{"id":665916,"date":"2026-08-31T22:48:11","date_gmt":"2026-08-31T22:48:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/665916\/"},"modified":"2026-08-31T22:48:11","modified_gmt":"2026-08-31T22:48:11","slug":"gardai-decided-against-investigating-niall-collins-over-land-sale-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/665916\/","title":{"rendered":"Garda\u00ed decided against investigating Niall Collins over land sale \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/tags\/an-garda-siochana\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-garda-siochana\/\">Garda\u00ed<\/a> told Minister of State <a href=\"https:\/\/www.irishtimes.com\/tags\/niall-collins\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/niall-collins\/\">Niall Collins<\/a> last year that there would be no prosecution on foot of a complaint against him relating to the sale of local authority land to his wife in 2007.<\/p>\n<p class=\"c-paragraph paywall \">People Before Profit TD <a href=\"https:\/\/www.irishtimes.com\/tags\/paul-murphy\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/paul-murphy\/\">Paul Murphy<\/a> lodged a complaint with the <a href=\"https:\/\/www.irishtimes.com\/tags\/standards-in-public-office-commission-sipo\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/standards-in-public-office-commission-sipo\/\">Standards in Public Office Commission<\/a> (Sipo) \u2013 the State\u2019s ethics watchdog \u2013 in 2023 after online publication The Ditch reported that Collins had voted to sell public land in Limerick that his wife subsequently bought.<\/p>\n<p class=\"c-paragraph paywall \">Last week Sipo told Murphy that it was proceeding to conduct a preliminary investigation into his complaint against Collins. This process will decide if a full investigation is warranted. Sipo declined to answer a number of questions from The Irish Times about the process.<\/p>\n<p class=\"c-paragraph paywall \">Collins, who is a junior minister at the Department of Agriculture and has been a <a href=\"https:\/\/www.irishtimes.com\/tags\/fianna-fail\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/fianna-fail\/\">Fianna F\u00e1il<\/a> TD since 2007, also declined to comment.<\/p>\n<p class=\"c-paragraph paywall \">It is understood, however, that the Garda National Economic Crime Bureau, having received a similar complaint to Sipo, conducted an assessment of the complaints that concluded early last year, after which it was decided that no criminal investigation should take place. <\/p>\n<p class=\"c-paragraph paywall \">In a statement to The Irish Times, the Garda said: \u201cAn Garda S\u00edoch\u00e1na carried out an assessment of an allegation of alleged breaches of the Local Government Act 2001 in the Southern Garda Region. The assessment determined that a criminal investigation was not warranted. An Garda S\u00edoch\u00e1na did not commence a criminal investigation.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Sipo declined to say when it became aware of the outcome of the Garda assessment of the complaint.<\/p>\n<p class=\"c-paragraph paywall \">It said that \u201cdue to the nature of Sipo\u2019s role as an impartial oversight body, it would be inappropriate to provide a comment on any complaint that may or may not have been received\u201d. However, complainants often release details of their interactions with the commission.<\/p>\n<p class=\"c-paragraph paywall \">Murphy has confirmed that Sipo now intends to conduct a preliminary investigation. <\/p>\n<p class=\"c-paragraph paywall \">Sipo said that it conducts follow-up inquiries in fewer than 5 per cent of cases. This is understood to be the stage that Sipo has now embarked upon with the Collins complaint. It opens a formal investigation in fewer than 1 per cent of cases.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/politics\/2026\/07\/22\/minister-of-state-accuses-media-of-misinformation-regarding-aughinish-alumina\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Niall Collins accuses media of \u2018misinformation\u2019 regarding Aughinish AluminaOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">In a statement to the <a href=\"https:\/\/www.irishtimes.com\/tags\/dail-eireann\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dail-eireann\/\">D\u00e1il<\/a> in 2023, Collins confirmed that he had take part in a discussion on selling the site at the Bruff local area committee in 2007, which was subsequently bought by his wife, who was the highest bidder. By the time the council approved the sale of the site, Collins was no longer a member, having been elected to the D\u00e1il.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIn hindsight, given the focus and perception which has arisen, it would have been better if I had not taken part in the local area committee meeting. However, it was my understanding and remains the same today, that I was not participating in a discussion or a decision that in any way contravenes the 2001 Local Government Act.
