The foundation is written in Genesis 1:27, which states that humans were all created in the image of God. And while all the religions that hold Genesis in their canon of sacred texts differ in interpretation, Judaism is clear that every human life is a world unto itself, a line well known from the Mishnah (<a href=\"https:\/\/www.sefaria.org\/Mishnah_Sanhedrin.4.5?lang=bi\" target=\"_blank\" rel=\"noopener nofollow\">Mishnah Sanhedrin 4:5<\/a>) quoted in the movie \u201cSchindler\u2019s List.\u201d\u00a0<\/p>\n<p>So how can it be that lawmakers in Israel \u2014 a country that purportedly bases itself on Jewish teachings and values \u2014 approved a <a href=\"https:\/\/www.reuters.com\/world\/middle-east\/israeli-death-penalty-bill-palestinian-murder-convicts-faces-vote-2026-03-30\/\" rel=\"nofollow noopener\" target=\"_blank\">death penalty law<\/a> and <a href=\"https:\/\/www.npr.org\/2026\/05\/12\/g-s1-121583\/israeli-lawmakers-set-up-a-special-tribunal\" rel=\"nofollow noopener\" target=\"_blank\">tribunal<\/a> that only apply to one class of people?<\/p>\n<p>As <a href=\"https:\/\/religionnews.com\/2019\/02\/27\/the-jewish-answer-to-how-to-punish-the-pittsburgh-synagogue-shooter\/\" target=\"_blank\" rel=\"noopener nofollow\">part of a congregation<\/a> that lost 11 members in a violent antisemitic attack against our synagogue and two others in Pittsburgh in 2018, I know the pain of loss through terror. But perhaps the best rationale against the death penalty is that given by the late Nobel Peace Prize laureate and Holocaust survivor Elie Wiesel in a speech at <a href=\"https:\/\/deathpenaltyinfo.org\/new-voices-elie-wiesel-speaks-about-the-death-penalty\" rel=\"nofollow noopener\" target=\"_blank\">Wesleyan University in 2010<\/a>: \u201cI know the pain of those who sur\u00advive. \u2026 Your wound is open. It will remain. You are mourn\u00ading, and how can I not feel the pain of your mourn\u00ading? But death is not the answer.\u201d\u00a0<\/p>\n<p>Of course, there are other texts in the Hebrew Bible, a famous one being the lex talionis, which reads, \u201cthou shalt give life for life\u201d (Exodus 21: 23, Leviticus 24:18), and in Leviticus, \u201che that kills a man, he shall be put to death.\u201d(Leviticus 24:20). It is repeated in Deuteronomy 19:21, for good measure. And yet, even within the Hebrew Bible there is a drawing back, a sense that this is not absolutely applicable in all situations. The Book of Numbers notes a contingency, saying that in some cases, rather than be put to death, an assailant should be banished to a city of refuge where the family of the victim cannot seek revenge if the killing was done accidentally and without malice (Numbers 35:9-34). We see that even within the Bible, there are exceptions to what might seem in a literal reading to be an absolute rule.<\/p>\n<p>The death penalty is not just a problem from the stance of whether Jews have the right, in the absence of an authoritative court, to put others to death, as I have written <a href=\"https:\/\/www.nytimes.com\/2023\/04\/26\/opinion\/tree-of-life-synagogue-jewish-tradition-death-penalty.html\" rel=\"nofollow noopener\" target=\"_blank\">previously<\/a>. The state of Israel has claimed that it upholds modern Jewish values. Until now, the death penalty has been used in Israel only with the architect of the \u201cFinal Solution,\u201d Adolf Eichmann. Even then, there were those, most <a href=\"https:\/\/www.nytimes.com\/1962\/06\/05\/archives\/buber-calls-eichmann-execution-great-mistake-israeli-philosopher.html\" rel=\"nofollow noopener\" target=\"_blank\">famously the theologian Martin Buber<\/a>, who thought it wrong, despite the guilt of the accused. Buber did not want other Germans to think that once Eichmann was put to death they could feel less guilty for their own roles in the Holocaust.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4139062\" src=\"https:\/\/www.europesays.com\/iran\/wp-content\/uploads\/2026\/05\/webRNS-Elie-Wiesel1.jpg\" alt=\"\" width=\"750\" height=\"499\"  \/> <\/p>\n<p class=\"wp-caption-text edd-enabled\">In this Sept. 12, 2012, photo, Elie Wiesel is seen in his office in New York. (AP Photo\/Bebeto Matthews, File)<\/p>\n<p>In modern times, rabbis have <a href=\"https:\/\/religionnews.com\/2019\/02\/27\/the-jewish-answer-to-how-to-punish-the-pittsburgh-synagogue-shooter\/\" target=\"_blank\" rel=\"noopener nofollow\">effectively done away with the death penalty<\/a>. The prevailing modern Jewish opinion is that it is for God to avenge guilt \u2014 not humans.