Yet one new <a class=\"color-link\" href=\"https:\/\/www.federalregister.gov\/documents\/2026\/06\/16\/2026-12059\/medicare-drug-price-negotiation-program-and-medicare-prescription-drug-benefit-program\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.federalregister.gov\/documents\/2026\/06\/16\/2026-12059\/medicare-drug-price-negotiation-program-and-medicare-prescription-drug-benefit-program\" aria-label=\"proposal\">proposal<\/a> from the Centers for Medicare and Medicaid Services could do just the opposite.<\/p>\n<p>The agency has proposed a seemingly technical expansion of Medicare\u2019s prescription drug price control scheme, which was created by the <a class=\"color-link\" href=\"https:\/\/www.forbes.com\/sites\/sallypipes\/2025\/01\/27\/creative-counting-cant-fix-the-inflation-reduction-acts-flaws\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/sallypipes\/2025\/01\/27\/creative-counting-cant-fix-the-inflation-reduction-acts-flaws\/\" target=\"_self\" aria-label=\"Inflation Reduction Act\" rel=\"nofollow noopener\">Inflation Reduction Act<\/a> of 2022. CMS wants to treat certain newer medicines as though they were the same product as older ones when determining when they become eligible for government price controls.<\/p>\n<p>That change would have real-world consequences. It would shorten the period companies have to recover investments in improving existing medicines. As the expected return on those investments falls, companies will have less reason to pursue them.<\/p>\n<p>Pharmaceutical innovation rarely ends with a drug\u2019s first approval from the <a class=\"color-link\" href=\"https:\/\/www.forbes.com\/sites\/sallypipes\/2025\/12\/15\/chaos-at-the-fda-benefits-americas-rivals-at-the-expense-of-americas-patients\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/sallypipes\/2025\/12\/15\/chaos-at-the-fda-benefits-americas-rivals-at-the-expense-of-americas-patients\/\" target=\"_self\" aria-label=\"Food and Drug Administration\" rel=\"nofollow noopener\">Food and Drug Administration<\/a>. Researchers routinely spend years finding better ways to use medicines that already work\u2014developing new formulations, improving delivery methods, and discovering new uses for existing therapies.<\/p>\n<p>One analysis found that <a class=\"color-link\" href=\"https:\/\/jamanetwork.com\/journals\/jama-health-forum\/fullarticle\/2792644\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/jamanetwork.com\/journals\/jama-health-forum\/fullarticle\/2792644\" aria-label=\"nearly four in ten\">nearly four in ten<\/a> novel tablet and capsule medicines were later followed by at least one FDA-approved new formulation.<\/p>\n<p>Those improvements take years of additional research, new clinical trials, another round of FDA review, and substantial financial investment.<\/p>\n<p>Cancer care offers one of the clearest examples. Opdivo, Bristol Myers Squibb\u2019s immunotherapy for several cancers, was originally available only as an <a class=\"color-link\" href=\"https:\/\/www.bms.com\/ca\/en\/media\/press-release-listing\/2025-12-11-press-release.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.bms.com\/ca\/en\/media\/press-release-listing\/2025-12-11-press-release.html\" aria-label=\"intravenous infusion\">intravenous infusion<\/a>. In late 2024, the FDA approved <a class=\"color-link\" href=\"https:\/\/www.fda.gov\/drugs\/resources-information-approved-drugs\/fda-approves-nivolumab-and-hyaluronidase-nvhy-subcutaneous-injection\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.fda.gov\/drugs\/resources-information-approved-drugs\/fda-approves-nivolumab-and-hyaluronidase-nvhy-subcutaneous-injection\" aria-label=\"Opdivo Qvantig\">Opdivo Qvantig<\/a>, a new formulation that combines nivolumab with hyaluronidase, allowing many patients to receive the same medicine as a <a class=\"color-link\" href=\"https:\/\/packageinserts.bms.com\/pi\/pi_opdivo-qvantig.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/packageinserts.bms.com\/pi\/pi_opdivo-qvantig.pdf\" aria-label=\"three- to five-minute\">three- to five-minute<\/a> injection under the skin rather than a <a class=\"color-link\" href=\"https:\/\/packageinserts.bms.com\/pi\/pi_opdivo-qvantig.pdf#=page9\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/packageinserts.bms.com\/pi\/pi_opdivo-qvantig.pdf#=page9\" aria-label=\"30-minute\">30-minute<\/a> IV infusion.<\/p>\n<p>Patients spend less time in infusion chairs. And physicians and nurses can treat more people. One analysis estimated that the new formulation reduced preparation and administration time by more than <a class=\"color-link\" href=\"https:\/\/cancer.miconferences.com\/program\/scientific-program\/2025\/time-and-cost-to-healthcare-providers-and-sites-associated-with-preparation-and-administration-of-subcutaneous-vs-intravenous-nivolumab-for-the-treatment-of-cancer-a-time-driven-activity-based-costing-study\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/cancer.miconferences.com\/program\/scientific-program\/2025\/time-and-cost-to-healthcare-providers-and-sites-associated-with-preparation-and-administration-of-subcutaneous-vs-intravenous-nivolumab-for-the-treatment-of-cancer-a-time-driven-activity-based-costing-study\" aria-label=\"63%\">63%<\/a> and direct provider costs by <a class=\"color-link\" href=\"https:\/\/cancer.miconferences.com\/program\/scientific-program\/2025\/time-and-cost-to-healthcare-providers-and-sites-associated-with-preparation-and-administration-of-subcutaneous-vs-intravenous-nivolumab-for-the-treatment-of-cancer-a-time-driven-activity-based-costing-study\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/cancer.miconferences.com\/program\/scientific-program\/2025\/time-and-cost-to-healthcare-providers-and-sites-associated-with-preparation-and-administration-of-subcutaneous-vs-intravenous-nivolumab-for-the-treatment-of-cancer-a-time-driven-activity-based-costing-study\" aria-label=\"17%\">17%<\/a> per treatment episode compared with the intravenous version.