{"id":78346,"date":"2025-09-22T07:05:07","date_gmt":"2025-09-22T07:05:07","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/78346\/"},"modified":"2025-09-22T07:05:07","modified_gmt":"2025-09-22T07:05:07","slug":"how-a-car-crash-in-dublin-4-drove-public-sector-ceo-salaries-higher-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/78346\/","title":{"rendered":"How a car crash in Dublin 4 drove public-sector CEO salaries higher \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">Shortly before 6pm on a dark winter evening in January last year, a car swerved and crashed into two other vehicles on Anglesea Road in Ballsbridge, Dublin 4. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">It was driven by Mark Foley, chief executive of the national grid company <a href=\"https:\/\/www.irishtimes.com\/tags\/eirgrid\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/eirgrid\/\">EirGrid<\/a>, who was arrested by garda\u00ed and later prosecuted. The case was subsequently <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/10\/22\/drink-driving-case-against-former-eirgrid-chief-executive-dismissed-over-failure-to-offer-a-urine-test\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/10\/22\/drink-driving-case-against-former-eirgrid-chief-executive-dismissed-over-failure-to-offer-a-urine-test\/\">dismissed<\/a> but he <a href=\"https:\/\/www.irishtimes.com\/business\/2025\/06\/12\/eirgrid-paid-former-boss-mark-foley-347000-last-year-after-he-stepped-down-as-court-case-loomed\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/business\/2025\/06\/12\/eirgrid-paid-former-boss-mark-foley-347000-last-year-after-he-stepped-down-as-court-case-loomed\/\">resigned<\/a> from his post in April.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Unlikely as it seems, the incident had reverberations not just within the company but on the <a href=\"https:\/\/www.irishtimes.com\/tags\/government\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/government\/\">Government<\/a>\u2019s delicate structure for dealing with top-level pay in commercial State companies. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--center\"> *** <\/p>\n<p class=\"c-paragraph paywall \">Apart from running the Government, Ministers are shareholders in a host of companies that own and operate everything from airports to power stations, health insurers to railways.<\/p>\n<p class=\"c-paragraph paywall \">These are commercial operations which, in many cases, compete in the market to secure their top executives. They have for years operated under \u2013 and in several instances chafed against \u2013 austerity-era restrictions on top-level pay. <\/p>\n<p class=\"c-paragraph paywall \">In 2011, the then minister for public expenditure Brendan Howlin introduced, with some exceptions, a general pay cap of \u20ac250,000 for the chief executives.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Some pay rises were approved on a case-by-case basis. But several companies believed the rules placed them in a straitjacket. Performance bonuses were banned, while fixed-term contracts frequently meant chief executives having to leave after a maximum of seven years.<\/p>\n<p class=\"c-paragraph paywall \">In a booming economy, State company boards began to push against these restrictions. But Ministers, perhaps fearful of claims of pay bonanzas, were cautious.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--center\">***<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">In March last year, a few weeks after the Ballsbridge crash, the Government established a new Senior Posts Remuneration Committee (SPRC) chaired by chartered accountant Maeve Carton, who is a governor of The Irish Times Trust. Its first task was to review chief executive pay rates in the commercial State companies.<\/p>\n<p class=\"c-paragraph paywall \">Boards who had been pressing for new top-level pay structures were told they should wait for the SPRC process to play out.<\/p>\n<p class=\"c-paragraph paywall \">But the resignation of Foley as EirGrid chief executive set in train circumstances that were to lead to challenges to the Government\u2019s plans. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">As EirGrid set about finding a replacement, its chairman Brendan Tuohy told the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-the-environment-climate-and-communications\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-the-environment-climate-and-communications\/\">Department of the Environment, Climate and Communications<\/a> in June 2024 that the salary of \u20ac250,000 \u2013 which had been increased from \u20ac200,000 in May of the previous year \u2013 was an \u201cinadequate level to attract the type of candidate that we would consider the role requires\u201d.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The then minister <a href=\"https:\/\/www.irishtimes.com\/tags\/eamon-ryan\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/eamon-ryan\/\">Eamon Ryan<\/a> backed increasing the EirGrid chief executive\u2019s pay, telling <a href=\"https:\/\/www.irishtimes.com\/tags\/paschal-donohoe\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/paschal-donohoe\/\">Paschal Donohoe<\/a>, then minister for public expenditure, that the company played a critical role and was \u201cfundamental\u201d to climate targets. Donohoe agreed to \u20ac300,000.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The decision to sanction the rise outside of the SPRC process did not go unnoticed.