AUSTIN \u2013\u00a0Attorney General Ken Paxton secured a settlement with LG Electronics U.S.A., Inc. (\u201cLG\u201d) to protect Texans from unlawful privacy violations involving smart television technology. Under the agreement, LG will no longer use Automated Content Recognition (\u201cACR\u201d) technology to collect consumers\u2019 viewing data without their informed consent.\u00a0This settlement follows Attorney General Paxton\u2019s\u00a0lawsuit<\/a>\u00a0against the company.\u00a0<\/p>\n

The\u00a0agreement\u00a0requires LG to update its smart TVs to display\u00a0a pop-up\u00a0disclosure\u00a0that explains how viewing data may be collected and used.\u00a0Additionally, this\u00a0disclosure\u00a0will now be included on LG\u2019s website.\u00a0Users will be given a clear and\u00a0simple\u00a0way\u00a0to opt out of\u00a0any viewing data collection agreements.\u00a0These changes\u00a0include LG\u2019s agreement to prohibit Viewing Data transfers\u00a0in any form to the Chinese Communist Party\u00a0and\u00a0will help prevent Texans\u2019 data from being unlawfully collected through ACR technology\u00a0or\u00a0transferred without users\u2019 knowledge or consent.\u00a0<\/p>\n

\u201cLG has now taken important steps to ensure that users\u2019 viewing data will not be collected without their informed consent and that consumers maintain their fundamental right to privacy in their own homes,\u201d said Attorney General Paxton. \u201cNo electronics company should be collecting consumers\u2019 data and exposing Texans to potential surveillance by the Chinese government. I am\u00a0pleased\u00a0to see that after my office\u00a0took\u00a0action,\u00a0smart TV companies are\u00a0doing what\u00a0is necessary\u00a0to protect Texans. I will continue to\u00a0work to\u00a0aggressively hold\u00a0other smart TV companies accountable for unlawfully using ACR technology to put\u00a0consumers at risk.\u201d\u00a0<\/p>\n

This legal victory builds upon Attorney General Paxton\u2019s\u00a0previous\u00a0settlement<\/a>\u00a0with\u00a0Samsung. This agreement is\u00a0a product of\u00a0the Office of the Attorney General\u2019s\u00a0wide-sweeping\u00a0action<\/a>\u00a0against television companies to ensure Texans are safe\u00a0from being\u00a0monitored\u00a0in their own homes.\u00a0Cases against Sony and\u00a0Hisense and TCL Technology,\u00a0the latter two of which are\u00a0based in China, remain ongoing.\u00a0<\/p>\n