<\/p>\n<p>These gains required considerable post-approval work, including a Phase 3 trial involving <a class=\"color-link\" href=\"https:\/\/www.fda.gov\/drugs\/resources-information-approved-drugs\/fda-approves-nivolumab-and-hyaluronidase-nvhy-subcutaneous-injection\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.fda.gov\/drugs\/resources-information-approved-drugs\/fda-approves-nivolumab-and-hyaluronidase-nvhy-subcutaneous-injection\" aria-label=\"495 patients\">495 patients<\/a> and a <a class=\"color-link\" href=\"https:\/\/www.fda.gov\/drugs\/resources-information-approved-drugs\/fda-approves-nivolumab-and-hyaluronidase-nvhy-subcutaneous-injection\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.fda.gov\/drugs\/resources-information-approved-drugs\/fda-approves-nivolumab-and-hyaluronidase-nvhy-subcutaneous-injection\" aria-label=\"separate FDA review\">separate FDA review<\/a> for the new formulation.<\/p>\n<p>Innovations like Opdivo Qvantig are precisely what CMS is putting at risk. Under <a class=\"color-link\" href=\"https:\/\/www.cms.gov\/files\/document\/ipay-2028-final-guidance.pdf#page=16\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.cms.gov\/files\/document\/ipay-2028-final-guidance.pdf#page=16\" aria-label=\"current policy\">current policy<\/a>, separately approved medicines generally receive their own timeline for potential selection for Medicare\u2019s price controls. Small-molecule drugs generally cannot be selected until <a class=\"color-link\" href=\"https:\/\/www.cms.gov\/files\/document\/ipay-2028-final-guidance.pdf#page=8\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.cms.gov\/files\/document\/ipay-2028-final-guidance.pdf#page=8\" aria-label=\"at least seven years\">at least seven years<\/a> after FDA approval, while biologics cannot be selected until <a class=\"color-link\" href=\"https:\/\/www.cms.gov\/files\/document\/ipay-2028-final-guidance.pdf#page=8\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.cms.gov\/files\/document\/ipay-2028-final-guidance.pdf#page=8\" aria-label=\"at least 11 years\">at least 11 years<\/a> after.<\/p>\n<p>CMS now <a class=\"color-link\" href=\"https:\/\/www.federalregister.gov\/documents\/2026\/06\/16\/2026-12059\/medicare-drug-price-negotiation-program-and-medicare-prescription-drug-benefit-program\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.federalregister.gov\/documents\/2026\/06\/16\/2026-12059\/medicare-drug-price-negotiation-program-and-medicare-prescription-drug-benefit-program\" aria-label=\"proposes\">proposes<\/a> treating certain separately approved medicines that share an active ingredient with an older product as though they were a single \u201cqualifying single source drug,\u201d or QSSD, for purposes of Medicare\u2019s price-control program. As a result, some newer therapies could become eligible for government price controls years sooner than they otherwise would.<\/p>\n<p>CMS defends this approach by arguing that medicines sharing an active ingredient should be treated alike. But companies don\u2019t invest in follow-on research based solely on chemistry. They invest when they expect the return will justify the cost. If Medicare shortens the period before price controls apply, that calculation changes. Projects that once made financial sense no longer will.<\/p>\n<p>Skeptics may dismiss this concern as speculative. It isn\u2019t. Drugmakers have already begun adjusting investment decisions in response to the Inflation Reduction Act. Just months after the law passed, Eli Lilly <a class=\"color-link\" href=\"https:\/\/lifesciencetracker.com\/entries\/eli-lilly-company-11-1-2022\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/lifesciencetracker.com\/entries\/eli-lilly-company-11-1-2022\/\" aria-label=\"abandoned\">abandoned<\/a> development of LOXO-338, an experimental treatment for certain blood cancers. A <a class=\"color-link\" href=\"https:\/\/lifesciencetracker.com\/entries\/eli-lilly-company-11-1-2022\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/lifesciencetracker.com\/entries\/eli-lilly-company-11-1-2022\/\" aria-label=\"company spokesperson\">company spokesperson<\/a> explained that, \u201cin light of the Inflation Reduction Act, this program no longer met our threshold for continued investment.\u201d<\/p>\n<p>Broader research points in the same direction. University of Chicago economists Tomas Philipson and Troy Durie estimate that the law\u2019s pricing provisions could result in roughly <a class=\"color-link\" href=\"https:\/\/bpb-us-w2.wpmucdn.com\/voices.uchicago.edu\/dist\/d\/3128\/files\/2021\/08\/Issue-Brief-Drug-Pricing-in-HR-5376-11.30.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/bpb-us-w2.wpmucdn.com\/voices.uchicago.edu\/dist\/d\/3128\/files\/2021\/08\/Issue-Brief-Drug-Pricing-in-HR-5376-11.30.pdf\" aria-label=\"135 fewer\">135 fewer<\/a> new medicines being developed over the next two decades.<\/p>\n<p>Every regulation creates incentives. CMS\u2019s proposal would encourage one thing above all else: investing less in improving existing medicines.
