{"id":84002,"date":"2025-09-25T03:02:14","date_gmt":"2025-09-25T03:02:14","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/84002\/"},"modified":"2025-09-25T03:02:14","modified_gmt":"2025-09-25T03:02:14","slug":"academic-seeks-to-challenge-unlawful-nomination-process-for-presidential-election-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/84002\/","title":{"rendered":"Academic seeks to challenge \u2018unlawful\u2019 nomination process for presidential election \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">An academic who failed to be nominated to contest the p<a href=\"https:\/\/www.irishtimes.com\/tags\/presidential-election\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/presidential-election\/\">residential election<\/a> has applied for permission to bring a High Court challenge to the nomination process over \u201cunlawful blocking\u201d of candidates.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Mr Justice Miche\u00e1l P O\u2019Higgins said, having regard to the importance of the issues, \u201cas distinct from the grounds\u201d, raised by Dr Cora Stack, her ex parte (one side only) application for leave for judicial review should be heard on notice to the various State respondents and Tan\u00e1iste and <a href=\"https:\/\/www.irishtimes.com\/tags\/fine-gael\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/fine-gael\/\">Fine Gael<\/a> leader <a href=\"https:\/\/www.irishtimes.com\/tags\/simon-harris\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/simon-harris\/\">Simon Harris<\/a>.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Her leave application was adjourned to October 7th, when the respondents will also be heard. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Dr Stack told the court on Wednesday the process unlawfully blocked her and other Independent candidates from contesting the election and has turned it into a \u201ccomplete farce\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The courts, on behalf of the people, need to \u201cget a handle\u201d on it and make clear such \u201ccoercion\u201d is not acceptable, she said. The people are \u201cliving in a dictatorship\u201d and there is \u201can awful lot of silencing\u201d. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/politics\/2025\/09\/24\/irish-presidential-election-live-updates\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Maria Steen criticises \u2018oppressive\u2019 political consensus after failing to secure nominationOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Independent candidate <a href=\"https:\/\/www.irishtimes.com\/tags\/maria-steen\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/maria-steen\/\">Maria Steen<\/a> lost out on contesting the election by just two votes, and another Independent candidate, Gareth Sheridan, was \u201csilently\u201d blocked by <a href=\"https:\/\/www.irishtimes.com\/tags\/fianna-fail\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/fianna-fail\/\">Fianna F\u00e1il<\/a> and <a href=\"https:\/\/www.irishtimes.com\/tags\/sinn-fein\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/sinn-fein\/\">Sinn F\u00e9in<\/a>, she said. <\/p>\n<p class=\"c-paragraph paywall \">Under the process, aspiring candidates must secure nominations from either 20 members of the Oireachtas or from four local authorities.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Among her claims, Dr Stack contends that the Fine Gael leader unlawfully and unconstitutionally directed the party\u2019s TDs and councillors not to nominate Independent candidates. <\/p>\n<p class=\"c-paragraph paywall \">In his ruling adjourning the matter, the judge noted that Dr Stack, a lecturer in mathematics at the Technological University of Dublin, had in her application sought an interim order staying the entire electoral process.<\/p>\n<p class=\"c-paragraph paywall \">He was not satisfied the balance of justice would allow for the granting of such an order, he said.<\/p>\n<p class=\"c-paragraph paywall \">To ensure fairness to her, and the fair administration of justice, and noting the low threshold of arguability for granting leave, he would direct that her leave application be heard on notice.<\/p>\n<p class=\"c-paragraph paywall \">He was not saying whether the threshold had been met but, having regard to the importance of the issues raised, as distinct from the grounds, he was adjourning the application.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Dr Stack, he noted, had told the court she wanted to be a candidate, but was restricted to perhaps five minutes at council meetings and curtailed before she finished her presentation. She was unable to attend some council meetings on September 22nd last because of simultaneous scheduling of those, and could only attend two. She was locked out of a meeting of <a href=\"https:\/\/www.irishtimes.com\/tags\/meath-county-council\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/meath-county-council\/\">Meath County Council<\/a>, which she argued was arbitrary and unjust.<\/p>\n<p class=\"c-paragraph paywall \">Among her claims, she contended the current nomination process is null and void, and also alleged breach of the Protected Disclosures Act.<\/p>\n<p class=\"c-paragraph paywall \">The application concerned important issues touching on important electoral process relating to the office of president of Ireland, the judge said. <\/p>\n<p class=\"c-paragraph paywall \">When he said he was concerned the arguments sought to be raised were not fully developed, Dr Stack interrupted his ruling to say she had just one day to prepare her application.<\/p>\n<p class=\"c-paragraph paywall \">Concluding his ruling, the judge directed the leave application should be heard on notice.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Dr Stack had applied at about 11.30am to have the judge deal with the matter urgently,  by  noon, the deadline for nominations. <\/p>\n<p class=\"c-paragraph paywall \">Several other matters were already listed on Wednesday before the judge, including an urgent application by a father seeking the return from Poland of his toddler daughter, whom he has not seen since January.<\/p>\n<p class=\"c-paragraph paywall \">Dr Stack\u2019s application was unlisted and the judge said he would hear it after the listed matters, which also had some urgency.
