{"id":3051,"date":"2026-04-03T07:29:17","date_gmt":"2026-04-03T07:29:17","guid":{"rendered":"https:\/\/www.europesays.com\/italy\/3051\/"},"modified":"2026-04-03T07:29:17","modified_gmt":"2026-04-03T07:29:17","slug":"icc-accuses-italy-of-non-compliance-in-libyan-generals-torture-case-2","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/italy\/3051\/","title":{"rendered":"ICC accuses Italy of non-compliance in Libyan general&#8217;s torture case"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">April 2 (UPI) &#8212; The International Criminal Court on Thursday referred Italy to the Assembly of States Parties over a case in which it alleges the country has refused to comply with the court.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The case involves a Libyan general who was wanted by the ICC at The Hague for alleged crimes against humanity.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Osama Almasri Najim, also known as Almasri, the former chief of Libya&#8217;s judicial police, was arrested in November in Tripoli, Libya. He is accused of torturing prisoners, leading to the death of one. Najim was arrested in Turin, Italy, <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/RelatedRecords\/0902ebd180a94249.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:on the ICC warrant;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;on the ICC warrant&quot;}\" class=\"link \">on the ICC warrant<\/a> but was released two days later and flown to Tripoli on an Italian air force plane, <a href=\"https:\/\/www.theguardian.com\/world\/2025\/jan\/21\/libyan-general-arrested-in-turin-on-icc-warrant-for-alleged-war-crimes\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:The Guardian;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;The Guardian&quot;}\" class=\"link \">The Guardian<\/a> reported.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The <a href=\"https:\/\/www.icc-cpi.int\/news\/referral-presidency-international-criminal-court-italys-non-compliance-assembly-states-parties\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:ICC said;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;ICC said&quot;}\" class=\"link \">ICC said<\/a>, &#8220;a representative of Italy was invited to the April 1, 2026, meeting of the Bureau of the Assembly to discuss the implications of the Court&#8217;s decision regarding its non-cooperation and to present its views on how it would cooperate with the Court in the future.&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It&#8217;s unclear if an Italian representative appeared.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The ICC said the decision to refer Italy to the Assembly of States Parties was made Jan. 26.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The Assembly of States Parties is the management oversight and legislative body of the ICC.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Italian Prime Minister Giorgia Meloni has said Najim was quickly sent back to Libya because he was a risk to Italy&#8217;s national security.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">But some critics said her administration was pandering to Libya because the country helps stop the flow of migrants toward Italy, The Guardian reported.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Though Libya is not a part of the Rome statute &#8212; the founding treaty of the ICC &#8212; in May it accepted the authority of the ICC to investigate the alleged war crimes.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Meloni&#8217;s opposition criticized her after Najim was arrested in November.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Antonella Forattini, a politician in Italy&#8217;s Democratic party, said it was &#8220;a stain on our institutions and Italy&#8217;s image around the world. Libya is now demonstrating that it is ahead of our country in defending justice and legality.&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Former Prime Minister Giuseppe Conte called the issue &#8220;a humiliation for the Meloni government.&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Elly Schlein, leader of the Democratic party, said: &#8220;The Libyan authorities ordered Almasri&#8217;s arrest on charges of torture and murder &#8230; the same criminal that [the Italian government] freed and escorted home on a government flight.
