Six people, including the chairman of the Samsung Group’s super-business labor union and Samsung Electronics employees, who are accused of creating a “union blacklist” by taking personal information of more than 100,000 Samsung Electronics employees without permission, will be investigated by the prosecution.<\/p>\n

According to police and others on the 4th, Hwaseong Dongtan Police Station in Gyeonggi Province sent without detention the chairman of Samsung Group’s Samsung Electronics branch and union executive A of Seungho Choi Group on charges of violating the Personal Information Protection Act. The police also sent four Samsung Electronics employees who abnormally accessed the company’s system and inquired about other employees’ personal information on the same charges.<\/p>\n

Chairman Choi and others are suspected of using personal information of Samsung Electronics executives and employees around March, when the possibility of a general strike increased due to the approval of a vote on industrial action by the super-business union.<\/p>\n

A, who was in charge of in-house system-related work, reportedly accessed the system regardless of the purpose of his work, secured a list of more than 100,000 employees, and delivered it to the union.<\/p>\n

In April, Samsung Electronics filed a complaint with the police after confirming that data containing employees’ department names, names, company numbers, and union members were shared in an in-house group messenger chat room.<\/p>\n

The company later identified and further sued A, claiming that A accessed the company’s business site about 20,000 times in about an hour to inquire about employee personal information, and that the process was captured by the abnormal traffic detection system.<\/p>\n

The police, who launched the investigation, conducted the investigation for about five months, including securing statements related to the complaint against Samsung Electronics officials and conducting seizure and search three times.<\/p>\n

In the process, the police also reportedly investigated Choi’s remarks on YouTube broadcasts with the intention of managing employees who do not participate in the strike as a list. Through the investigation, the police decided that Chairman Choi and A were suspected of violating the Personal Information Protection Act and handed over the case to the prosecution.<\/p>\n

The four employees of Samsung Electronics, who were sent separately, were members of the ultra-corporate union, and were found to have inquired whether they joined the union using the personal information of other employees. However, it is reported that they only inquired about the information out of curiosity, but did not make a separate list or distribute it to the outside world.<\/p>\n

The police explained that the cases of two people suspected of collecting a large amount of personal information and four people caught for accessing the in-house system are separate cases that are not related to each other.<\/p>\n

The case continued even after Samsung Electronics’ labor and management agreed to drop related civil and criminal charges when they reached a wage negotiation in May.<\/p>\n

On May 20, a day before the general strike, Samsung Electronics’ labor and management sealed the strike by drawing up a provisional agreement for wage negotiations. At that time, labor and management decided to drop charges in various civil and criminal cases raised over suspicions of blacklisting, but it was found that no actual charges were filed with the police.<\/p>\n

The charge of violating the Personal Information Protection Act does not constitute an anti-will penalty that cannot be punished against the will of the victim or a pro-conflict crime that can be punished only when there is a complaint, so even if the complaint is dropped, investigation and punishment are possible.<\/p>\n

Regarding the transfer, Chairman Choi expressed his position that he received a list of employees during the dispute and was investigated for the use outside of his work, and that he is continuing related responses.<\/p>\n
