{"id":81936,"date":"2026-08-28T14:59:33","date_gmt":"2026-08-28T14:59:33","guid":{"rendered":"https:\/\/www.europesays.com\/japan\/81936\/"},"modified":"2026-08-28T14:59:33","modified_gmt":"2026-08-28T14:59:33","slug":"icc-president-tomoko-akane-details-fallout-from-us-sanctions-urges-japan-eu-to-push-back","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/japan\/81936\/","title":{"rendered":"ICC President Tomoko Akane Details Fallout From US Sanctions, Urges Japan, EU to Push Back"},"content":{"rendered":"<p>The United States has sanctioned International Criminal Court officials over the organization&#8217;s investigations into US and allied nationals, cutting them off from key financial and tech services and prompting concern in Europe and Asia about the court&#8217;s ability to function.\u00a0<\/p>\n<p>Japan, an ICC member and vocal supporter of the &#8220;rule of law,&#8221; has so far stopped short of directly criticizing the sanctions.<\/p>\n<p>ICC President Tomoko Akane spoke by telephone with The Sankei Shimbun on August 23, addressing the fallout from US sanctions against the court and calling on Japan to press Washington directly. Excerpts from the interview follow.<\/p>\n<p>What has been the impact of the US sanctions?\u00a0<\/p>\n<p>I think our VISA credit cards, including ones issued in Japan, can no longer be used. The sanctions also mean my personal Gmail is unusable.\u00a0<\/p>\n<p>After the United States moved against the ICC last year, we had already begun shifting our data from the US company Microsoft to systems based in Europe, so there has been no disruption to daily operations.\u00a0<\/p>\n<p>Financial institutions are highly concerned about sanctions exposure, but several European banks have supported ICC staff hit by sanctions and have continued to handle transactions with us. We arrange business travel and pay salaries through these banks.<\/p>\n<p>Are countermeasures possible?\u00a0<\/p>\n<p>We have pressed the European Union to invoke the &#8216;blocking statute&#8217; under EU treaty law (a measure that nullifies third-country sanctions within the EU and bars compliance with them).\u00a0<\/p>\n<p>If a mechanism were established to shield companies from US sanctions, it would encourage them to continue providing services to the ICC. That has not been realized yet.\u00a0<\/p>\n<p>The Netherlands, where the ICC is based, along with other European countries, has worked hard to secure data transfers and banking access.<\/p>\n<p><a href=\"https:\/\/featured.japan-forward.com\/japan2earth\/\" target=\"_blank\" onclick=\"gtag(&#039;event&#039;, &#039;click&#039;, {&#039;event_category&#039;: &#039;banner&#039;,&#039;event_label&#039;: &#039;japan2earth-in-article&#039;});\" rel=\"nofollow noopener\">&#13;<br \/>\n<img decoding=\"async\" src=\"https:\/\/www.europesays.com\/japan\/wp-content\/uploads\/2026\/08\/1787929173_493_japan-2-earth-masthead-v2.jpg\" alt=\"Japan 2 Earth Masthead Banner\" height=\"50%\" onload=\"gtag('event', 'impression', {'event_category': 'banner','event_label': 'japan2earth-in-article'});\"\/><\/a><br \/>\nWhat do you expect from Japan?\u00a0<\/p>\n<p>The sanctions are wrong. Trying to disable the ICC from the outside is an attack on judicial independence, and Japan needs to say so clearly.\u00a0<\/p>\n<p>Japan has upheld the rule of law and pledged support for the ICC. It&#8217;s precisely because Japan has championed the rule of law that it has earned the respect it holds in the international community. If Japan works with the EU and the UK, which share these values, it won&#8217;t be facing the United States alone.\u00a0<\/p>\n<p>Japan has worked to expand ICC membership across Asia. Other countries may now follow the US lead and move to withdraw from the court. To prevent that, Japan can show its willingness to cooperate with Asian countries\u2014which would also help build trust in Japan.<\/p>\n<p>Japan has historically followed US sanctions on counterterrorism and drug trafficking, but this ICC sanction is an entirely different matter.\u00a0<\/p>\n<p>Japan&#8217;s response so far, without directly criticizing the sanctions, likely reflected a desire to avoid escalating the US actions. But at this rate, the United States will eventually impose sanctions on the ICC as a whole. If that happens, it will mark the beginning of the collapse of the rule of law.<\/p>\n<p>How has the ICC held up operationally?\u00a0<\/p>\n<p>ICC judges are communicating directly on essential matters and remain able to continue fair trials.<\/p>\n<p>The scope of US sanctions may expand further, but there has been no major disruption among judges or staff. Having moved our electronic systems and secured banking relationships, our resilience has increased considerably.<\/p>\n<p>In Japan, a signature campaign calling for the sanctions to be withdrawn and for the Japanese government to act has gathered 60,000 supporters so far.\u00a0<\/p>\n<p>Honestly, there are times when I lose my appetite and can&#8217;t sleep, but the support I have received from Japan has become a driving force behind my determination to keep going. I was nominated by the Japanese government to serve as an ICC judge.
