The petition was viewed by The Jerusalem Post.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The action stems from the mayor\u2019s alleged \u201cpattern of obstruction\u201d regarding Behar\u2019s two Freedom of Information Law (FOIL) requests for all records pertaining to his mayoral actions relating to antisemitism and Israel.<\/p>\n<p>The First FOIL request specifically sought records relating to <a href=\"https:\/\/www.jpost.com\/tags\/zohran-mamdani\" target=\"_blank\" rel=\"nofollow noopener\">Mamdani\u2019s<\/a> Executive Order 1 to rescind the definition of <a href=\"https:\/\/www.jpost.com\/diaspora\/antisemitism\/article-882099\" target=\"_blank\" rel=\"nofollow noopener\">IHRA antisemitism<\/a>, despite it being adopted by the US government, over 35 US states, over 90 American cities and counties, and many universities.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Behar is seeking all records explaining Mamdani\u2019s rationale for issuing Executive Order No. 1, records assessing its merits, interoffice communications, research, studies, public impact analyses, and directives.<\/p>\n<p><img alt=\"New York City Mayor Zohran Mamdani and his wife Rama Duwaji react as confetti falls during his inauguration ceremony in New York City, US, January 1, 2026.\" loading=\"lazy\" width=\"822\" height=\"829\" decoding=\"async\" data-nimg=\"1\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/iran\/wp-content\/uploads\/2026\/06\/710952.jpeg\"\/>New York City Mayor Zohran Mamdani and his wife Rama Duwaji react as confetti falls during his inauguration ceremony in New York City, US, January 1, 2026. (credit: REUTERS\/JEENAH MOON)<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The Second FOIL request sought records relating to the following: Mamdani\u2019s revocation of an Executive Order by the prior mayor that had banned city agencies from participating in economic warfare (BDS) against Israel; Mamdani\u2019s decision to remove NYC Economic Development Corp webpages promoting the city\u2019s ties with Israeli companies and entrepreneurs; and Mamdani\u2019s vow when running for mayor to terminate the public-private partnership between Cornell University and the Technion in Israel.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Behar submitted the two FOIL requests to the Office of the Mayor of New York City on January 13, 2026, and May 8, 2026.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">There has been no response.<\/p>\n<p>Behar describes the city&#8217;s conduct as &#8216;unlawful&#8217;<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">According to Behar and Mastro, the City\u2019s conduct in response to the FOIL requests is \u201cunlawful,\u201d mainly because under Public Officers Law \u00a7 89(3)(a), an agency must acknowledge a FOIL request within five business days and must grant or deny access to the requested records within a reasonable time thereafter, not to exceed 20 business days.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The case has been expedited by state Supreme Court Judge Gerald Lebovits, and the case will be fully submitted to the judge by July 2 and ready for a decision by that point.<\/p>\n<p>Behar told the Post that the backdrop for his demands is the rising <a href=\"https:\/\/www.jpost.com\/diaspora\/antisemitism\" target=\"_blank\" rel=\"nofollow noopener\">antisemitism<\/a> in the city, something which has arguably worsened under the anti-Israel mayor.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">\u201cAt a time when antisemitic violence in New York City has reached historic levels, the public has a compelling interest in understanding why Mayor Mamdani chose, as his first official act, to dismantle the very protections his predecessor had put in place to address this crisis.\u201d<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Mastro submitted the petition on Behar\u2019s behalf. Mastro was appointed first deputy mayor of New York City by the previous mayor, Eric Adams. As part of this role, Mastro was tasked with overseeing the newly-established Mayor\u2019s Office to Combat Antisemitism.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Before this, he also served as deputy mayor for operations under former mayor Rudy Giuliani.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Judge Lebovits, who will preside over the case, is the son of a Holocaust survivor. In 2019, he wrote a book named Holocaust Houdinis about his family\u2019s story of survival.<\/p>\n<p>ADL findings on the potential impact of New York&#8217;s divestment from Israel<\/p>\n<p>Earlier this month, the Post reported on new research by the Anti-Defamation League (ADL), which found that Israel divestment could <a href=\"https:\/\/www.jpost.com\/diaspora\/antisemitism\/article-898990\" target=\"_blank\" rel=\"nofollow noopener\">cost New York City taxpayers<\/a> more than $37 billion over the next decade.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Carried out with its affiliate, JLens, the ADL report examines the potential impact on the city\u2019s pension funds of investment policies excluding companies that do business in Israel.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The report estimates approximately $37.55 billion in potential forgone value over a 10-year period, assuming a similar performance gap, when applied to the NYC pension funds\u2019 estimated large-cap US public equity allocations (assets invested in large US companies).<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">\u201cWhile some in New York, including Mayor Mamdani, have publicly supported the BDS movement,\u201d Jonathan Greenblatt, ADL\u2019s CEO and national director, said, \u201cthis analysis highlights the potentially serious financial consequences of applying BDS-aligned divestment strategies to the city\u2019s pension funds.\u201d<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">\u201cThis research shows that divestment strategies guided by the BDS campaign can be bad fiscal policy, and we believe that they risk contributing to an environment where Jewish New Yorkers are already targeted and marginalized,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"Ex-deputy NYC mayor Randy Mastro and investigative journalist Richard Behar have filed a suit against NYC Mayor Zohran&hellip;\n","protected":false},"author":2,"featured_media":178195,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":"","_share_on_mastodon":"0"},"categories":[33],"tags":[6826,2492,5143,37,10957,4204,8983],"class_list":["post-178194","post","type-post","status-publish","format-standard","has-post-thumbnail","category-israel","tag-adl","tag-antisemitism","tag-diaspora","tag-israel","tag-lawsuit","tag-new-york","tag-zohran-mamdani"],"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@iran\/116815331704688871","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/posts\/178194","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/comments?post=178194"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/posts\/178194\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/media\/178195"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/media?parent=178194"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/categories?post=178194"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/iran\/wp-json\/wp\/v2\/tags?post=178194"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
