{"id":610269,"date":"2026-07-29T17:03:22","date_gmt":"2026-07-29T17:03:22","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/610269\/"},"modified":"2026-07-29T17:03:22","modified_gmt":"2026-07-29T17:03:22","slug":"witnesses-in-cafe-tips-row-unable-to-explain-mystery-card-machine-which-pulled-in-e5000-in-18-months-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/610269\/","title":{"rendered":"Witnesses in cafe tips row unable to explain mystery card machine which pulled in \u20ac5,000 in 18 months \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Staff waited nearly two years to get their split of over \u20ac5,000 in customer gratuities from a tap-to-tip machine installed at a Limerick City cafe in unexplained circumstances, a tribunal has heard. <\/p>\n<p class=\"c-paragraph paywall \">At the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission (WRC)<\/a>, both the former manager of Esquires Coffee Limerick and the proprietor of the business denied responsibility for the installation of the electronic tip machine. <\/p>\n<p class=\"c-paragraph paywall \">The owner said she did not know it was there at all until the manager came looking for her share of the proceeds. <\/p>\n<p class=\"c-paragraph paywall \">By the time the tips were distributed, a quarter of the money had been eaten up by fees charged by the machine\u2019s provider, JustTip, the Workplace Relations Commission (WRC) noted in a decision published on Wednesday. <\/p>\n<p class=\"c-paragraph paywall \">The tribunal has now ordered Rise and Grind Ltd, trading as Esquires Coffee Limerick on Catherine Street, to pay \u20ac100 in compensation to the cafe\u2019s ex-manager, Hueian Hsiao, for a delay in paying her wages. <\/p>\n<p class=\"c-paragraph paywall \">Ms Hsiao worked on and off at the cafe between May 2023 and August 2025, when she asked her employer about the tips machine 10 days before resigning her position as manager. <\/p>\n<p class=\"c-paragraph paywall \">Customers regularly used the card tip machine, Ms Hsiao told the tribunal, but she said she had never been shown any breakdown of how electronic tips were being shared with staff. <\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2026\/07\/1785344602_649_1784803479672-9ae96ac7-c636-4bcb-998c-c0aedcc60931.jpeg\"\/>What size does your pension actually need to be for a comfortable retirement?<\/p>\n<p class=\"c-paragraph paywall \">In reply to Ms Hsiao\u2019s queries, company director Agata Danielkiewicz replied: \u201cRegarding the tips machine: I\u2019m not aware of its operation, I don\u2019t have access on the site, and I\u2019m not responsible for it.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Ms Hsiao submitted further that after she registered a complaint under the Payment of Wages Act 1991 against her former employer, Danielkiewicz was in a position to access the tip machine data and tell her she was due \u20ac350. <\/p>\n<p class=\"c-paragraph paywall \">Ms Hsiao maintained she was actually due \u20ac1,000. <\/p>\n<p class=\"c-paragraph paywall \">The tribunal was told that the after fees of \u20ac1,268.57 were deducted by JustTip from the total paid into the machine by customers between May 2024 and August 2025, there was \u20ac3,731.44 left to distribute to a number of current and former staff. <\/p>\n<p class=\"c-paragraph paywall \">Hsiao considered the fees being deducted \u2013 just over a quarter of the \u20ac5,000 left by customers using it \u2013 to be \u201cunreasonable\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Under cross-examination by Edward Kelly of Holmes O\u2019Malley Sexton Solicitors LLP, for the respondent, Hsiao said she \u201cdid not know who dealt with the company who provided the tips machine\u201d. <\/p>\n<p class=\"c-paragraph paywall \">She said at some point she had asked another member of staff about the device, but he \u201cknew nothing about it\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Danielkiewicz said in her evidence she was mostly based at her firm\u2019s other site in Galway and was \u201cnot aware of the machine in Limerick\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The company director\u2019s evidence was that she contacted JustTip upon learning about the machine, and later had it deactivated. <\/p>\n<p class=\"c-paragraph paywall \">Danielkiewicz said Hsiao, as the manager, \u201cshould have known about the machine and removed it\u201d. <\/p>\n<p class=\"c-paragraph paywall \">JustTip\u2019s records showed the machine was activated late in 2024, she said. There had been \u201cno requirement to sign a contract\u201d with JustTip, Ms Danielkiewicz said. <\/p>\n<p class=\"c-paragraph paywall \">The company director said the company had reached out to \u201call staff, current and former\u201d about paying them their share of the tip machine money. <\/p>\n<p class=\"c-paragraph paywall \">Hsiao, the tribunal noted, confirmed in a post-hearing submission that she received a payment of \u20ac392.96 for the outstanding tips a week on from the hearing of her complaint in early March 2026. <\/p>\n<p class=\"c-paragraph paywall \">In her decision, adjudicator Ewa Sobanska wrote: \u201cNeither the respondent nor the complainant could explain how and when the piece of equipment was installed in the premises.\u201d<\/p>\n<p class=\"c-paragraph paywall \">While she had \u201creservations\u201d about Hsiao\u2019s evidence, she found the employer in breach of the Payment of Wages Act 1991 both when the worker filed her complaint and on the day of the hearing, Sobanska wrote. <\/p>\n<p class=\"c-paragraph paywall \">While it was the employer\u2019s duty to distribute any electronic tips, Hsiao had contributed to the delay, Sobanska concluded. <\/p>\n<p class=\"c-paragraph paywall \">She awarded \u20ac100 in compensation for the delay. <\/p>\n","protected":false},"excerpt":{"rendered":"Staff waited nearly two years to get their split of over \u20ac5,000 in customer gratuities from a tap-to-tip&hellip;\n","protected":false},"author":2,"featured_media":610270,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":"","_share_on_mastodon":"0"},"categories":[73],"tags":[79,18,19,17,81],"class_list":["post-610269","post","type-post","status-publish","format-standard","has-post-thumbnail","category-business","tag-business","tag-eire","tag-ie","tag-ireland","tag-workplace-relations-commission"],"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@ie\/117004351068771949","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/610269","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=610269"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/610269\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/610270"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=610269"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=610269"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=610269"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
