request.<\/p>\n<p class=\"c-paragraph paywall \">The Central Bank bank always insisted it was legally obliged to approve Israel\u2019s bond document once it contained all necessary information required under EU law.<\/p>\n<p class=\"c-paragraph paywall \">However, the Irish bank has wide discretionary powers over requests to transfer the right of approval for a bond prospectus to another EU member state.<\/p>\n<p class=\"c-paragraph paywall \">The bank has the right \u201cin its sole and absolute discretion\u201d to accept or reject such requests. It must also consider each request on a case-by-case basis. The factors to be taken into account can include the domicile of the debt issuer.<\/p>\n<p class=\"c-paragraph paywall \">The Central Bank notified the Luxembourg transfer to the Esma, the supervisor of financial markets, as it was required to do under EU regulations.<\/p>\n<p class=\"c-paragraph paywall \">But it did not tell the committee directly that the critical notification had been made. A letter from Mr Makhlouf to Ms Farrell cited the regulation in question but not the Esma notification.<\/p>\n<p class=\"c-paragraph paywall \">Ms Farrell accused the bank of a lack of transparency.<\/p>\n<p class=\"c-paragraph paywall \">Asked for its response to her criticism, the bank\u2019s spokeswoman said: \u201cWe don\u2019t have any comment to make.\u201d <\/p>\n<p class=\"c-paragraph paywall \">Both the Central Bank and Esma declined to release notification papers. \u201cI can confirm that in line with requirements, written notification was provided to Esma.
