A man in his 30s who was sentenced to seven years in prison for breaking into the home of actress Nana and her mother and threatening them with a weapon has again denied the charges in his appeal.
At the first hearing of the appeal on robbery causing injury, held on the 13th before the Seoul High Court’s Criminal Division 14-3, lawyers for the man, surnamed Kim, 34, argued that the lower court had made factual and legal errors and that the sentence was excessive.
Kim’s side repeated its earlier claim that he was not carrying a weapon when he entered the home. It also argued that the injuries the victims suffered were not serious.
The court decided to hold another session to consider whether to accept a witness requested by Kim’s side.
Kim was indicted on charges that he broke into Nana’s home in Acheon-dong, Guri, Gyeonggi Province, at around 5:40 a.m. on November 15 last year, threatened Nana and her mother, and demanded money.
Prosecutors applied the charge of robbery causing injury, alleging that Kim entered the home while carrying a weapon, threatened Nana and her mother by choking them, and attempted but failed to obtain money and valuables.
The lower court found Kim guilty on all counts and sentenced him to seven years in prison.
At the time, Kim argued that he had not carried a weapon while breaking in and had no intention of committing robbery, but the court rejected that claim.
In explaining its sentence, the lower court said, “The defendant broke into the victims’ residence carrying a weapon at night, a time when absolute peace must be protected, and committed the crime.” It added, “Given the gravity and seriousness of the offense, a corresponding punishment is unavoidable.”
