Three young people have appeared before Clonakilty District Court charged in connection with an incident in which a stolen BMW was stopped near Ballinhassig in the early hours of yesterday.<\/p>\n

Two 14-year-old boys and 19-year-old Wayne Daly, of Farm Lawn, Manor Farm, Lehenaghmore, Cork, are charged with allowing themselves to be carried in a vehicle taken without the owner\u2019s consent or lawful authority, contrary to the Road Traffic Act 1961. The juveniles cannot be identified because of their age.<\/p>\n

Court presenter Sgt Tom Mulcahy gave certificate evidence of the arrest, charge, and caution of the two juveniles.<\/p>\n

Judge Brendan O\u2019Reilly told the parents present that, following the recent McCormack High Court decision, he was required to state that the boys were presumed innocent.<\/p>\n

Judge O\u2019Reilly said that, as they were not legally represented in court, they were at a disadvantage.<\/p>\n

Both had previously consulted solicitors and applied for bail.<\/p>\n

Garda\u00ed did not object.<\/p>\n

The court heard that neither had previous convictions or had been the subject of a bench warrant.<\/p>\n

Bail was granted on their own \u20ac100 cash bonds, subject to conditions including that they live at their home addresses, attend school, sign on daily at a local garda station, observe a 10pm to 6am curfew, remain contactable by phone, stay out of West Cork, and be of good behaviour.<\/p>\n

They were remanded on bail to Bandon District Court on September 11 for directions from the Director of Public Prosecutions.<\/p>\n

Detective Garda Neil Ryan gave evidence that Wayne Daly made no reply when charged.<\/p>\n

Garda\u00ed objected to bail, telling the court that Mr Daly had 12 outstanding matters, including three alleged similar incidents.<\/p>\n

Det Gda Ryan said Mr Daly had been the subject of three bench warrants earlier this year, was already on bail and was considered likely to commit further offences if released.<\/p>\n

Mr Daly told the court the warrants arose from mix-ups over court dates.<\/p>\n

He said he had recently begun a new job, had \u201cgot in with the wrong people\u201d and did not want to get into further trouble.<\/p>\n

Sgt Mulcahy said that Mr Daly was already before the courts on a number of similar charges and was on bail at the time of the alleged offence.<\/p>\n

Judge O\u2019Reilly granted Mr Daly bail on his own bond of \u20ac300 cash and an independent surety of \u20ac1,000, with \u20ac300 required in cash and a freezing order on the remaining \u20ac700.<\/p>\n

He was also directed to live at his home address, sign on daily at Togher Garda Station, observe a 10pm to 6am curfew, remain contactable by phone, stay out of West Cork and be of good behaviour.<\/p>\n

Mr Daly said that he could not immediately raise the money and was remanded in custody, with consent to bail, to appear again at Clonakilty District Court on August 27 for directions from the DPP.<\/p>\n
