Popular Italian food distributor faces lawsuit over \u2018false\u2019 branding"},"content":{"rendered":"<p>Two shoppers in <a href=\"https:\/\/www.independent.co.uk\/topic\/california\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:California;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">California<\/a> are looking to sue Cento Fine Foods, alleging it is committing &#8220;tomato fraud.&#8221;<\/p>\n<p>The proposed<a href=\"https:\/\/www.independent.co.uk\/bulletin\/news\/meta-mark-zuckerberg-ai-publishers-copyright-b2971023.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:class-action lawsuit;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\"> class-action lawsuit<\/a> accuses the company of falsely branding its <a href=\"https:\/\/www.aol.com\/news\/scientists-create-world-first-tomatoes-111001742.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:tomato products;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">tomato products<\/a> with claims that it uses San Marzano Certified tomatoes, <a href=\"https:\/\/abcnews.com\/GMA\/Food\/popular-italian-food-brand-accused-tomato-fraud-new\/story?id=132678999\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:ABC News reports;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">ABC News reports<\/a>. That specific type of tomato is grown in <a href=\"https:\/\/www.independent.co.uk\/topic\/italy\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Italy\u2019s;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Italy\u2019s<\/a> Campania region, and is prized for its flavor.<\/p>\n<p>In the same way that sparkling wines marketed as <a href=\"https:\/\/www.aol.com\/news\/ministers-were-stockpiling-french-wine-151255029.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:champagne;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">champagne <\/a>should originate from France&#8217;s Champagne region, under European Union law and international treaties, a true San Marzano tomato should always originate from Campania in southern Italy under E.U. rules.<\/p>\n<p>&#8220;Defendant&#8217;s marketing and labeling of Cento San Marzanos as &#8216;Certified San Marzano&#8217; tomatoes is false, misleading, and unfair,&#8221; the lawsuit states. &#8220;They lack the taste, consistency, and other physical characteristics associated by consumers with certified San Marzano Tomatoes.&#8221;<\/p>\n<p>Tomatoes certified as DOP, or Denominazione d&#8217;Origine Protetta, are reviewed by Il Consorzio di Tutela del Pomodoro San Marzano DOP, an independent consortium regulating the tomatoes&#8217; origins.<\/p>\n<p><img alt=\"A can of Cento Fine Foods' San Marzano tomatoes. Two Californians are suing the company over alleged &#8216;tomato fraud,&#8217; claiming the tomatoes it uses are not certified by an Italian consortium that regulates the origin on San Marzano tomatoes (U.S. District Court for the Northern District of California)<\/p>\n<p>The lawsuit accuses Cento, which is based in New Jersey, of using marketing that is meant to trick consumers into thinking that the company is using certified San Marzano tomatoes in its products.<\/p>\n<p>It specifically alleges that Cento has created &#8220;an erroneous impression that they contain DOP certified San Marzano Tomatoes of equivalent quality.&#8221; The suit is claiming $25 million in compensation to shoppers.<\/p>\n<p>The company claims otherwise on its website.<\/p>\n<p>&#8220;Cento Certified San Marzano Tomatoes have always been and continue to be grown and produced in an area known as the Sarnese Nocerino area of <a href=\"https:\/\/www.independent.co.uk\/topic\/italy\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Italy;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Italy<\/a>. Our production plant in the San Marzano region of Campania, Italy sits in the shadow of Mount Vesuvius,&#8221; it says.<\/p>\n<p>The company website offers ways for its consumers to track the products they buy back to their origin, including a &#8220;Find My Field&#8221; option for its tomatoes.<\/p>\n<p>An attorney representing Cento Fine Foods told ABC News that the lawsuit is &#8220;entirely without merit&#8221; and said the company would &#8220;defend this claim vigorously.&#8221;<\/p>\n<p>The statement added: \u201cWe believe this claim is entirely without merit.