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The EirGrid role was filled by the chief executive at another State-owned commercial company, <a href=\"https:\/\/www.irishtimes.com\/tags\/gas-networks-ireland\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/gas-networks-ireland\/\">Gas Networks Ireland<\/a> (GNI), who at the time had a salary of \u20ac225,000.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">This created a vacancy at GNI and in January this year its board contacted Minister for Housing <a href=\"https:\/\/www.irishtimes.com\/tags\/james-browne\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/james-browne\/\">James Browne<\/a> seeking an increase. Browne wrote to the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-public-expenditure-and-reform\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-public-expenditure-and-reform\/\">Department of Public Expenditure and Reform<\/a> (DPER) backing a higher salary, emphasising that the remuneration of the EirGrid boss had been adjusted before the SPRC group had issued recommendations.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The previous October, the board of another State commercial company, <a href=\"https:\/\/www.irishtimes.com\/tags\/bord-na-m&#xF3;na\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/bord-na-m&#xF3;na\/\">Bord na M\u00f3na<\/a>, had written to Ryan seeking higher pay for its chief executive Tom Donnellan, paid \u20ac225,000 already \u2013 later judged a \u201csignificant enhancement\u201d to the chief executive\u2019s terms by DPER. The details of the pay terms in place at Bord na M\u00f3na were to cause considerable alarm in DPER. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Around the same time the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-transport\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-transport\/\">Department of Transport<\/a> had sought approval to recruit a new chief executive for <a href=\"https:\/\/www.irishtimes.com\/tags\/irish-rail\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/irish-rail\/\">Irish Rail<\/a> on the existing pay rate of \u20ac225,000 and use of a car.<\/p>\n<p class=\"c-paragraph paywall \">This was sanctioned by DPER, but in February this year transport officials reported that the rail company could not secure an appropriate individual within the stipulated terms.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThere was one successful candidate who would not accept a salary that was less than approximately \u20ac300,000,\u201d it reported. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">DPER officials told their new Minister <a href=\"https:\/\/www.irishtimes.com\/tags\/jack-chambers\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/jack-chambers\/\">Jack Chambers<\/a> in February that the Department of Transport, like GNI and Bord na M\u00f3na, had referenced the EirGrid precedent. <\/p>\n<p class=\"c-paragraph paywall \">They warned that \u201cfurther requests\u201d were expected this year from other commercial State companies and that the approach taken would \u201chave implications\u201d elsewhere.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--center\">***<\/p>\n<p class=\"c-paragraph paywall \">The SPRC reported at the end of March, concluding that the existing system for determining the pay for chief executives was \u201cnot optimal in serving the interests of the commercial State bodies, the State or the taxpayer\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Submissions to the committee reveal the scale of frustration that had been building.<\/p>\n<p class=\"c-paragraph paywall \">Ryan had told the SPRC \u201ca one-size-fits-all\u201d approach was not working in attracting talent. He wanted greater flexibility for companies on contract length as well as the provision of incremental rises and some element of performance bonuses.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The submission also said the board of the <a href=\"https:\/\/www.irishtimes.com\/tags\/esb\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/esb\/\">ESB<\/a> had \u201csignificant concern\u201d that the salary for company\u2019s chief executive was insufficient.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">In the early part of last year, then minister for housing <a href=\"https:\/\/www.irishtimes.com\/tags\/darragh-obrien\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/darragh-obrien\/\">Darragh O\u2019Brien<\/a> told the committee he had received warnings from the chairs of GNI, <a href=\"https:\/\/www.irishtimes.com\/tags\/uisce-eireann\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/uisce-eireann\/\">Uisce \u00c9ireann<\/a> and the <a href=\"https:\/\/www.irishtimes.com\/tags\/land-development-agency\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/land-development-agency\/\">Land Development Agency<\/a> (LDA) that pay restrictions for their top executives posed \u201cvery real and serious risks\u201d to the work of the organisations \u2013 the first two warning they could lose their chief executives. <\/p>\n<p class=\"c-paragraph paywall \">However, the Cabinet did not adopt the SPRC report in full, instead diluting it. It decided market rates would apply but there would be no backdating of increases to May of last year, as the review proposed, and the ban on performance-related bonuses for chief executives would remain.