[Yonhap News]

SK Group Chairman Chey Tae-won (65) reportedly disagreed with the ruling of the repatriation of the destruction of the property division that requires the payment of 944 billion won in cash to Roh So-young (65), director of the art center, due to differences between the two sides over the specific payment method.

Chairman Choi’s side offered to pay the shares along with cash, but Roh’s side reportedly stuck to paying the full amount of cash.

Analysts say that Chairman Choi, who will have to pay 130 million won in delayed interest per day if he fails to pay the property split even after the ruling is finalized, would have had no choice but to re-appeal to earn time to raise cash.

According to Yonhap News on the 16th, Chairman Choi’s side reportedly intended to accept the ruling of the court’s remand on the 24th of last month and wrap up the lawsuit that has been going on for more than nine years.

However, it encountered difficulties in securing 944 billion won in cash within about three weeks until the 14th, the deadline for re-appeal.

Chairman Choi considered selling some of SK shares, but reportedly feared the impact on stock prices and group governance if the group’s major shareholders dispose of many stocks in a short period of time.

In response, Chairman Choi reportedly proposed to Director Roh a method of paying the property split by mixing cash and stocks. If the stock price goes down, Chairman Choi reportedly put forward a condition that he compensates for the difference, but does not require a separate increase even if the stock price rises.

However, it is said that Roh expressed his position that he would accept only full cash as ordered by the court of remand.

Analysts say that Chairman Choi, who was in a position to pay a delayed interest rate of 5% per year from the day after the ruling was finalized, bought time to further review realistic payment plans while avoiding the interest burden through a re-appeal.

Chairman Choi’s representatives issued a statement at 11:59 p.m. on the 14th, one minute before the deadline for the re-appeal, informing them of the re-appeal.

In the legal community, some analysts say that if Chairman Choi disagrees with the full amount of 944 billion won, the recognition fee (a kind of lawsuit fee) due to the re-appeal will be in the billions of won range.

Chairman Choi’s side is expected to argue that there is a legal misunderstanding in the calculation of the ratio and amount of property division in the ruling of the revocation and remand at the re-appeal.

The revocation court set the standard time for calculating the price of SK shares held by Chairman Choi as April 16, 2024, the closing date of the divorce lawsuit (appeal).

Although it rejected Roh’s claim that the bill should be calculated based on June 26, the closing date of the court hearing, the situation in which the stock price surged more than five times from 160,000 won to 858,000 won between the two points was reflected in the calculation of the property division ratio. The move comes after Roh admitted that he contributed in part to the growth of SK Group and the increase in corporate value.

The property division ratio set in this way is 33.3% for Director Roh and 66.6% for Chairman Choi. In the case of director Roh, it was evaluated that he did well because it was only 1.7% lower than the rate set by the appeals court (35%).

On the contrary, Chairman Choi’s side can argue that it is contradictory to reflect the stock price fluctuations after the base point in the division ratio. It is also expected to highlight the fact that SK shares have recently plunged more than 30% to the 500,000 won range compared to the closing date of the court hearing.

사진 확대 SK Group Chairman Chey Tae-won and Art Center Director Noh So-young will attend the second mediation…

[23
62648,49911,62647,241,240,16973
post-120964","post","type-post","status-publish","format-standard","has-post-thumbnail","category-sk","tag-and-jiyeon-interest","tag-art-center","tag-repatriation-trial","tag-sk","tag-sk-group","tag-yonhap-news
["GET
