The Department of Homeland Security ended protection for people from <a href=\"https:\/\/www.dhs.gov\/news\/2025\/06\/27\/dhs-terminates-haiti-tps-encourages-haitians-obtain-lawful-status\" rel=\"nofollow noopener\" target=\"_blank\">both<\/a> <a href=\"https:\/\/www.dhs.gov\/news\/2025\/09\/19\/secretary-noem-announces-termination-temporary-protected-status-syria\" rel=\"nofollow noopener\" target=\"_blank\">countries<\/a> in 2025, but lower court orders later <a href=\"https:\/\/www.scotusblog.com\/2026\/03\/temporary-protected-status-and-the-supreme-court-an-explainer\/\" rel=\"nofollow noopener\" target=\"_blank\">blocked<\/a> this.  <\/p>\n<p dir=\"ltr\">Congress established <a href=\"https:\/\/www.americanimmigrationcouncil.org\/fact-sheet\/temporary-protected-status-tps-overview\/\" rel=\"nofollow noopener\" target=\"_blank\">TPS<\/a> in 1990 to temporarily prevent people from being deported into dangerous situations, such as wars or natural disasters. The Secretary of Homeland Security can grant TPS for a particular country for up to 18 months and then either renew or terminate it after that. Nearly 300,000 Haitians and 6,000 Syrians currently <a href=\"https:\/\/wng.org\/podcasts\/a-temporary-program-endures-1777409471\" rel=\"nofollow noopener\" target=\"_blank\">reside<\/a> in the United States under TPS.<\/p>\n<p dir=\"ltr\">In 2025, the DHS had TPS protections in place for 17 countries but has since moved to end it for <a href=\"https:\/\/lawofficeimmigration.com\/blog\/tps-under-attack-countries-losing-protection.html\" rel=\"nofollow noopener\" target=\"_blank\">nearly<\/a> <a href=\"https:\/\/wng.org\/sift\/the-u-s-ends-special-protections-for-somali-nationals-1768347409\" rel=\"nofollow noopener\" target=\"_blank\">all<\/a> <a href=\"https:\/\/wng.org\/roundups\/why-is-the-united-states-ending-temporary-protected-status-for-afghans-1744920641\" rel=\"nofollow noopener\" target=\"_blank\">of<\/a> them. <\/p>\n<p dir=\"ltr\">What were the arguments Wednesday? U.S. Solicitor General D. John Sauer argued on behalf of the DHS that the government has power over the TPS program, not the courts. He emphasized that the program was designed to be temporary. Several justices pressed Sauer on arguments from Haiti that DHS\u2019s actions were motivated by racism. Sauer said none of the remarks from the DHS on Haiti indicated any racist motivations. <\/p>\n<p dir=\"ltr\">Ahilan Arulanantham, a professor at the UCLA School of Law, argued the case on behalf of people from Syria while attorney Geoffrey Pipoly represented Haiti. They argued that both countries are still in crisis and people can\u2019t return to them safely. Haitians were first granted protection after a catastrophic earthquake hit the region in 2010. Following this, gang violence has continued to <a href=\"https:\/\/wng.org\/sift\/violence-in-haiti-worsens-as-new-gang-suppression-force-planned-1774474373\" rel=\"nofollow noopener\" target=\"_blank\">impact<\/a> the country. Syrians received TPS as a result of a 13-year Syrian <a href=\"https:\/\/wng.org\/sift\/u-s-withdraws-from-syrian-base-1770936811\" rel=\"nofollow noopener\" target=\"_blank\">civil war<\/a>.