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Jack Chambers announced a banded salary structure for chief executives in April. The boards of State commercial companies would propose a point on the banded salary structure for their chief executives\u2019 pay. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--center\">***<\/p>\n<p class=\"c-paragraph paywall \">Almost six months after the SPRC presented its findings, several State companies seem frustrated at the slow pace at which the new system is being introduced.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The Irish Times understands that <a href=\"https:\/\/www.irishtimes.com\/tags\/an-post\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-post\/\">An Post<\/a> chairman Kieran Mulvey wrote to the Department of Culture, Communications and Sport and the Minister for Public Expenditure to stress the urgency of securing the proposed pay bands to allow the company to press ahead with a recruitment process for a chief executive. The company\u2019s current chief executive <a href=\"https:\/\/www.irishtimes.com\/tags\/david-mcredmond\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/david-mcredmond\/\">David McRedmond<\/a> \u2013 who is paid a basic salary of \u20ac250,000 annually \u2013 is understood to be scheduled to leave in autumn next year. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Gas Networks Ireland, having lost its chief executive to EirGrid, sought a pay increase earlier this year, but remains in limbo with an acting chief executive. The <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-housing\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-housing\/\">Department of Housing<\/a> said the request remained \u201cunder review\u201d. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The same department said Uisce \u00c9ireann had sought a pay increase for its chief executive, Niall Gleeson, who earns \u20ac225,000. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The ESB, whose chief executive Paddy Hayes is paid a basic salary of \u20ac318,000, confirmed it made a submission in relation to his salary in April. It would not confirm the amount being sought. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\"><a href=\"https:\/\/www.irishtimes.com\/tags\/bus-eireann\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/bus-eireann\/\">Bus \u00c9ireann<\/a> too said it made a \u201cbusiness case &#8230; regarding CEO salary\u201d which is currently under consideration. Its current boss, Stephen Kent, is paid \u20ac286,000 a year. The Galway Harbour company, whose chief executive is paid \u20ac104,000, has also made a request, currently under review. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Meanwhile, the LDA has been seeking an extension to its chief executive\u2019s contract, arguing that John Coleman should be given a further five-year deal. <\/p>\n<p class=\"c-paragraph paywall \">This has run foul of DPER, which said it would \u201ccontravene long-standing policy\u201d by bringing his term to a total of 12 years. This issue of pay is in the ether here too \u2013 while no formal request for a salary increase has been lodged, a three-year contract offer to Coleman remains unsigned. <\/p>\n<p class=\"c-paragraph paywall \">The agency said in recent days that \u201cwhen compared to both commercial and public sector remuneration, the LDA CEO\u2019s total pay ranks significantly behind\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The issue extends to other parts of the public sector, not just State-owned commercial companies. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Last year, the outgoing director general of the <a href=\"https:\/\/www.irishtimes.com\/tags\/environmental-protection-agency\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/environmental-protection-agency\/\">Environmental Protection Agency<\/a> wrote to its parent department saying its functions had \u201cgrown exponentially\u201d while salaries for the role and for directors have stagnated \u2013 and called for a previous link to high-level Civil Service positions to be restored. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Niall Muldoon, the <a href=\"https:\/\/www.irishtimes.com\/tags\/ombudsman-for-children\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/ombudsman-for-children\/\">Ombudsman for Children<\/a>, has made a similar bid for pay restoration, saying in private ministerial correspondence that he found failure to make a decision which he has long sought \u201cto be completely unreasonable\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The SPRC, which confined its first tranche of work to the commercial semi-States, may in time turn its attention to pay in non-commercial State organisations, or even civil servants. Government departments that have sought clarity on what comes next for the pay review body have been left without confirmation.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-justice\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-justice\/\">Department of Justice<\/a> has received one pay increase request, while the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-health\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-health\/\">Department of Health<\/a> said it has rejected two. The Department of Culture has approved one of three requests, with one still under consideration. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--center\">***<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The Government is facing the prospect of a slew of salary increases for some of the best-paid public sector staff.
