Terms of Use

Nasscom Community (Platform) is operated by National Association of Software and Service Companies (Nasscom). These Terms of Use (Terms) govern an user’s access to and use of the Platform, including any content, functionality, and services offered on or through it.

By accessing or using the Platform, including by uploading, posting, or submitting any content, an user agrees to be bound by these Terms.


Nature of the Platform


The Platform enables registered users to post and share articles, images, videos, and other content.
The Platform operates solely as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 (IT Act), providing a technological means for users to share content.
Nasscom does not control, monitor, or pre-screen any content posted or submitted by users and is not responsible for the views, accuracy, legality, or completeness of any such content.


User Obligations


By using the Platform, a user represent and warrant that:


They are at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
They will use the Platform only for lawful purposes and in accordance with applicable laws and regulations.
They  will not post or share any content that: (I) infringes any intellectual property or proprietary rights of third-parties; (II) violates any law in force; (III) is defamatory, obscene, hateful, or otherwise objectionable; (IV) contains any marketing or promotional material or (V) contains false or misleading information.


In the event a user submit content on the Platform that has been generated or assisted by artificial intelligence tools, models, or automated systems (AI-Generated Content), the user acknowledges and agrees that they are solely responsible for verifying and ensuring the accuracy, legality, originality, and reliability of any AI-Generated Content they post.
The user agrees to take full responsibility and legal liability for all content that they upload, post, or publish on the Platform including AI Generated Content.

 


Intellectual Property


All rights, title, and interest in and to (i) the Platform, including its layout, design, look-and-feel, user interface elements, features, and functionality, and (ii) any content created, authored, or otherwise posted by Nasscom on the Platform (Nasscom Content), are and shall remain the exclusive property of Nasscom. Except for the limited rights expressly granted under these Terms, no rights are granted to any user in or to the Platform or Nasscom Content. Any unauthorized use of Nasscom Content shall constitute a material breach of these Terms and may result in suspension of access, takedown of infringing content, or legal action, as deemed appropriate by Nasscom.
The user who publishes the post retain ownership of any intellectual property rights in the content that they post. However, by submitting or posting content on the Platform, the user who publishes the post grants Nasscom a non-exclusive, worldwide, royalty-free, perpetual, and sublicensable license to host, store, display, and distribute such content solely in connection with operation and promotion of the Platform.
The user who publishes the post represent that they have all necessary rights, licenses, and permissions to post such content and to grant the above license to Nasscom.

 


Complaints of Breach of Intellectual Property


Nasscom respects intellectual property rights and expects users to do the same.
If any third-party believe that any content on the Platform infringes their copyright or other intellectual property rights, they may notify Nasscom in writing at community@nasscom.in. The notice must include:


Identification of the infringing content.
Proof of ownership of the intellectual property right claimed.
Contact details for further communication.

 


Nasscom’s Liability and Disclaimer


As an intermediary under the IT Act, Nasscom is not liable for any post by an user, third-party information, data, or communication link made available or hosted on the Platform, since Nasscom does not:


Initiate the transmission.
Select the receiver of the transmission.
Modify the information contained in the transmission.


Nasscom is not responsible for:


Any content posted by users.
Any loss, damage, or injury caused by reliance on user-submitted content.
Any disputes arising between users or between users and third parties.


While Nasscom may remove content that violates the law or these Terms, it does not monitor or moderate user submissions.
The Platform may contain links to third-party websites, downloadable materials, or external resources. Users acknowledge and agree that:


All external sites and downloadable content are accessed at their own risk.
Nasscom does not endorse, control, monitor, or guarantee the safety, accuracy, or availability of any third-party websites or downloadable files.
Nasscom makes no representations that the Platform, its servers, or any files available for download are free of viruses, malware, harmful code, or other security vulnerabilities.


To the fullest extent permitted by law, Nasscom shall not be liable for any loss, damage, security breach, data corruption, system failure, or other harm arising out of or relating to:


The use of, or reliance on, third-party websites or resources.
Any downloads initiated through the Platform.
Any virus, malware, malicious code, or harmful components encountered through the Platform or linked resources.


Users are responsible for implementing appropriate anti-virus protections and exercising caution when accessing external links or downloading files.

 


User Liability and Indemnification


A user shall be solely responsible for the content they post, including any claims, damages, losses, or liabilities arising from such content.
A user agree to indemnify, defend, and hold harmless Nasscom, its affiliates, officers, and employees from any claims, damages, or expenses (including legal fees) arising out of:


A breach of these Terms.
Violation of any law or rights of a third party.
Any content uploaded, published, or shared through the Platform.


Takedown and Suspension

The user agrees by making a post on the Platform that, Nasscom reserves the right to remove or disable any content, suspend or terminate user accounts, or restrict access to the Platform, at their sole discretion, if:


It receives a legitimate complaint or court order.
The content violates these Terms or any law in force.
It deems it necessary to protect its interests or those of other users.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts in Delhi shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the use of the Platform.

 


Modifications

Nasscom reserve the right to modify these Terms at any time without prior notice to a user. Updated versions of the Terms will be posted on the Platform. Continued use of the Platform after any such changes constitutes acceptance of the revised Terms.
