{"id":115192,"date":"2026-05-15T12:59:09","date_gmt":"2026-05-15T12:59:09","guid":{"rendered":"https:\/\/www.europesays.com\/iran\/115192\/"},"modified":"2026-05-15T12:59:09","modified_gmt":"2026-05-15T12:59:09","slug":"netanyahu-and-israel-threaten-to-sue-the-new-york-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/iran\/115192\/","title":{"rendered":"Netanyahu and Israel threaten to sue The New York Times"},"content":{"rendered":"<p>The controversy over a piece in The New York Times continued to smolder on Thursday when Israeli Prime Minister Benjamin Netanyahu and his country\u2019s foreign ministry said they might sue the Times and the author of the article.<\/p>\n<p>Earlier this week, Nicholas Kristof, a two-time Pulitzer Prize-winner, wrote, <a href=\"https:\/\/www.nytimes.com\/2026\/05\/11\/opinion\/israel-palestinians-sexual-violence.html\" rel=\"nofollow noopener\" target=\"_blank\">\u201cThe Silence That Meets the Rape of Palestinians.\u201d<\/a> In it, Kristof writes about allegations of widespread rape of Palestinian prisoners in Israeli jails. He wrote that \u201cin wrenching interviews, Palestinians have recounted to me a pattern of widespread Israeli sexual violence against men, women and even children \u2014 by soldiers, settlers, interrogators in the Shin Bet internal security agency and, above all, prison guards.\u201d<\/p>\n<p>It should be noted that Kristof also wrote, \u201cThere is no evidence that Israeli leaders order rapes. But in recent years they have built a security apparatus where sexual violence has become, as a United Nations report put it last year, one of Israel\u2019s \u2018standard operating procedures\u2019 and \u2018a major element in the ill treatment of Palestinians.\u2019\u201d<\/p>\n<p>Israel\u2019s Foreign Ministry initially denounced the column, writing, \u201cThe New York Times chose to publish one of the worst blood libels ever to appear in the modern press.\u201d<\/p>\n<p>Others \u2014 such as <a href=\"https:\/\/www.timesofisrael.com\/from-rutgers-speaker-to-kristof-column-bogus-anti-israel-dog-rape-claim-goes-mainstream\/\" rel=\"nofollow noopener\" target=\"_blank\">here<\/a> and <a href=\"https:\/\/www.wsj.com\/opinion\/free-expression\/kristofs-unbelievable-tale-d9d7b6ff\" rel=\"nofollow noopener\" target=\"_blank\">here<\/a> \u2014 have weighed in and questioned the allegations made in Kristof\u2019s story.<\/p>\n<p>Then on Thursday, <a href=\"https:\/\/x.com\/netanyahu\/status\/2054911103692337300\" rel=\"nofollow\">Netanyahu put out this statement<\/a>: \u201cToday I instructed my legal advisers to consider the harshest legal action against The New York Times and Nicholas Kristof. They defamed the soldiers of Israel and perpetuated a blood libel about rape, trying to create a false symmetry between the genocidal terrorists of Hamas and Israel\u2019s valiant soldiers. Under my leadership, Israel will not be silent. We will fight these lies in the court of public opinion and in the court of law. Truth will prevail.\u201d<\/p>\n<p>In a statement earlier this week, the Times defended the story. <a href=\"https:\/\/x.com\/NYTimesPR\/status\/2054713015107273103\" rel=\"nofollow\">Times spokesperson Charlie Stadtlander said<\/a>, \u201cNicholas Kristof\u2019s deeply reported piece of opinion journalism starts with a proposition to readers: \u2018Whatever our views of the Middle East conflict, we should be able to unite in condemning rape.\u2019 He draws together on-the-record accounts and cites several analyses documenting the practice of sexual violence and abuse conducted by various parts of Israel\u2019s security forces and settlers. The accounts of the 14 men and women he interviewed were corroborated with other witnesses, whenever possible, and with people the victims confided in \u2014 that includes family members and lawyers. Details were extensively fact-checked, with accounts further cross-referenced with news reporting, independent research from human-rights groups, surveys and in one case, U.N. testimony. Independent experts were consulted on the assertions in the piece throughout reporting and fact-checking.\u201d<\/p>\n<p>While Netanyahu might threaten to sue, the question is whether he and the Israeli government actually can sue and who, specifically, was defamed? <a href=\"https:\/\/www.cbsnews.com\/news\/netanyahu-says-israel-will-sue-the-new-york-times\/\" rel=\"nofollow noopener\" target=\"_blank\">CBS News\u2019 Graham Kates wrote<\/a>, \u201cIt is unclear if litigation will be filed in the United States or Israel, or who the plaintiffs will be.\u201d<\/p>\n<p>And <a href=\"https:\/\/www.theguardian.com\/world\/2026\/may\/14\/israel-sue-new-york-times-sexual-abuse-palestinian-prisoners\" rel=\"nofollow noopener\" target=\"_blank\">The Guardian\u2019s Alice Speri and Jeremy Barr wrote<\/a>, \u201cIt is not clear in which jurisdiction Israeli officials would bring the lawsuit or whether defamation claims could even be filed by a government.\u201d<\/p>\n<p>David A Logan, a professor emeritus at the Roger Williams School of Law and media law expert, told The Guardian, \u201cThere is no chance a US court would countenance such a case.\u201d<\/p>\n<p>Mark Stephens, an international media law expert, said the idea of Israel suing the Times is, \u201cludicrous.\u201d<\/p>\n<p>In addition, Rodney Smolla, a First Amendment scholar and former president of the Vermont Law and Graduate School, told CBS News that a government itself cannot sue for defamation in the United States, adding, \u201cI think at the end of the day, courts would say this (article) is insufficiently targeting Netanyahu, and to allow him to sue is just too perilously close to allowing a suit by the government itself.\u201d<\/p>\n<p>This isn\u2019t the first time Netanyahu has threatened to sue the Times. Last year, he told Fox News that the Times \u201cshould be sued\u201d for its coverage of starvation in Gaza.<\/p>\n<p>Netanyahu said at the time, \u201cI\u2019m actually looking at whether a country can sue the New York Times. And I\u2019m looking into it right now, because I think it\u2019s such clear defamation.\u201d<\/p>\n<p>Israel never did sue the Times in that matter.<\/p>\n<p>New York Times\u2019 spokesperson <a href=\"https:\/\/x.com\/NYTimesPR\/status\/2055059712874365269\" rel=\"nofollow\">Danielle Rhoades Ha said in a statement <\/a>Thursday night: \u201cThe Israeli Prime Minister has threatened to file a libel lawsuit against The New York Times regarding Nicholas Kristof\u2019s deeply reported opinion column on sexual abuse by Israel\u2019s prison guards, soldiers, settlers and interrogators. This threat, similar to one made last year, is part of a well-worn political playbook that aims to undermine independent reporting and stifle journalism that does not fit a specific narrative.
