{"id":613548,"date":"2026-07-31T14:27:17","date_gmt":"2026-07-31T14:27:17","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/613548\/"},"modified":"2026-07-31T14:27:17","modified_gmt":"2026-07-31T14:27:17","slug":"school-tech-supplier-gets-injunction-over-alleged-commercial-sabotage-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/613548\/","title":{"rendered":"School tech supplier gets injunction over alleged \u2018commercial sabotage\u2019 \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A company that provides devices, software and information technology (IT) services to schools has been granted a <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> injunction over alleged unlawful accessing of confidential data by former employees working for competitors. <\/p>\n<p class=\"c-paragraph paywall \">Judge David Nolan said he was satisfied to grant the injunction to Upskill Online Ltd, trading as Olive Media, as he was satisfied there was a prima facie case of \u201ccommercial sabotage\u201d in the manner in which the defendants had interacted with and taken clients away from Upskill.<\/p>\n<p class=\"c-paragraph paywall \">Upskill, based in <a href=\"https:\/\/www.irishtimes.com\/tags\/beacon-south-quarter\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/beacon-south-quarter\/\">Beacon South Quarter<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/sandyford\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/sandyford\/\">Sandyford<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin\/\">Dublin<\/a>, is suing Ian Gaughran; Erik Jentetics; Fintan Costello; PNS Ltd, trading as PC Peripherals; Grafton Digital Ltd; and Eduvolve Ltd. <\/p>\n<p class=\"c-paragraph paywall \">The judge made the orders following a one-side-only application from counsel Jarlath Ryan, with Arthur Cunningham, and returned the case to next Wednesday\u2019s holiday sittings.<\/p>\n<p class=\"c-paragraph paywall \">Upskill says Gaughran breached a March settlement agreement over an action brought over the alleged misappropriation and misuse of confidential information and assets of Upskill.<\/p>\n<p class=\"c-paragraph paywall \">Gaughran was Upskill\u2019s former head of formal education, on a salary of \u20ac120,000 plus benefits, and was part of the settlement agreement.<\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2026\/07\/1785508037_858_1784803479672-9ae96ac7-c636-4bcb-998c-c0aedcc60931.jpeg\"\/>What size does your pension actually need to be for a comfortable retirement?<\/p>\n<p class=\"c-paragraph paywall \">Jentetics is chief executive of Grafton Digital and a director of PNS. He was also a defendant in the previous case but no settlement agreement was entered into with him. <\/p>\n<p class=\"c-paragraph paywall \">Upskill chief executive Brendan Kavanagh said in an affidavit seeking the injunction that PNS was in direct competition with his company and had made considerable efforts in recent months to acquire Upskill\u2019s customers. PNS provides its competing service through Eduvolve.<\/p>\n<p class=\"c-paragraph paywall \">The other defendant, Fintan Costello, resigned from Upskill last January and days before he did so sought to have the company\u2019s Office 365 customer invoicing and support contract records exported and compiled for his own use, Kavanagh said.<\/p>\n<p class=\"c-paragraph paywall \">Investigations revealed that Costello had unlawfully accessed Upskill\u2019s confidential commercial information on eight separate occasions in March, April and May last.<\/p>\n<p class=\"c-paragraph paywall \">Kavanagh said the previous settled proceedings revealed there was little doubt that Costello and Gaughran remained in close contact.<\/p>\n<p class=\"c-paragraph paywall \">He said Gaughran has been actively assisting the business of PNS and in breach of the March settlement agreement.