<\/p>\n<p>The other looming problem with the law the Israeli Knesset passed in March is that it provides different punishments for different classes of people; the law only allows for the execution of Palestinians convicted of terror charges \u2014 not Jews charged with similar crimes. In fact, it mandates the death penalty for Palestinians in the West Bank who are convicted of killing Jews there, <a href=\"https:\/\/www.timesofisrael.com\/experts-say-death-penalty-law-discriminatory-and-drastic-but-not-necessarily-doomed\/\" rel=\"nofollow noopener\" target=\"_blank\">according to The Times of Israel<\/a>.<\/p>\n<p>The Hebrew Bible is unequivocal that this is not right: \u201cThere shall be one law for the citizen and for the stranger who dwells among you.\u201d (Exodus 12:49, with parallels in Leviticus 24:22\u00a0and Numbers 15:15). Or, as member of Knesset and Reform Rabbi <a href=\"https:\/\/www.timesofisrael.com\/knesset-passes-death-penalty-law-for-palestinians-convicted-of-deadly-acts-of-terror\/\" rel=\"nofollow noopener\" target=\"_blank\">Gilad Kariv has stated<\/a> of the death penalty bill, \u201cThis is an immoral law that contradicts the foundational values of the state of Israel as a Jewish and democratic state, and the provisions of international law that Israel has undertaken to uphold.\u201d\u00a0<\/p>\n<p>Rather, a just society creates conditions for all to flourish. In his commentary on the Exodus verse, the late Bible scholar Nahum Sarna said the aforementioned religious law gave all residents the enjoyment of many rights and privileges, including Sabbath rest, the sabbatical year off and access to cities of refuge. In other words, a society with laws governed by the Jewish religion should create fairness for all.<\/p>\n<p>It is still unclear whether the Israeli Supreme court will permit the law, which many legal experts say is unconstitutional. The <a href=\"https:\/\/www.timesofisrael.com\/experts-say-death-penalty-law-discriminatory-and-drastic-but-not-necessarily-doomed\/\" rel=\"nofollow noopener\" target=\"_blank\">Arab-majority Hadash-Ta\u2019al <\/a>political party <a href=\"https:\/\/www.timesofisrael.com\/knesset-passes-death-penalty-law-for-palestinians-convicted-of-deadly-acts-of-terror\/\" rel=\"nofollow noopener\" target=\"_blank\">has said<\/a> the law \u201cis not merely a punitive measure \u2014 it is an official declaration of the institutionalization of apartheid and racism, and the transformation of the legal system into yet another tool in the violent political repression of the Palestinian people.\u201d The <a href=\"https:\/\/www.theguardian.com\/world\/2026\/mar\/31\/israel-death-penalty-law-international-criticism\" rel=\"nofollow noopener\" target=\"_blank\">U.N. high commissioner for human rights, Volker T\u00fcrk,<\/a> has condemned it as well, saying it is \u201cpatently inconsistent with Israel\u2019s international law obligations, including in relation to the right to life.\u201d<\/p>\n<p>One of the main drives of the bill is to prevent terrorists from being freed in prisoner exchanges, as Yahya Sinwar was in 2011. He ended up becoming the master planner of the Oct. 7, 2023, attacks. However, death penalty opponent <a href=\"https:\/\/www.jpost.com\/opinion\/article-886821\" rel=\"nofollow noopener\" target=\"_blank\">Cantor Michael Zoosman<\/a> has a simple solution, writing in The Jerusalem Post, \u201cWhat they fail to recog\u00adnize is that Israel can avoid this out\u00adcome simply by chan\u00adging the law to for\u00adbid includ\u00ading any\u00adone dir\u00adectly involved in murder in any future pris\u00adoner exchanges, without excep\u00adtion. Such legis\u00adla\u00adtion would solve the prob\u00adlem without cre\u00adat\u00ading new mar\u00adtyrs around whose memory other ter\u00adror\u00adists would assuredly rally.\u201d And as has been demonstrated in many countries, the <a href=\"https:\/\/theconversation.com\/theres-no-evidence-that-death-penalty-is-a-deterrent-against-crime-43227\" rel=\"nofollow noopener\" target=\"_blank\">death penalty is no deterrent to future criminals,<\/a> as its advocates claim.<\/p>\n<p>A bill that contradicts the value of all human life, the value of having one law for all and that will not deter criminals is clearly wrong.
