{"id":28975,"date":"2026-03-20T22:24:09","date_gmt":"2026-03-20T22:24:09","guid":{"rendered":"https:\/\/www.europesays.com\/iran\/28975\/"},"modified":"2026-03-20T22:24:09","modified_gmt":"2026-03-20T22:24:09","slug":"strait-of-hormuz-legal-framework-for-us-plan-to-provide-maritime-reinsurance-latin-america-global-law-firm","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/iran\/28975\/","title":{"rendered":"Strait of Hormuz: Legal framework for US&#8217; plan to provide maritime reinsurance | Latin America | Global law firm"},"content":{"rendered":"<p>In light of ongoing and active hostilities in Iran and the surrounding region since February 28, 2026, owners, operators and charterers and traders of vessels operating in and around the Strait of Hormuz should be aware of the following developments: <\/p>\n<p>    Major insurers have issued notices of cancellation with respect to war risk insurance coverage for vessels in the region: Beginning March 1, 2026, a number of major industry insurers have issued notices of cancellation with respect to war risk insurance coverage for vessels traveling through the Persian Gulf, Gulf of Oman and Strait of Hormuz.<br \/>\n    President Trump has ordered the <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/\" target=\"_blank\">United States International Development Finance Corporation<\/a> (<a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/\" target=\"_blank\">DFC<\/a>) to make insurance available to protect affected maritime trade: In response to the above notices, President Trump announced via a <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/116166926920657651\" target=\"_blank\">Truth Social post<\/a> on March 3, 2026, that he had ordered the <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/about-us\" target=\"_blank\">DFC<\/a>, which describes itself as the \u201cinternational investment arm of the US government,\u201d to provide \u201cpolitical risk insurance and guarantees\u201d for maritime trade traveling through \u201cthe Gulf.\u201d<br \/>\n    DFC has announced plan to provide insurance covering losses of up to US$20 billion: On March 6, 2026, the DFC <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/media\/press-releases\/dfc-announces-20b-plan-maritime-reinsurance-gulf\" target=\"_blank\">announced a US$20 billion plan<\/a> \u201cto deploy Maritime Reinsurance, including war risk, in the Gulf region,\u201d noting that businesses and financial institutions seeking to access the DFC&#8217;s Insurance and Guaranty products should contact the DFC directly at <a href=\"https:\/\/www.nortonrosefulbright.com\/en-419\/knowledge\/publications\/938cb025\/mailto:maritime@dfc.gov\" rel=\"nofollow noopener\" target=\"_blank\">maritime@dfc.gov<\/a>. On March 11, 2026, the DFC also announced that they had chosen the lead insurance partner for the Maritime Reinsurance plan. <\/p>\n<p>Background on the DFC and budgetary considerations<\/p>\n<p>The DFC is a wholly owned US government corporation established under the <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/senate-bill\/2463\" target=\"_blank\">Better Utilization of Investments Leading to Development Act<\/a> of 2018 (<a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/senate-bill\/2463\" target=\"_blank\">BUILD Act<\/a>). The stated purpose of the BUILD Act was to consolidate the functions of the <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/oig.usaid.gov\/OPIC\" target=\"_blank\">Overseas Private Investment Corporation<\/a> (<a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/oig.usaid.gov\/OPIC\" target=\"_blank\">OPIC<\/a>) and the Development Credit Authority of the US Agency for International Development (USAID) into a single federal agency. Through the consolidation of OPIC and USAID, the DFC serves as the US&#8217; primary development finance institution, facilitating investment in foreign markets to support US foreign policy objectives. <\/p>\n<p>The Board of Directors is composed of both government and non-government members including a Chief Executive Officer, appointed by the President with the advice and consent of the Senate. The eight currently sitting members of the Board of Directors for the DFC are as follows:\u00a0 <\/p>\n<p>    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/ben-black\" target=\"_blank\">Ben Black<\/a>, Chief Executive Officer<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/marco-rubio\" target=\"_blank\">Marco Rubio<\/a>, Secretary of State, US Department of State<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/eric-ueland\" target=\"_blank\">Eric Ueland<\/a>, PTDO Administrator, US Agency for International Development<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/scott-bessent\" target=\"_blank\">Scott Bessent<\/a>, Secretary of the Treasury, US Department of the Treasury<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/howard-lutnick\" target=\"_blank\">Howard Lutnick<\/a>, Secretary of Commerce, US Department of Commerce<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/irving-w-bailey-ii\" target=\"_blank\">Irving W. Bailey II<\/a>, Senior Advisor, Chrysalis Ventures<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/board-member\/christopher-p-vincze\" target=\"_blank\">Christopher P. Vincze<\/a>, Chairman and CEO, TRC Companies, Inc.