A judge has not ruled on the motion and court documents only show a proposed orer.<\/p>\n<p>Plaintiffs in a case against SK hynix rezoning have filed for a motion to rule in their favor effectively reversing the rezoning of the property.<\/p>\n<p>Two local Greater Lafayette residents, Lora Williams and Karl Janich, filed a joint petition in June 2025 challenging an ordinance from the city of West Lafayette that amended portions of zoning for the SK hynix plant.<\/p>\n<p>The West Lafayette City Council originally passed Ordinance 18-2025, a request to change the real estate for SK hynix from R1, a type of low-density residential area, to I3, a heavy-on-impact industrial area, in 2025.<\/p>\n<p>The rezoning gave room for an SK hynix industrial-scale semiconductor facility on the north side of Kalberer Road, west of Salisbury Street.<\/p>\n<p>In a court document filed Monday petitioners submitted motion for summary judgement, which they want to use to declare the city ordinance void.<\/p>\n<p>In an earlier document, Williams asked the court to determine if the APC had the jurisdiction to enact the ordinance in the first place, given \u201cdeficiencies in the content of the statutorily mandated published public notice.\u201d<\/p>\n<p>In a proposed order submitted to the court the petition says the APC did not use the words industrial or heavy in impact, and the plaintiffs say the notice only used \u201ccryptic zoning codes without plain-language explanation.\u201d<\/p>\n<p>According to the proposed order, the APC also did not correctly state that written objections filed with the secretary will be considered as the Indiana statute requires.<\/p>\n<p>The petitioners also said the APC did not include that oral comments would be heard. Instead, the petitioners said the notice told people who submitted written comments they would not be allowed to speak during the hearing.<\/p>\n<p>\u201cThe defects cause the published notice to fail in its essential purpose to provide a meaningful description of the proposed zoning change,\u201d the proposed summary judgment reads.<\/p>\n<p>The document further says the APC \u201clacked jurisdiction to proceed\u201d and the city \u201clacked jurisdiction to adopt the ordinance.\u201d<\/p>\n<p>The petitioners want the judge to direct the city and the APC to treat the area where the plant is planned to be built as a residential area, according to court documents filed on Monday.<\/p>\n<p>Construction for the SK hynix site already began, but if the summary judgement were to pass, all construction would stop as the document calls for any structures or changes inconsistent with R1, or residential areas, to be removed.<\/p>\n<p>Mark Crandley, an attorney for the city of West Lafayette, said the city is planning on opposing the motion and will file a response.
