Ed Markey, D-Mass., is\u00a0<a href=\"https:\/\/x.com\/SenMarkey\/status\/2041653455698227278\" rel=\"nofollow\">calling for the removal<\/a>\u00a0of President Donald Trump over his actions in Iran \u2013\u00a0even after the United States and Iran\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/world\/2026\/04\/08\/iran-war-ceasefire-strait-hormuz-trump-updates--live\/89509782007\/\" rel=\"nofollow noopener\" target=\"_blank\">came to a ceasefire<\/a>\u00a0on April 7.<\/p>\n<p>\u201cI\u2019m glad there is a reported ceasefire deal with Iran. But we shouldn\u2019t be in this illegal war in the first place. And Donald Trump can\u2019t simply threaten war crimes with impunity,\u201d Markey posted on social media April 7. \u201cCongress needs to get back in session now to stop this war and remove Donald Trump.\u201d<\/p>\n<p>Markey had originally called for Trump\u2019s removal, either by impeachment or through the 25th Amendment, after the president threatened to\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2026\/04\/07\/donald-trump-iran-war-maga-bridges-power-plants\/89497525007\/\" rel=\"nofollow noopener\" target=\"_blank\">wipe out a \u201cwhole civilization\u201d<\/a>\u00a0if Iran did not capitulate to U.S. demands.<\/p>\n<p>\u201cHe has threatened war crimes on an apocalyptic scale and appears eager to commit them, including through the possible use of nuclear weapons,\u201d Markey said\u00a0<a href=\"https:\/\/www.markey.senate.gov\/news\/press-releases\/senator-markey-calls-for-trump-removal-over-threat-to-eradicate-civilization-in-iran\" rel=\"nofollow noopener\" target=\"_blank\">in a statement.<\/a>\u00a0\u201cThe Congress must act now.\u201d<\/p>\n<p>Trump threatens Iran<\/p>\n<p>On April 7, Trump issued a\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/graphics\/2026\/04\/07\/trump-threatens-postpones-iran-attacks\/89501786007\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">strongly worded threat\u00a0<\/a>against Iran.<\/p>\n<p>\u201cA whole civilization will die tonight, never to be brought back again. I don\u2019t want that to happen, but it probably will,\u201d he posted on Truth Social.\u00a0<\/p>\n<p>The post prompted\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2026\/04\/07\/donald-trump-iran-war-maga-bridges-power-plants\/89497525007\/\" rel=\"nofollow noopener\" target=\"_blank\">backlash across the aisle<\/a>, with Democrats like Markey and Illinois Gov. JB Pritzker to even former Georgia GOP Rep. Marjorie Taylor Greene\u00a0<a href=\"https:\/\/x.com\/FmrRepMTG\/status\/2041499550012084690\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">suggesting<\/a>\u00a0that\u00a0Trump should be removed from office.<\/p>\n<p>What is the 25th amendment?Markey, along with others like Greene and the NAACP, said that the cabinet and the Vice President must\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2026\/04\/07\/what-is-25th-amendment-trump-iran-war\/89500481007\/\" rel=\"nofollow noopener\" target=\"_blank\">invoke the 25th\u00a0Amendment<\/a>\u00a0to remove Trump.<\/p>\n<p>The<a href=\"https:\/\/constitutioncenter.org\/the-constitution\/amendments\/amendment-xxv\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">\u00a025th Amendment to the U.S. Constitution<\/a>\u00a0lays out the rules of succession for the presidential office and those for presidential disability or removal.<\/p>\n<p>Part of the amendment outlines the process for a removal of a president who is unable or unwilling to perform their duties. In the case the president is incapable of serving but does not voluntarily transfer power, they can be declared unable to hold the position by the vice president, along with a &#8220;majority of either the principal officers of the executive departments or of such other body as Congress may by law provide.&#8221;<\/p>\n<p>The terms &#8220;unable&#8221; and &#8220;inability&#8221; were left intentionally broad, according to the\u00a0<a href=\"https:\/\/constitutioncenter.org\/blog\/how-the-constitutions-25th-amendment-works\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">National Constitution Center<\/a>. Legal scholars have cited impeachment, physical disability or &#8220;political emergencies&#8221; like kidnapping as potential scenarios for the use of Section 4.<\/p>\n<p>Can the 25th\u00a0Amendment be used to remove Trump?<\/p>\n<p>Theoretically, the 25th Amendment can be invoked by or against any sitting president. However, the bar for clearing its use is much higher than for other actions like impeachment.<\/p>\n<p>Modern interpretations from scholars at institutions like\u00a0<a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/amendment-25\/overview-of-twenty-fifth-amendment-presidential-vacancy-and-disability\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Cornell Law<\/a>\u00a0and the Congressional Research Service say the majority, if not all, of the acting Cabinet heads would need to sign on with the vice president to put Section 4 into action.\u00a0<\/p>\n<p>Neither\u00a0<a href=\"https:\/\/www.usatoday.com\/news\/politics\/jd-vance\/\" rel=\"nofollow noopener\" target=\"_blank\">JD Vance<\/a>\u00a0and nor any of the relevant Cabinet members have expressed support for removing Trump or taking punitive action against him. And it\u2019s also unclear whether Trump would qualify as being \u201cunable\u201d to serve as president.<\/p>\n<p>\u201cUnfortunately, invoking the 25th\u00a0is not\u00a0realistic\u00a0right\u00a0now, given his oddball cabinet of sycophants and eccentrics, and Republican \u2019spines of foam,\u2019\u201d Sen. Sheldon Whitehouse, D-R.I., said\u00a0<a href=\"https:\/\/x.com\/SenWhitehouse\/status\/2041559794041909291\" rel=\"nofollow\">on social media<\/a>\u00a0April 7. \u201cWe\u2019re going to have to buckle down and win this the old-fashioned way.\u201d<\/p>\n<p>Can Trump be impeached?<\/p>\n<p>Markey also said that Trump could be removed through the impeachment process.\u00a0<\/p>\n<p>To impeach a president, the House must pass the articles of impeachment by a\u00a0<a href=\"https:\/\/www.usa.gov\/impeachment\" rel=\"nofollow noopener\" target=\"_blank\">simple majority vote<\/a>. Then,\u00a0<a href=\"https:\/\/www.senate.gov\/about\/powers-procedures\/impeachment.htm\" rel=\"nofollow noopener\" target=\"_blank\">two-thirds<\/a>\u00a0of the Senate must vote to convict and remove him.<\/p>\n<p>Trump was impeached twice by the House of Representatives during his first term, but the Senate did not convict and remove him from office.<\/p>\n<p>It\u2019s likely that impeachment would be difficult now as both the House and the Senate are currently controlled by Republicans, few of whom have expressed interest in impeaching Trump.<\/p>\n<p>What to know about the ceasefire<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" rel=\"nofollow noopener\" target=\"_blank\">two-week ceasefire<\/a>\u00a0between the United States and Iran is now underway following an 11th\u00a0hour deal struck just before a deadline imposed by Trump. Both countries declared victory.<\/p>\n<p>While negotiations take place and the fighting halts, Iran said\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/world\/2026\/04\/07\/why-is-the-strait-of-hormuz-so-important\/89508780007\/\" rel=\"nofollow noopener\" target=\"_blank\">the Strait of Hormuz will remain open<\/a>.