<br \/>\n    <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/deven-parekh\" target=\"_blank\">Deven Parekh<\/a>, Managing Director, Insight Partners<\/p>\n<p>The Board is responsible for setting DFC policy, implementing statutory requirements and advancing executive priorities, particularly with respect to the President\u2019s foreign affairs powers under Article II of the US Constitution. <\/p>\n<p>Pursuant to the BUILD Act, the DFC is authorized to provide direct loans, loan guarantees, equity investments and insurance, with such insurance backed by the full faith and credit of the US government. With respect to insurance, the BUILD Act broadly authorizes the DFC to \u201cissue insurance or reinsurance, upon such terms and conditions as the [DFC] may determine, to private sector entities and qualifying sovereign entities assuring protection of their investments in whole or in part against any or all political risks such as currency inconvertibility and transfer restrictions, expropriation, war, terrorism, civil disturbance, breach of contract, or non-honoring of financial obligations.\u201d<\/p>\n<p>One consideration regarding the announced insurance program is budgetary constraints, as all DFC-backed projects must be evaluated by the DFC for \u201ceconomic and financial soundness and development objectives\u201d and the DFC must notify certain congressional committees regarding any financial commitment exceeding US$100 million (though congressional approval is notably not required).<a href=\"file:\/\/\/C:\/Users\/mc59892\/Downloads\/Strait%20of%20Hormuz%20Article%20-%20NRF%20Draft%203.10.2026%20-%20ML%20edits_Comms.docx#_edn2\" name=\"_ednref2\">2<\/a>\u00a0More significantly, as the DFC must operate within DFC\u2019s congressionally approved maximum contingent liability, which is currently US$250 billion through 2031.\u00a0Industry commentators have observed that such fiscal constraints may materially affect the scale of coverage the DFC is able to provide. <\/p>\n<p>President Trump orders DFC to insure maritime trade in affected areas<\/p>\n<p>On March 3, 2026, President Trump announced that he had ordered the <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/who-we-are\/about-us\" target=\"_blank\">DFC<\/a> to provide \u201cpolitical risk insurance and guarantees\u201d for maritime trade traveling through \u201cthe Gulf,\u201d although the announcement did not precisely specify which areas \u201cthe Gulf\u201d is referring to. On the same day, the DFC put out a <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/media\/press-releases\/dfcs-political-risk-insurance-and-guaranty-products-will-support-private\" target=\"_blank\">media release<\/a> noting it was \u201cready to mobilize its Political Risk Insurance and Guaranty products\u201d in accordance with these orders. <\/p>\n<p>On March 6, 2026, the DFC made an additional <a rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dfc.gov\/media\/press-releases\/dfc-announces-20b-plan-maritime-reinsurance-gulf\" target=\"_blank\">announcement<\/a>, providing more specific details on such an initiative, announcing a DFC maritime reinsurance facility which \u201cwill insure losses up to approximately US$20 billion on a rolling basis\u201d launched in coordination with the US Central Command and the US Department of the Treasury. The announcement noted the insurance will \u201cfocus on Hull &amp; Machinery and Cargo to start\u201d and \u201capply only to vessels that meet the criteria,\u201d though the specifics of such \u201ccriteria\u201d have yet to be announced.<\/p>\n<p>On March 11, 2026, the DFC further announced its selection of a leading international insurer \u201cas the lead underwriter issuing policies for eligible vessels.\u201d<\/p>\n<p>Though exact details remain to be seen, both the President\u2019s announcement and the DFC\u2019s releases note the coverage would be available to protect all marine shipping in the \u201cGulf\u201d or \u201cGulf Region,\u201d with a particular emphasis placed on ensuring the security of energy trade. <\/p>\n<p>Generally, the Political Risk Insurance offered by the DFC provides coverage of up to US$1 billion against losses due to: <\/p>\n<p>    Currency inconvertibility<br \/>\n    Expropriation<br \/>\n    Political violence<br \/>\n    Arbitral award default<br \/>\n    Denial of recourse<br \/>\n    Non-honoring of sovereign financial obligations <\/p>\n<p>The DFC\u2019s \u201cpolitical violence\u201d coverage, in particular, generally protects against income and asset losses caused by: <\/p>\n<p>    Declared or undeclared war<br \/>\n    Hostile actions by national or international forces<br \/>\n    Revolution, insurrection and civil strife<br \/>\n    Terrorism and sabotage <\/p>\n<p>In addition to the above, the DFC notes that \u201cpolitical violence\u201d coverage is available to cover: <\/p>\n<p>    evacuation expenses,<br \/>\n    income losses resulting from temporary abandonment of a project caused by political violence and<br \/>\n     income losses resulting from damage to specific sites outside the insured facility, such as a critical railway spur, power station or supplier.<\/p>\n<p>Beyond insurance coverage, the President\u2019s announcement further noted that \u201c[i]f necessary, the US Navy will begin escorting tankers through the Strait of Hormuz, as soon as possible.\u201d\n<\/p>\n<p>The DFC releases state that affected businesses and financial institutions seeking to access DFC&#8217;s Insurance and Guaranty products or DFC&#8217;s Maritime Reinsurance product should contact DFC directly at <a href=\"https:\/\/www.nortonrosefulbright.com\/en-419\/knowledge\/publications\/938cb025\/mailto:maritime@dfc.gov\" rel=\"nofollow noopener\"
