{"id":66121,"date":"2025-09-15T20:01:08","date_gmt":"2025-09-15T20:01:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/66121\/"},"modified":"2025-09-15T20:01:08","modified_gmt":"2025-09-15T20:01:08","slug":"former-attorney-general-to-challenge-slane-bypass-planning-approval-in-high-court-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/66121\/","title":{"rendered":"Former attorney general to challenge Slane bypass planning approval in High Court \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">A legal challenge by a former <a href=\"https:\/\/www.irishtimes.com\/tags\/attorney-general\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/attorney-general\/\">attorney general<\/a> John Rogers, aimed at overturning a planning approval for the Slane bypass in Co <a href=\"https:\/\/www.irishtimes.com\/tags\/meath\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/meath\">Meath<\/a>, will be heard at the <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> in January.<\/p>\n<p class=\"c-paragraph paywall \">Mr Rogers, a senior counsel, of Crewbane, Slane, says his lands will be affected by the proposed bypass. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Petrifying streams on the lands are particularly affected, Crewbane Marsh floods a number of times a year and <a href=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\/\">An Coimisi\u00fan Plean\u00e1la<\/a> had not obtained expert hydrologist advice about the impact of proposed deep trenching for the proposed route, he said in an affidavit.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">When it approved Meath County Council\u2019s application for permission last June, the commission did not have an adequate expert report concerning this significant road project adjacent to the <a href=\"https:\/\/www.irishtimes.com\/tags\/unesco\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/unesco\">Unesco<\/a> Br\u00fa na B\u00f3inne World Heritage Site of Outstanding Natural Value, which includes the Neolithic passage tomb at Newgrange, he also argues.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/ireland\/2025\/07\/01\/great-day-for-slane-as-long-awaited-bypass-and-gets-approval-from-an-coimisiun-pleanala\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">\u2018Great day\u2019 for Slane as long-awaited bypass gets approval from An Coimisi\u00fan Plean\u00e1laOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">That contrasted with 2012, when An Bord Plean\u00e1la refused the council\u2019s first application for planning permission for the bypass, Mr Rogers said in a grounding affidavit.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The board\u2019s refusal was for reasons including it was within the viewshed &#8211; the view of a geographical area from a specific vantage point &#8211; of the Unesco World Heritage site.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The board had commissioned a report by Dr Douglas R Comer, a former chief of the US national parks service responsible for all planning and development projects with that service, Mr Rogers said. A report by a person of the standing of Dr Comer was not before the commission in the second planning application, he said<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Unlike 2012, there was no oral hearing where opinions and statements of the experts could be examined concerning the second planning application, Mr Rogers said.<\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"Former attorney general John Rogers. Photograph: Dara Mac Donaill\/The Irish Times <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">What was \u201cmost noteworthy\u201d was that the Environmental Impact Assessment report accompanying the second application approached the assessment on the project on the basis the world heritage site \u201cis just another factor be to considered in the route selection\u201d, he added.<\/p>\n<p class=\"c-paragraph paywall \">In written observations to the commission, he objected to the \u201ctrenching of a highway\u201d through the Boyne valley. He submitted there was no necessity for the bypass as the N33 was built years ago as the route to relieve Ardee, Collon and Slane and said traffic congestion in Slane would be relieved and resolved by restricting HGVs from using the N2 to pass through Slane. <\/p>\n<p class=\"c-paragraph paywall \">The council responded a proper course of action was to implement improvements to the \u201csub-standard\u201d national primary route and for HGVs to be retained on it. This ignores that Slane already has access to the M1 and M3 motorways designed for such traffic, he said.<\/p>\n<p class=\"c-paragraph paywall \">The case by Mr Rogers, represented by barrister Michael O\u2019Donnell, instructed by solicitor Gabriel Toolan, came before the High Court\u2019s planning and environment list on Monday.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Mr Justice Richard Humphreys fixed a hearing date for January 15th, 2026. He was told the council is very anxious the case is heard quickly.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The road project involves construction of a 3.5km-long bypass around Slane village and includes a dual carriageway and a 258m-long bridge over the River Boyne.<\/p>\n<p class=\"c-paragraph paywall \">The council has said the reasons for the 2012 refusal of permission were taken into account by the project team in its second application, as had changes to design standards, government policies and environmental legislation.<\/p>\n<p class=\"c-paragraph paywall \">Slane is at the crossroads of two major arteries for traffic &#8211; the N2 which links Dublin to Derry and the N51 which links Delvin, Co Westmeath to Drogheda, Co Louth via Navan. An estimated 17,000 vehicles travel through the village daily via the N2 and N51.<\/p>\n<p class=\"c-paragraph paywall \">There have been several calls over years for a bypass to address road safety concerns.
