{"id":653464,"date":"2026-08-24T08:04:10","date_gmt":"2026-08-24T08:04:10","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/653464\/"},"modified":"2026-08-24T08:04:10","modified_gmt":"2026-08-24T08:04:10","slug":"tenants-who-found-ukrainian-family-living-in-former-apartment-fail-to-have-complaint-upheld-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/653464\/","title":{"rendered":"Tenants who found Ukrainian family living in former apartment fail to have complaint upheld \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Tenants who discovered a Ukrainian family living in their former apartment after their tenancy was terminated, despite their landlord saying he required the home for his own use, have failed to have their complaint upheld.<\/p>\n<p class=\"c-paragraph paywall \">Michal and Anita Nowak received a notice of termination from landlord Fionan Comerford, who told them he intended to occupy the apartment in Priory Court, <a href=\"https:\/\/www.irishtimes.com\/tags\/kildare\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/kildare\/\">Kildare<\/a> town. The tenants, who had lived there since 2015, vacated the apartment in February 2025, though Anita Nowak claimed that, about two weeks later, she was told others were \u201cviewing\u201d the property.<\/p>\n<p class=\"c-paragraph paywall \">She told a <a href=\"https:\/\/www.irishtimes.com\/tags\/residential-tenancies-board-prtb\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/residential-tenancies-board-prtb\/\">Residential Tenancies Board<\/a> (RTB) tribunal she subsequently went to the apartment to \u201ccheck for post\u201d, and when she knocked on the door, it was answered by a Ukrainian woman and her daughter, according to a tribunal report published on Friday.<\/p>\n<p class=\"c-paragraph paywall \">Michal Nowak claimed he was told by the new residents they were renting the property from Comerford for \u20ac1,300, up from the \u20ac844 they were paying. The pair also submitted a photograph into evidence of post issued to the Ukrainian residents at the address. He told the tribunal he believed that once the tenancy had been terminated, Comerford would move in but \u201che had not\u201d, he maintained.<\/p>\n<p class=\"c-paragraph paywall \">The tenants told the tribunal they brought the dispute so Comerford would \u201ctake responsibility for what had happened\u201d, claiming the issue had \u201ccaused stress\u201d and affected their health.<\/p>\n<p class=\"c-paragraph paywall \">Speaking on behalf of their former landlord, John Comerford claimed Fionan Comerford had moved into the apartment about two months after the tenants vacated.<\/p>\n<p class=\"c-paragraph paywall \">He confirmed that a Ukrainian woman and her daughter had moved into the property, but said they were \u201cguests\u201d of the landlord and this arrangement lasted two months. He told the tribunal that a utility bill had been put in the name of the woman as she required a proof of address.<\/p>\n<p class=\"c-paragraph paywall \">Another Ukrainian person subsequently stayed at the property for a period, he said.<\/p>\n<p class=\"c-paragraph paywall \">However, he told the tribunal Comerford was the sole occupant of the apartment by the time of the hearing in February this year, though he was \u201caway travelling a lot\u201d.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/2026\/08\/13\/irish-inflation-unchanged-at-34-amid-uncertainty-of-middle-east-peace-deal\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Higher energy prices and rising rents increase cost-of-living squeeze for Irish householdsOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">The tribunal did not uphold the former tenants\u2019 complaint and found Fionan Comerford had not \u201cabused the termination process\u201d, saying it was satisfied he moved into the property.<\/p>\n<p class=\"c-paragraph paywall \">It said it was also satisfied the Ukrainian people staying at the apartment were \u201ccategorised as guests\u201d of Comerford under the Accommodation Recognition Payment (ARP) scheme and that he had not entered into a new tenancy.<\/p>\n<p class=\"c-paragraph paywall \">A letter from the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-social-protection\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-social-protection\/\">Department of Social Protection <\/a>outlining that the ARP had been paid to Comerford for hosting the Ukrainian people had been entered into evidence.<\/p>\n<p class=\"c-paragraph paywall \">Since March, new ARP applications for properties that have been registered with the RTB at any time since Russia\u2019s invasion of Ukraine in 2022 are no longer eligible. The move aimed to stop private rental properties being used.<\/p>\n<p class=\"c-paragraph paywall \">The monthly tax-free payment was cut from \u20ac800 to \u20ac600 last June. It will be cut again to \u20ac400 from next month as part of a gradual phasing-out of the scheme, which is due to be wound down by March 2027.<\/p>\n<p class=\"c-paragraph paywall \">The tribunal separately did not uphold Comerford\u2019s complaint that Michal and Anita Nowak caused damage to the property in excess of normal wear and tear. Comerford had attributed mould to his belief the tenants were running a \u201claundry business\u201d at the apartment.
