Yonhap News<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">The National Labor Relations Commission (NLRC) has again recognized Hyundai Engineering&#8217;s employer status with respect to a subcontractor labor union. However, the commission took a cautious stance on attempts to demand &#8220;split bargaining&#8221; with the prime contractor by union federation.<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">On Tuesday, the NLRC upheld an initial ruling that &#8220;recognized&#8221; Hyundai Engineering&#8217;s obligation regarding a correction request for the public notice of its bargaining demand. This means Hyundai Engineering&#8217;s employer status toward the subcontractor union is recognized, requiring it to enter into bargaining. Earlier, the Ulsan Regional Labor Relations Commission had recognized the prime contractor&#8217;s employer status on the grounds that Hyundai Engineering applied the same safety measures to subcontracted workers.<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">However, the NLRC took a cautious approach toward the union&#8217;s demand to bargain separately with the prime contractor by federation. The commission showed a strong tendency to uphold initial rulings that had dismissed such demands. On the same day, the NLRC upheld an initial ruling that dismissed a review request concerning the decision to separate bargaining units at SK Ecoplant. Earlier, the Korea Plant Construction Workers&#8217; Union had demanded that its bargaining unit be separated from the Federation of Korean Trade Unions, citing the Korean Confederation of Trade Unions&#8217; different bargaining agenda.<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">However, even though the Seoul Regional Labor Relations Commission had earlier recognized the employer status of SK Ecoplant&#8217;s subcontractor, the demand to separate the bargaining unit was not accepted. The judgment was that a bargaining unit cannot be separated based solely on differences in union ideology or history, but only when there are substantial differences in working conditions or clear reasons such as employment type.<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">The NLRC also dismissed, in line with the initial ruling, a correction request for the public notice of a bargaining demand filed by a household waste disposal workers&#8217; union against Okcheon and Boeun counties.<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">With these four rulings, the total number of cases in which the regional commissions&#8217; initial rulings differed from review decisions came to two, out of 22 review cases brought to the NLRC related to the so-called Yellow Envelope Act. This is a very low level compared with the reversal rate for first-instance civil cases in court (26.1%).<\/p>\n<p class=\"mb-4 text-[var(--color-text)] leading-relaxed\">In bargaining unit separation cases handled by labor commissions, 12 out of 30 were recognized for separation. However, nine of these were cases where separation by business division was recognized, while separation by union federation accounted for only two.<\/p>\n","protected":false},"excerpt":{"rendered":"National Labor Relations Commission.
